"Kepailitan merupakan salah satu aspek hukum yang memiliki kemungkinan terjadi yang besar dalam proses perusahaan-perusahaan di Indonesia. Terdapat asas yang sangat penting dalam suatu proses kepailitan perusahaan di Indonesia yang disebut dengan asas Going Concern, dimana asas ini memberikan kesempatan bagi debitor untuk menjalankan usahanya dengan harapan dapat membayarkan hutangnya di masa depannya. Akan tetapi dalam pelaksanaannya sendiri, seringkali hambatan implementasi asas ini berasal dari berbagai pihak, dari Debitur, Kreditur, bahkan bisa juga dari pengurus atau pihak lain, di sisi lain kendala valuasi dalam kepailitan juga menjadi aspek yang penting yang dapat menentukan suatu pelaksanaan Going Concern dalam kepailitan. Penelitian ini menggunakan metode penelitian doktrinal. Hasil penelitian ini dapat dilihat bahwa Implementasi Going Concern dan aspek yang mendukung pelaksanaannya di Indonesia masih kurang, dimana banyak sisi yang harus dilihat untuk mengetahui apakah asas ini dapat dilaksanakan pada suatu perusahaan, asas ini juga berkaitan dengan valuasi/penilaian kekayaan intelektual karena dari hasil nilai ini, selain kita bisa melihat bagaimana pemberesan utang debitur, kita juga bisa melihat profitabilitas suatu perusahaan dari hasil valuasi, yang kemudian dapat berkaitan langsung dengan penerapan asas Going Concern pada perusahaan pailit. Asas Going Concern adalah asas yang penting yang dapat menyelamatkan suatu perusahaan dari keadaan pailit, akan tetapi harus ada kerja sama dari tiap pihak agar asas ini dapat diimplementasi dengan baik. Valuasi kekayaan intelektual juga memegang peran penting, karena valuasi ini yang dapat menjadi aspek yang dinilai untuk masa depan suatu perusahaan, oleh karena itu harus ada standar hukum penilaian yang tepat untuk pelaksanaan suatu penilaian kekayaan intelektual

Bankcruptcy Law is one of the most common law that has a high percentage to happen to companies in Indonesia. In Indonesia’s Bankcruptcy law policy, there is one important aspect called, Going Concern, where in this condition the company is given a chance to keep running while also hoped to be able to receive enough revenue to pay for their debts. Oftentimes, the hindrance that is faced while trying to implement this principle comes from everyone that are included in the process, whether from the debtor, creditor, or even the administor, on the other hand, the valuation process also holds an important part on valuating whether to implement the Going Concern Principle in bankcruptcy law. This research uses the doctrinal research method. In this research we can see that, the implementations and other aspects of Going Concern is still lacking, there are a lot of aspects that needs more attention to judge if the implementation of going concern is needed on a company, this principle is also connected to the valuation of the company’s intellectual property, because from this valuation can we see, the process of assets settlements, on the other side, we can also see how profitable is the company itself, which then will affect the going concern implementation. Going concern is an important principle which can save a company from a situation of Bankcruptcy, but it also need the help of all the people included to work together for the principle to work effectively. The valuation of intangible assets also holds an important part,, whereas from this valuation we can see the future of the company itself, that is why, the standards of valuations needs to be legally regulated.
