Abstrak :
Penelitian ini membahas diskresi jaksa dalam sistem peradilan pidana di Indonesia. KUHAP belum mengatur diskresi secara jelas. Konsep diskresi baru ditemukan dalam hukum administrasi, tetapi apakah konsep ini dapat diterapkan dalam hukum pidana dan bagaimana pengaturan diskresi jaksa dalam proses pemeriksaan perkara pidana di Indonesia. Penelitian ini juga mengkaji konsep penuntutan yang memungkinkan digunakannya diskresi jaksa untuk kepentingan hukum dan kepentingan umum, sekaligus memformulasikan konsep diskresi jaksa yang ideal dalam SPP Indonesia. Penelitian ini menggunakan metode penelitian kualitatif untuk mengkaji aturan hukum, prinsip, konsep, teori, dan masalah hukum terkait, dan metode kuantitatif dalam pengumpulan pandangan jaksa tentang diskresi dengan teknik survei. Hasil kajian menunjukkan bahwa diskresi dalam hukum administrasi tidak dapat langsung diterapkan dalam hukum pidana. Diskresi dalam hukum pidana terkait dengan masalah hak asasi manusia dan hanya dapat dilakukan jika diberikan kewenangan oleh undang-undang. Esensi diskresi terletak pada kebebasan jaksa dalam menilai dan menerapkan kewenangan yang dimiliki. Di Indonesia, diskresi jaksa ditemukan pada setiap tahapan sistem peradilan pidana, tetapi hanya didasarkan pada aspek kepentingan hukum dan belum mencakup aspek kepentingan umum. Pelaksanaan diskresi jaksa juga dibatasi oleh prinsip kesatuan komando di lembaga kejaksaan. Mayoritas responden jaksa di Indonesia jarang menerapkan diskresi karena birokrasi yang rumit. Mereka setuju bahwa jaksa harus memiliki independensi dan akuntabilitas yang lebih kuat. Temuan penelitian ini menawarkan pendekatan baru bagi jaksa dalam mengambil keputusan, yakni pendekatan the operational efficiency model, yang menekankan efisiensi sistem peradilan pidana dengan mempertimbangkan aspek kepentingan umum. Penelitian ini juga menawarkan konsep penuntutan yang menggabungkan asas legalitas dengan asas oportunitas, serta mempertegas posisi jaksa sebagai pengendali perkara dan menjaga independensinya. Penelitian ini juga mengusulkan konsep diskresi jaksa dalam sistem peradilan pidana, termasuk prinsip-prinsip diskresi, syarat-syarat diskresi jaksa, alternatif penyelesaian perkara oleh jaksa, dan pemaknaan ulang terhadap makna Pasal 139 KUHAP yang mencakup kepentingan umum. ......This study examines the discretion of prosecutors within the Indonesian criminal justice system. The Indonesian Criminal Procedure Code does not clearly regulate prosecutor’s discretion. While the concept of discretion has been established in administrative law, it remains unclear whether it can be applied in criminal law and how the discretion of prosecutors is regulated in the examination of criminal cases in Indonesia. This research investigates the concept of prosecution, which allows prosecutors to exercise discretion for the benefit of the law and the public interest, while formulating an ideal framework for prosecutor’s discretion in the Indonesian criminal justice system. Qualitative research methods are employed to examine legal rules, principles, concepts, theories, and related legal issues, and a quantitative approach is used to collect prosecutors' perspectives on discretion through a survey. The findings indicate that discretion in administrative law cannot be directly applied to criminal law. Discretion in criminal law is associated with human rights issues and can only be exercised if authorized by law. The essence of discretion lies in the prosecutor's freedom to assess and apply their powers. In Indonesia, prosecutor’s discretion is present at every stage of the criminal justice system, but it is currently limited to considerations of legal interests and does not encompass the public interest. The implementation of prosecutor’s discretion is further restricted by the principle of unity of command within the prosecutor's institution. The majority of surveyed prosecutors in Indonesia rarely exercise discretion due to bureaucratic complexities. They agree that prosecutors should have greater independence and accountability. The findings propose a new decision-making approach for prosecutors—the operational efficiency model—which prioritizes the efficiency of the criminal justice system while considering the public interest. Furthermore, this study presents a prosecution concept that combines the legality principles and opportunity principles, reinforcing the prosecutor's role as a case controller and preserving their independence. Additionally, the study suggests a framework for prosecutor’s discretion in the criminal justice system, including principles, criteria for prosecutor discretion, alternative case resolutions, and a reinterpretation of Article 139 of the Indonesian Criminal Procedure Code to incorporate the public interest.
