"Penelitian ini membahas pengaturan countervailing measures dalam sistem penyelesaian sengketa WTO, khususnya pada kasus DS630 antara Uni Eropa dan China mengenai pengenaan bea masuk imbalan definitif atas impor kendaraan listrik berbaterai baru asal China. Dengan meningkatnya globalisasi ekonomi, penerapan subsidi dan countervailing duty berpotensi menyebabkan maraknya sengketa perdagangan internasional. Penelitian ini mengkaji ketentuan countervailing measures menurut Agreement on Subsidies and Countervailing Measures (SCM Agreement) dan GATT 1994, serta potensi permasalahan dalam penerapan bea imbalan oleh Uni Eropa pada kasus DS630, yang mencakup aspek inisiasi penyelidikan, metode perhitungan subsidi, penetapan kerugian, dan transparansi prosedural. Penelitian ini menggunakan metode doktrinal dengan metode pengumpulan data studi kepustakaan dan metode analisis kualitatif atas bahan hukum primer, sekunder, dan tersier. Hasil analisis menunjukkan bahwa meskipun Uni Eropa telah memenuhi ketentuan prosedural SCM Agreement, secara substansial tindakan Uni Eropa berpotensi dipersoalkan oleh Panel Dispute Settlement Body (DSB) WTO.

This thesis discusses the regulation of countervailing measures within the WTO dispute settlement system, particularly in the DS630 case between the European Union and China regarding the imposition of definitive countervailing duties on imports of new battery electric vehicles from China. With the rise of economic globalization, the implementation of subsidies and countervailing duties has the potential to trigger an increase in international trade disputes. This research examines the provisions of countervailing measures under the Agreement on Subsidies and Countervailing Measures (SCM Agreement) and GATT 1994, as well as potential issues in the application of countervailing duties by the European Union in the DS630 case, which include aspects such as the initiation of investigations, methods of calculating subsidies, determination of injury, and procedural transparency. This study uses a doctrinal method with a literature study for data collection and qualitative analysis method of primary, secondary, and tertiary legal materials. The results of the analysis indicate that although the European Union has fulfilled the procedural requirements of the SCM Agreement, substantively, the actions of the European Union may potentially be challenged before the WTO Dispute Settlement Body (DSB) Panel."
