Abstrak :
[Dalam menjalankan bisnis bank selaku kreditur atau pihak pemberi pinjaman dalam pemberian fasilitas kredit kepada debitur terdapat risiko yang melekat, dan bank harus dapat memperhitungkan risiko yang dapat timbul terkait dengan aktivitas pemberian kredit tersebut, sehingga dapat meminimalkan potensi risiko yang dapat terjadi. Namun persetujuan bank atas pemberian fasilitas kredit ternyata dikemudian hari terjadi pelanggaran dan/atau pelampauan Batas Maksimum Pemberian Kredit (BMPK) sedangkan Perjanjian Kredit telah ditandatangani dan sah menurut hukum kemudian bank menghentikan pencairan fasilitas kredit maka menimbulkan hak bagi debitur untuk mengajukan gugatan wanprestasi. Penelitian hukum ini bertujuan untuk mengetahui dan memahami mengenai akibat hukum bagi bank apabila telah melakukan pelanggaran dan/atau pelampauan Batas Maksimum Pemberian Kredit (BMPK) serta Untuk mengetahui dasar gugatan wanprestasi oleh debitur terhadap bank serta perlindungan hukum bagi bank atas adanya gugatan wanprestasi oleh debitur atas perjanjian kredit yang telah ditanda tangani antara bank dengan debitur atas pelanggaran dan/atau pelampauan batas maksimum pemberian kredit. Penulisan tesis ini dikaji dengan menggunakan metode penelitian hukum normatif atau yuridis normatif yaitu menggunakan teknik pengumpulan data berupa penelitian kepustakaan dengan cara mempelajari berbagai literatur yang berhubungan dengan objek penelitian atas bahan-bahan hukum baik bahan menggunakan bahan hukum primer, bahan hukum sekunder, maupun bahan hukum tersier. Hasil yang diperoleh dari penelitian yang telah dilakukan, bahwa Terhadap pelanggaran dan/atau pelampauan atas ketentuan BMPK dapat dikenakan sanksi mulai dari sanksi administrasi dan tidak menutup kemungkinan dapat dikenakan sanksi pidana kepada Dewan Komisaris, Direksi, pegawai Bank, pemegang saham maupun pihak terafiliasi lainnya, mencerminkan adanya permasalahan tata kelola bank (GCG), hingga menyebabkan terjadinya penurunan tingkat kesehatan serta secara hukum bank dapat dilindungi dari gugatan wanprestasi debitur akibat terjadinya pelanggaran dan/atau pelampauan batas maksimum pemberian kredit demi kepentingan bank.;In running a business bank as creditor or lender in the provision of credit facilities to borrowers there are inherent risks, and the bank must be able to take into account the risks that may arise relating to the credit granting activities, so as to minimize the potential risks that can occur. Penelitian tesis ini berdasarkan kasus wanprestasi, dimana penjual wanprestasi dalam pelaksanaan perjanjian sewa beli Rumah, dalam hal ini Tergugat tidak segera membangun rumah yang diperjanjikan dalam perjanjian. Permasalahan yang menjadi bahasan adalah pertimbangan hakim terkait pembuktian unsur-unsur wanprestasi dan akibat hukum bagi para pihak dalam hal tidak dilaksanakannya perjanjian sewa beli rumah. Metode penelitian yaitu berupa yuridis normatif dimana pengumpulan data menggunakan studi dokumen. Hasil dari penelitian studi Putusan Nomor 575/Pdt.G/2018/PN Smg adalah dalam pembuktian unsur- unsur wanprestasi, hakim melakukan penilaian yang berbeda terkait somasi, walaupun tidak terdapat somasi namun hakim tetap menyatakan Tergugat telah melakukan wanprestasi. Dalam putusan yang dianalisis akibat hukum yang dijatuhkan hakim kepada para pihak adalah Tergugat dalam hal ini harus menangung akibat hukum atas perbuatan wanprestasi tersebut dengan membayar biaya, rugi, dan bunga, serta tergugat harus melakukan kewajibannya untuk melaksanakan pembangunan rumah sesuai dengan isi dan kesepakatan para pihak yang telah tertuang dalam perjanjian. ......This thesis research is based on the case of default, where the seller defaults in the implementation of the residential rent-to-own agreement, in which the Defendant, does not immediately build the house as promised in the agreement. The problem centers on the consideration of the judge related to the evidentiary elements of default and legal consequences for the parties regarding to the non-implementation of the residential rent-to-own agreement. The research method is in the form of normative juridical , meanwhile data collection applies document studies. The result of the study of the decision No. 575/Pdt.G/2018/PN Smg shows that in proving the elements of default, the judge conducted a different assessment related to the call. Although there is no call, the judge still states the Defendant as committing a default. In the observed decision referring to the law, in this case is the Defendant, they must overcome the legal consequences of the default by paying costs, losses, and interest. In addition, the defendant must perform his/her obligation to build the house in accordance with the content and agreement of the parties that have been contained in the agreement.

Skripsi ini membahas mengenai sebuah lembaga keuangan desa adat yang bernama Lembaga Perkreditan Desa yang didirikan dengan syarat harus memiliki awig-awig desa adat terlebih dahulu. Lembaga Perkreditan Desa yang diteliti dalam skripsi ini adalah Lembaga Perkreditan Desa milik Desa Adat Kedonganan. Penelitian ini menggunakan metode analisis data kualitatif dan metode penelitian normatif. Bentuk perjanjian kredit di Lembaga Perkreditan Desa adat Kedonganan tidak bertentangan dengan aturan hukum perjanjian yang berlaku. Walaupun merupakan lembaga keuangan desa adat namun beberapa ketentuan hukum perdata digunakan dalam perjanjiannya. Ini dikarenakan Lembaga Perkreditan Desa mencoba mengakomodir perkembangan zaman yang terjadi dengan mengharmonisasikan nilai-nilai adat dengan unsur-unsur hukum perdata yang berlaku di Indonesia. ......This thesis discusses about a traditional village financial institution in Bali, name of this institution is "Lembaga Perkreditan Desa". Traditional Community in Bali should have Awig-Awig first before establish "Lembaga Perkreditan Desa". "Lembaga Perkreditan Desa" that are examined in this thesis is "Lembaga Perkreditan Desa Adat Kedonganan". This study uses qualitative data analysis methods and normative research methods. The Model of Loan Agreement in "Lembaga Perkreditan Desa Adat Kedonganan" is not contradict with the general rule of an agreement law in Indonesia. Although it is a traditional village financial institutions in Bali, but some rules of private law is used in the loan agreement. Lembaga Perkreditan Desa Adat Kedonganan is trying to accommodate the on-going global development by harmonizing traditional values with the applicable private law in Indonesia.
