Abstrak :
Anak adalah anugerah terbesar bagi pasangan yang telah menikah, tetapi tidak semua pasangan mendapatkan anak setelah menikah. Salah satu jalan untuk mengatasi kerinduan akan hadirnya anak adalah dengan jalan adopsi atau melakukan pengangkatan anak. Adopsi itu sendiri bisa dilakukan tidak hanya diantara warga negara Indonesia saja tetapi bisa juga dilakukan adopsi antar negara (Inter Country Adoption} salah satu kasus (Inter Country Adoption) adalah kasus Tristan Dowse seorang anak warga Negara Indonesia yang diadopsi oleh warga negara asing (Irlandia). Kasus ini mencuat ke permukaan dikarenakan setelah permohonan adopsinya diterima pengadilan pasangan orang tua angkatnya mengajukan pembatalan adopsi tersebut dengan alasan perkembangan Tristan tidak sesuai dengan apa yang mereka harapkan. Dalam tesis ini penulis mengangkat permasalahan mengenai persyaratan yang harus dipenuhi dalam proses adopsi anak warga negara Indonesia yang diadopsi oleh warga negara asing studi kasus Tristan Dowse dan mengenai perlindungan hukum yang diberikan terhadap anak warga negara Indonesia yang diadopsi oleh warga negara asing. Untuk dapat mencari jawaban permasalahn ini penulis menggunakan metode penelitian kepustakaan yang bersifat yuridis-normatif, yaitu dengan meneliti bahan pustaka atau data sekunder. Untuk memperoleh bahan hukum primer menggunakan peraturan perundang-undangan kewarganegaraan dan perlindungan anak. Untuk memperoleh bahan hukum sekunder menggunakan literatur-literatur, serta untuk memperoleh bahan hukum tersier menggunakan kamus. Berdasarkan penelitian yang dilakukan diketahui bahwa proses adopsi Tristan Dowse seorang anak warga negara Indonesia yang diadopsi oleh warga negara asing tidak sesuai dengan peraturan perundang-undangan yang berlaku di Indonesia dan karena kasus itu terjadi pada tahun 2001 dan yang berlaku adalah Undang-undang no 62 tahun 1958 maka pada scat seorang anak warga negara Indonesia diadopsi oleh warga negara asing maka anak tersebut pindah kewarganegaraan mengikuti kewarganegaraan orangtua angkatnya dan dalam hal ini berarti segala hak dan kewajiban terhadap anak tersebut dilakukan bukan lagi menurut hukum Indonesia tapi menurut hukum negara orang tua angkatnya yaitu negara Irlandia.

In this thesis the writer promoted the problem concerning the condition that must be met in the process of adoption of the citizen's Indonesian child who was adopted by the foreign citizen of the case study of Tristan Dowse and concerning the protection of the law that was given against the citizen's Indonesian child who was adopted by the foreign citizen. To be able to look for the answer of problem this the writer used the method the research the bibliography that was juridical-normative, that is by researching the book material or the secondary data. To receive the primary legal material used the regulation and the protection of the child of the citizenship legislation. To receive the secondary legal material used literature, as well as to receive the tertiary legal material used the dictionary. Was based on the research that was carried out it was known that the process of adoption of Tristan Dowse of one of the citizen's Indonesian children who was adopted by the foreign citizen was not in accordance with the legislation regulation that was valid in Indonesia and because the case happened during 2001 and that was valid was regulations no 62 in 1958 then when one of the citizen's Indonesian children was adopted by the foreign citizen then this child moved citizenship followed his parent's adopted citizenship and in this case meant all the rights and the obligation was against this child carried out and no longer according to the Indonesian law but according to his adopted law of parent's country that is the Irish country.

Penelitian ini menggambarkan tentang keterlibatan peran pekerja sosial di Yayasan Sayap Ibu Cabang Jakarta dalam pengangkatan anak terlantar oleh warga asing (intercountry adoption). Pentingnya keterlibatan pekerja sosial dalam pengangkatan anak intercountry untuk membantu calon orang tua angkat serta memastikan bahwa pelaksanaan pengangkatan anak sesuai dengan peraturan yang berlaku di Indonesia serta harus memenuhi persyaratan sesuai Peraturan Pemerintah Nomor 54 tahun 2007 tentang Pelaksanaan Pengangkatan Anak dan Peraturan Menteri Sosial Nomor: 110/HUK/2009 tentang Persyaratan Pengangkatan Anak..Perlunya peran pekerja sosial ini untuk memastikan bahwa pengangkatan anak yang diajukan sesuai dengan peraturan yang berlaku di Indonesia serta anak berada dalam keluarga pengganti yang tepat. Penelitian ini dilakukan dengan menggunakan metode kualitatif dan pendekatan dengan wawancara mendalam dan observasi. Lokasi penelitian dilakukan di Yayasan Sayap Ibu Cabang Jakarta dengan tujuan untuk memperoleh gambaran tentang peran pekerja sosial dalam pelaksanaan pengangkatan anak Warga Negara Indonesia oleh Warga Negara Asing beserta faktor pendukung dan faktor penghambat dalam pelaksanaan peran tersebut. Penelitian ini bersifat deskriptif dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa pekerja sosial telah melakukan peran sebagai enabler, broker, mediator, empowerer, negosiator, counsellor dan administrator. ......The adoption of Indonesian citizens by foreign (intercountry adoption) is a last resort (ultimum remedium) which aims at the best intersts of the child. The implementation of adoption is carried out through various stages and must meet the requirement in accordance with Government Regulation Number 54 0f 2007 concerning Implementation of Child Apponttment and Regulation of the Minister of Social Affairs Number 110/HUK/2009 concerning Child Appointment Requirenments. In each of these stages there is an important role for social workers in assisting and making social reports on the feasibility of prospective adoptive parents and adopted children. The need for the role of social workers to ensure that the adoption of children submitted in accordance with applicable regulations in Indonesia and children are in the right substitude family. The study uses qualitative methods and approaches with in-depth interview. The location at the Jakarta Branch Sayap Ibu Foundation with the aim of obtaining an overview of the role of social workers in implementing the adoption of Indonesian citizens by foreign citizens along eith supporting factors and inhibiting favtors in the implementation of these role. This research is descriptive with a qualitative approach. The result of the study indicate that social workers have perfomed roles as enablers, brokers, mediator, empoweres, negotiator and administrator.

