Abstrak :
Berdasarkan UU No. 1 Tahun 1974 tentang Perkawinan, anak dari perkawinan yang tidak dicatatkan berakibat anaknya tidak mempunyai hubungan perdata terhadap ayah biologisnya. Keberadaan Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 mengubah hubungan keperdataan anak luar kawin terhadap ayah biologisnya. Skripsi ini membahas mengenai efektivitas putusan Mahkamah Konstitusi terhadap kepentingan anak luar kawin, serta akibat dari putusan itu dalam hal terjadinya pewarisan khususnya anak luar kawin terhadap ayah biologisnya. Penelitian ini menggunakan metode yuridis normatif yang diuraikan secara deskriptif.
Hasil penelitian ini menyimpulkan bahwa ditemukan banyak kelemahan dalam putusan ini yang malah menambah masalah baru karena setelah putusan dikeluarkan pemerintah tidak segera membentuk undang-undang yang dapat memperbaharui Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan sebagaimana telah dinyatakan bahwa Pasal 43 ayat (1) dikatakan tidak mempunyai kekuatan hukum mengikat karena bertentangan dengan Undang- Undang Dasar Republik Indonesia 1945.
......Based on Act No. 1 of 1974 on Marriage, children from the unrecorded marriage has no civil relationship to the biological father. Existence of the Constitutional Court Decision Number 46/PUU-VIII/2010 has changed the civil relationship between illegitimate child to their biological father. This Thesis discuss regarding the effectiveness of the Constitutional Court's decision on the illegitimate child?s standing, and the consequences of their inheritance rights. This research using the normative juridicial method and outlined descriptively.
As the result, many flaws in this decision was found, or even add new problems because government was not immediately establish new laws that can renew the Act No. 1 of 1974 on Marriage as already stated that Article 43 paragraph (1) has no binding legal force because it conflicts with the Constitution of the Republic of Indonesia, 1945.

Abstrak :
In Indonesia society, a lot of 2 children are born outside marriage. Basically the child has no relation with his father, thus in this case inheritance law is not applicable between them according to the Civil Code, the Islamic Law compilation ( kompilasi Hukum Islam) and the Customary Law. His right under the Civil Code will arise after the acknowledgement of his father or mother, while with the father and mother's family after the official statement. Based on the Islamic Law compilation. an illegitimate child is entitled to inheritance right from his mother ang hos mother's family and vice versa. Meanwhile, since no relation with his biological father exists, no in heritance right arise. According to the concept of customary law, an illegitimate children has a civil relationship only with his mother, the refore an illegitimate child will only acquire inheritance from his mother and his mother's family. The child will not be entitled to for the inheritance from his father because there is no civil relationship with his father.

Abstrak :
Children of "siri" marriages are deemed at a disadvantage under the mariage Act, Law No. 1 Year 1974, as they ae regarded as illegitimate under state law. As a legal consequence, siri children do not derive civil rights, particulary inheritance, from their father and the father's family. This 2012 ruling of the Constitutional Courth granting judicial review of Article 43 paragraph (1)of the Marriage Act has effectively amended the said law. Siri children, including those born from mat'ah marriages, common law unions and adulterous relationships, are now given equal right accorded to legitimate children if blood ties with the father is proven or established by science and technologi and/or other evidence under the law. This paper discussed the implications of this ruling on the civil rights of illegitimate children flowing from their parental relationship with their biological father.
