"Jual-beli kapal oleh Warga Negara Indonesia atau Badan Hukum Indonesia banyak dilakukan untuk memenuhi kebutuhan transportasi sebagai negara kepulauan. Namun yang menjadi persoalan adalah apabila jual beli kapal yang berada di Indonesia dilakukan antara Badan Usaha Asing dengan Badan Usaha Indonesia dan dilakukan di luar negeri. Adapun permasalahan yang diangkat dalam penelitian ini adalah mengenai keberlakuan ketentuan Pasal 17 dan 18 AB terkait dengan kasus dalam putusan nomor 48/Pdt.G/2020/PN.Ptk; dan, analisis akta peralihan kapal yang dibuat di hadapan Notary Public di Singapura yang tidak memiliki sertfikat apostille untuk digunakan di Indonesia. Untuk menjawab permasalahan tersebut digunakan metode penelitan hukum normatif dengan tipe penelitian deskriptif analisis. Hasil analisis adalah sesuai dengan ketentuan Pasal 18 AB terhadap jual beli kapal yang dilaksanakan di Singapura berlaku ketentuan di tempat tindakan hukum itu dilakukan yaitu Singapura, sedangkan dikarenakan kapal sudah tidak terdaftar lagi di Mongolia, maka tidak berlaku ketentuan Pasal 17 AB karena sudah tidak ada unsur asing di dalamnya. Adapun saran yang dapat diberikan berupa percepatan penyelesaian  Penyusunan Rancangan Peraturan Menteri Hukum dan Hak Asasi Manusia tentang Layanan Legalisasi Apostille pada Dokumen Publik selaku peraturan pelaksana dari Konvensi Apostille dilaksanakan dengan baik dan tepat pada waktunya. Sehingga layanan Apostille dapat segera diselenggarakan di Indonesia.

The sale and purchase of vessel by Indonesian citizens or Indonesian legal entities is done a lot to meet transportation needs as an archipelagic country. However, the problem is if the sale and purchase of vessel in Indonesia is carried out between a foreign business entity and an Indonesian business entity and is carried out abroad. The issues raised in this research are the applicability of the provisions of Articles 17 and 18 AB related to the case in court judgement number 48/Pdt.G/2020/PN.Ptk; and the analysis of vessel’s deed of sale and purchase made before a Notary Public in Singapore that does not have an apostille certificate for use in Indonesia.

To answer these problems, a normative legal research method is used with the type of descriptive analysis research. The results of the analysis are in accordance with the provisions of Article 18 AB for the sale and purchase of vessel carried out in Singapore, the law applies where the legal action was carried out, namely Singapore, while because the vessel is no longer registered in Mongolia, then the provisions of Article 17 AB do not apply because there are no foreign elements in it.

The suggestions that can be given are to accelerate the completion of the regulation draft from The Minister of Law and Human Rights regarding Apostille Legalization Services on Public Documents as implementing regulations of the Apostille Convention carried out properly and on time. So that Apostille services can be immediately held in Indonesia."

"Upaya pemerintah mengenai peningkatan produksi target satu juta barel minyak pada tahun 2030 harus didukung oleh berbagai sarana yang menunjang peningkatan di industri minyak dan gas. Program tersebut dapat membawa dampak pada peningkatan stuktur lepas pantai. Dalam menunjang operasional eksplorasi dan produksi minyak dan gas dibutuhkan sarana berupa kapal. Salah satu tipe kapal yang banyak digunakan pada kegiatan lepas pantai di sektor hulu migas yaitu kapal jenis Anchor Handling Tug and Supply (AHTS). Kapal AHTS menyumbang valuasi kurang lebih 25% dari keseluruhan nilai pasar kapal lepas pantai global, menjadikannya jenis kapal lepas pantai terbesar kedua dalam hal jumlah porsi pasar. Jumlah nilai pasar kapal penunjang kegiatan lepas pantai diproyeksikan  mencapai $28,20 miliar pada tahun 2031. Pertumbuhan ini dapat dikaitkan dengan meningkatnya permintaan kebutuhan kapal AHTS untuk mendukung kegiatan operasi di sektor hulu migas. Namun dalam proses pengadaan kapal AHTS diperlukan banyak pertimbangan untuk memilih penyedia atau vendor yang paling sesuai dengan kebutuhan. Salah satu upaya untuk penyelesaian masalah tersebut ialah dengan merancang suatu Sistem Pendukung Keputusan (SPK) yang dapat membantu untuk memilih vendor. Karena kriteria bersifat kompleks, SPK akan menggunakan metode Analytical Hierarchy Process (AHP) untuk mendukung proses analisis menjadi lebih efektif. Dengan adanya SPK dapat meningkatkan efisiensi proses dari pengadaan kapal AHTS.

The government's efforts to increase the production of one million barrels of oil target by 2030 must be supported by various facilities that support improvements in the oil and gas industry. The program can have an impact on increasing offshore structures. In supporting oil and gas exploration and production operations, facilities in the form of ships are needed. One type of ship that is widely used in offshore activities in the upstream oil and gas sector is the Anchor Handling Tug and Supply (AHTS) type ship. AHTS vessels account for a valuation of approximately 25% of the overall global offshore vessel market value, making them the second largest type of offshore vessel in terms of market share. The total market value of vessels supporting offshore activities is projected to reach $28.20 billion by 2031. This growth can be attributed to the increasing demand for AHTS vessels to support operations in the upstream oil and gas sector. However, in the AHTS ship procurement process, many considerations are needed to choose the provider or vendor that best suits the needs. One of the efforts to solve this problem is to design a Decision Support System (DSS) that can help to select vendors. Because the criteria are complex, the DSS will use the Analytical Hierarchy Process (AHP) method to support the analysis process to be more effective. With the DSS, it can improve the efficiency of the AHTS ship procurement process."
