ABSTRAK Tesis ini membahas permasalahan terkait yayasan khususnya mengenai akibat hukum
yayasan sebagai badan hukum terhadap kekayaan yang dipisahkan oleh pendiri dengan
studi kasus Universitas Trisakti. Dengan menggunakan metode yuridis normatif,
diketahui bahwa landasan filosofis pendirian suatu yayasan adalah sebagai suatu badan
nirlaba dimana dalam pendiriannya pendiri memisahkan sebagian dari kekayaannya guna
untuk mewujudkan maksud dan tujuan yang bersifat sosial, agama dan kemanusiaan.
Dengan yayasan berstatus badan hukum, maka kekayaan yang telah dipisahkan oleh
pendiri tidak lagi menjadi milik pendiri dan merupakan milik yayasan. Oleh karena itu,
Yayasan Trisakti, sebagai badan hukum yang berdiri berdasarkan ketentuan dan
peraturan perundang-undangan yang berlaku, sah dan berwenang untuk melakukan
penyelenggaraan dan pengelolaan Universitas Trisakti, termasuk terhadap kekayaan yang
dimiliki Universitas Trisakti.
ABSTRACTThis thesis discusses about problems related to the foundation, particularly the legal
effect of the foundation as a legal entity to the property separated by the founder, with
University of Trisakti as the case study. By using normative juridical method, the
result of the analysis is that the philosophical assumption of foundation establishment
is a non-profit legal entity in which the founders separating a portion of his wealth in
order to realize the aims and objectives of social, religion and humanity. With the
legal status of foundation, the wealth that has been separated by the founders is no
longer belong to the founder, however is owned by the foundation. Therefore,
Trisakti Foundation, as a legal entity that established under the applicable regulations,
is legitimate and authorized to organize and manage the University of Trisakti,
including the property of University of Trisakti."
