"Skripsi ini membahas mengenai penolakan pemenuhan kewajiban imbalan jasa oleh pasien karena tidak terpenuhinya hak pasien atas informed consent dan rekam medis dalam putusan No. 396/PDT.G/2008/PN.JKT.PST. Dalam skripsi ini akan dibahas mengenai peranan informed consent dan rekam medis terkait pemenuhan kewajiban imbalan jasa oleh pasien di rumah sakit serta tanggung jawab hukum rumah sakit terkait penolakan pemenuhan kewajiban imbalan jasa oleh pasien karena tidak terpenuhinya hak pasien atas informed consent dan rekam medis khususnya dalam putusan No. 396/PDT.G/2008/PN.JKT.PST. Pembahasannya dilakukan dengan metode yuridis normatif. Hasil penelitian ini menyimpulkan bahwa informed consent dan isi rekam medis dapat dijadikan sebagai dasar pembayaran pelayanan kesehatan yang diterima pasien di rumah sakit. Hasil dari penelitian ini menyarankan agar adanya sosialisasi yang lebih terkait apa-apa saja yang menjadi hak dan kewajiban antara pasien dan rumah sakit agar masing-masing dapat sadar dan memahami secara utuh hak dan kewajibannya, khususnya dalam hal informed consent dan rekam medis sebagai dasar pembayar pelayanan kesehatan yang diterima pasien di rumah sakit.

This thesis discusses the refusal fulfillment of the service fee obligation by the patient due to the non-fulfillment of the patient's right to informed consent and medical record (study case of the court decision 396/PDT.G/2008/PN.JKT.PST). This thesis is focusing on the role of informed consent and medical records related to the fulfillment of service fee obligation by the patient in the hospital and the hospital liability related to the refusal fulfillment of the service fee obligation by the patient due to the non-fulfillment of the patient's right to informed consent and medical record especially in court decision 396/PDT.G/2008/PN.JKT.PST. Research method that is used in this thesis is normative juridical method. This thesis concluded that informed consent and medical record can be used as a basis for payment of the health services received by patients in the hospital. As the outcome, the result of this study suggests that it is advisable to make more informed socialization of the rights and obligations between the patient and the hospital so that each of them can be aware and fully understand their rights and obligations, especially in the case of informed consent and medical records as the basis for payment of the health services received by the patient in the hospital."
