Penegakan hukum hak kekayaan intelektual oleh otoritas kepabeanan ditujukan untuk melindungi pemilik atau pemegang hak dari segi ekonomi, melindungi konsumen terhadap barang-barang bermerek palsu maupun bajakan hak cipta dan untuk kepentingan negara dari segi perdagangan internasional serta penerimaan keuangan negara dilaksanakan dengan dua cara yaitu pasif dan aktif sesuai dengan ketentuan Persetujuan Trade Related Aspects of Intellectual Property Rights tentang tindakan yang diambil di perbatasan negara walaupun sudah memperlihatkan hasilnya namun masih memerlukan dukungan berupa peran serta secara aktif pemilik atau pemegang hak, masyarakat konsumen, dan kerjasama para penegak hukum, serta perangkat peraturan yang memadai. ...... Enforcement of intellectual property rights by the Customs Authority is aimed to give economic protection to the owner or holder of the right, consumer protection against counterfeit trademark and pirated goods as well as for the benefit of international trade and national revenue performed by Customs Authority in two actions, that is passive action and active action based on Trade Related Aspects of Intellectual Property Rights Agreement concerning with special requirements related to border measures although has been done successfully but it still need support in form of active participation by the owner or holder of the right, consumer as a whole, cooperation among law enforcement agencies and a set of reliable government regulation as well.

This book covers the different aspects, such as patents, trademarks and copyright of Intellectual Property (IP) from a more practical business perspective. Intellectual property and assessing its? financial value describes the differences between regions, mainly the differences between the US and EU. In addition, several tools are presented for assessing the value of new IP, which is of importance before engaging on a new project that could result in new IP or for licensing purposes. The first chapter introduces the different types of IP and illustrating the business importance of capturing and safeguarding IP, the second chapter discusses patents and other forms of IP with subsequent chapters exploring copyright and trademarks in more detail, and a concluding chapter on the future of systems that can assess new IP value.

Tesis ini membahas mengenai pemanfaatan sumberdaya hayati Indonesia oleh pihak asing dimana ada beberapa tanaman tradisional Indonesia yang dipatenkan oleh negara maju tanpa memberikan kompensasi kepada Indonesia. Negara maju menggunakan pengetahuan tradisional yang terkait dengan temulawak, brotowali, gambir, pasak bumi dan kunyit sehingga menghasilkan produk yang bernilai jual tinggi seperti obat-obatan, kosmetik, dan pangan. Hal ini tidak menguntungkan bagi Indonesia, karena bahan dasar produk-produk tersebut berasal dari Indonesia. Produk yang telah dipatenkan pun memiliki hak eksklusif/monopoli sehingga jika Indonesia membuat, menggunakan, atau menjual hal yang sama maka Indonesia harus membayar royalti kepada pemegang hak paten. Padahal apa yang telah dipatenkan oleh pihak asing tersebut disinyalir merupakan pengembangan dari pengetahuan tradisional masyarakat Indonesia yang sudah bertahun-tahun menggunakan tanaman obat tersebut untuk berbagai macam manfaat terutama obat-obatan. Sesuai dengan konvensi keanekaragaman hayati seharusnya Indonesia mendapatkan pembagian keuntungan yang adil dari hasil pemanfaatan bahan hayati tersebut. Dengan menggunakan teori strukturalis, penelitian ini melihat bagaimana hak paten merupakan alat dari para kapitalis di negara maju untuk tetap mempertahankan kekuasaannya terhadap negara berkembang (Indonesia) dan justifikasi atas eksploitasi sumberdaya hayati milik Indonesia. Struktur sistem internasional yang ada menyebabkan tidak terjadinya benefit sharing atas pemanfaatan dan komersialisasi sumberdaya hayati Indonesia. Hasil penelitian membuktikan bahwa pemanfaatan dan komersialisasi sumberdaya hayati Indonesia oleh pihak asing tanpa disertai benefit sharing disebabkan oleh beberapa faktor diantaranya kepentingan negara maju dalam TRIPs, adanya ketidaksinkronan TRIPs dan CBD, serta permasalahan internal di dalam negeri Indonesia sendiri. ......This thesis discusses the use of Indonesia's biological resources by foreign parties, where there are several traditional Indonesian plants are patented by develop countries without giving compensation to Indonesia. Developed countries using traditional knowledge related to ginger, brotowali, gambier, pasak bumi and turmeric to produce high value products such as pharmaceutivals, cosmetics, and food. It is not beneficial for Indonesia, because the basic ingredients of such products from Indonesia. The products have been patented also has exclusive rights/monopoly so that if Indonesia is making, using, or selling the same thing then Indonesia has to pay royalties to patent holders. Whereas what has been patented by a foreign party is alleged is a development of traditional knowledge of Indonesian people who have been using herbs for years for a variety of benefits, especially medication. In accordance with the convention of biodiversity, Indonesia should get a fair sharing of benefits from the utilization of these biological materials. With the use of structuralism theory, the study looks at how a patent is a tool of the capitalists in developed countries to retain power over developing countries (Indonesia) and the justification of the exploitation of Indonesia's biological resources. The structure of the existing international system led to the absence of benefit sharing of biological resources, utilization and commercialization of Indonesia. The results prove that the utilization and commercialization of Indonesia's biological resources by a foreign party without benefit sharing is caused by several factors, including the interests of developed countries in TRIPS, inappropriate of the TRIPS and CBD, and as well as internal problems within Indonesia itself.