Adopsi internasional di Indonesia telah menjadi kenyataan sosial, dan hubungan hukum keperdataan semacam ini diliputi unsur-unsur asing yang menjadikan perbuatan hukum ini memiliki hubungan yang kompleks antara para pihak terkait sehingga memiliki konsekuensi hukum yang kompleks pula. Adopsi internasional ini merupakan persoalan HPI sehingga tinjauan dengan menggunakan aspekaspek HPI akan membantu menguraikan dan menentukan hukum yang seharusnya diberlakukan dalam persoalan tersebut dengan demikian, fungsi hukum sebagai pelindung dan penjamin hak-hak warganegaranya dapat diterapkan secara tepat. Kesimpulan yang diperoleh dalam pembahasan kasus-kasus contoh adalah Indonesia perlu terus mengupayakan terciptanya suatu sistem adopsi domestik maupun internasional yang kredibel dan menjamin perlindungan anak. ...... International adoption in Indonesia has become a social reality and it is complex because there are foreign elements surrounding it, making its legal consequences complex as well. International adoption is a Private International Law matter, hence an analysis using aspects of Private International Law will help in determining what is the applicable law so a resolution can be achieved and the law can excell in its function of guardians of public interests. In conclusion based on the case studies, Indonesia have to continue taking steps for establishing a credible adoption system that will ensure the protection of children.

Kepentingan terbaik bagi anak merupakan suatu hal yang paling utama untuk diperhatikan dalam memutuskan segala sesuatu yang berhubungan dengan anak. Hal ini sesuai dengan prinsip The Best Interest of the Child. Setiap anak memiliki hak untuk diasuh oleh orang tuanya sendiri, kecuali pada kasus-kasus dimana pengasuhan oleh orang tua biologis anak tersebut justru bertentangan dengan prinsip The Best Interest of the Child. Namun, pengasuhan alternatif terhadap seorang anak juga tidak serta merta langsung menjamin prinsip tersebut telah diterapkan secara optimal. Tujuan dari penulisan ini adalah untuk menentukan apakah pengaturan prinsip The Best Interest of the Child menurut Hukum Perdata Internasional Indonesia telah cukup memadai serta untuk menentukan apakah penerapan dari prinsip ini telah dilaksanakan secara optimal dalam pengangkatan anak antarnegara di Indonesia. Penulisan ini menjelaskan mengenai hak-hak anak yang harus terpenuhi agar prinsip The Best Interest of the Child dapat dikatakan telah diterapkan secara optimal. Lebih lanjut, penulisan ini juga bermaksud untuk menganalisa penerapan dari prinsip The Best Interest of the Child pada tiga studi kasus pengangkatan anak antarnegara di Indonesia, yaitu pada Putusan No. 480/Pdt.P/2016/PN. Jkt. Sel., Penetapan No. 659/Pdt.P/2013/PN. Mlg, dan kasus Engeline di Bali yang merupakan pengangkatan anak secara ilegal. Penulisan ini memberikan gambaran mengenai akibat-akibat yang dapat terjadi jika prinsip The Best Interest of the Child tidak diterapkan secara optimal serta saran mengenai hal-hal yang dapat dilakukan agar prinsip ini dapat diterapkan secara lebih optimal. ......The child's best interest is the most important thing to consider in deciding every matter related to a child. This is in accordance with The Best Interest of the Child principle. Every child has the right to be cared for by their biological parents, except in cases where the care of the child's biological parents is contrary to The Best Interest of the Child principle. However, alternative care for a child also does not necessarily guarantee that this principle has been implemented optimally. This paper aims to determine whether the arrangement of The Best Interest of the Child principle according to Indonesian International Private Law is sufficient and whether this principle has been implemented optimally in intercountry adoption in Indonesia. This paper explains the rights of the child that must be fulfilled to say that The Best Interest of the Child principle has been applied optimally. Furthermore, this paper also analyzes the implementation of The Best Interest of the Child principle in three intercountry adoption cases in Indonesia, namely in Decision No. 480/Pdt.P/2016/PN. Jkt. Sel., Designation No. 659/Pdt.P/2013/PN. Mlg, and the Engeline case in Bali, which was illegal adoption. This paper provides an overview of the consequences that can occur if The Best Interest of the Child principle is not applied optimally and suggestions on things that can be done to ensure that this principle is applied more optimally.

The convergence of dramatic declines in birth rates worldwide, aside from sub-Saharan Africa, the rise of untrammelled global movement of capital, people and information, and the rapid-fire dissemination of a host of new medical technologies has led to the "globalization of motherhood".
