"Skripsi ini membahas dua hal utama menggunakan konsep dasar hukum perdata dan hukum ketenagakerjaan. Isu yang akan ditinjau adalah kontrak antara klub sepakbola dengan pemain sepakbola di Indonesia dan klausula peminjaman yang terdapat di dalam kontrak tersebut. Penelitian ini merupakan penelitian yuridis-normatif dengan menggunakan analisis kualitatif atas data sekunder. Hasil penelitian ini adalah: (1) Kontrak antara klub sepakbola dengan pemain sepakbola di Indonesia didasarkan pada pasal 1320 dan pasal 1338 KUH Perdata. Untuk konteks pinjam meminjam pemain sepakbola, tidak dapat digunakan konsep sewa menyewa yang ada di dalam KUH Perdata, karena manusia bukan objek sewa menyewa di dalam KUH Perdata. (2) Dalam konteks hukum ketenagakerjaan, hubungan hukum antara pihak klub dengan pemain sepakbola merupakan hubungan perjanjian/pekerjaan jasa tertentu, yang unsur utamanya adalah unsur koordinatif dan unsur keahlian. Untuk konteks pinjam meminjam pemain sepakbola, terdapat konsep yang mirip dengan konteks tersebut dalam hukum ketenagakerjaan, yaitu konsep alih daya.

The thesis reviews two main things using basic concepts of civil law and employment law. Issues that will be reviewed are a contract between a football club and football players in Indonesia together with the loan clause mentioned in the contract. This research is a normative legal research with qualitative analysis on secondary data. The results of this research are: (1) The contract between the football club and the players is based on Article 1320 and Article 1338 Indonesian Civil Code. For the loan agreement, the application couldn't based on the Indonesian Civil Code because human can't be categorized as an object of loan. (2) In the context of employment law, the legal relationship between football club and the players is merely providing professional services towards both parties in which the main elements are coordinative and skills. In the context of football player loan agreement, there is a similar concept in the employment law that is known as the concept of outsourcing.

"Tulisan ini menganalisis bagaimana hubungan antara kebijakan dan pengaturan penciptaan lapangan kerja, dengan adanya transisi energi ke arah energi baru dan terbarukan di Indonesia. Tulisan ini disusun dengan menggunakan metode penelitian doktrinal. Transisi energi di Indonesia membawa dampak yang signifikan terhadap berbagai sektor. Termasuk perubahan bagi kebijakan ekonomi serta kebijakan energi di Indonesia. Ketenagakerjaan sebagai salah satu bagian dari ekonomi makro sudah pasti mengalami dampaknya. Namun, saat ini di Indonesia, dengan berbagai kebijakan dan pengaturan yang ada selama masa transisi energi, ternyata belum dapat mengakomodir jumlah angkatan kerja yang sudah memasuki usia kerja untuk mendapatkan kesempatan kerja. Pemerintah memandang transisi energi sebagai ancaman, bahwa akan terjadi Pengakhiran Hubungan Kerja (PHK) di sektor energi fosil, tanpa melakukan persiapan untuk melindungi para pekerja yang mengalami PHK dan di sisi lain tidak mengambil peluang transisi energi untuk menciptakan lapangan kerja baru. Padahal, proyeksi lapangan kerja yang tercipta dengan adanya transisi energi ini sangat menjanjikan, terlebih melihat beberapa contoh negara yang sudah berhasil, yaitu Denmark, Amerika Serikat, dan Jepang. Kebijakan dan pengaturan di sektor energi baru terbarukan pada negara-negara tersebut memperhatikan aspek ketenagakerjaan untuk mendorong penciptaan lapangan kerja serta mendukung percepatan transisi ke arah energi baru dan terbarukan, tanpa mengurangi perhatian kepada tenaga kerja yang kehilangan pekerjaannya terutama di sektor energi fosil akibat adanya transisi energi.

This paper analyzes the relationship between job creation policies and regulations and the energy transition toward new and renewable energy in Indonesia. This papers employs a doctrinal legal research. The energy transition in Indonesia significantly impacts various sectors, including the transformation of economic and energy policies. Employment, as a component of the macroeconomy, has undoubtedly been affected. However, currently in Indonesia, the existing policies and regulations during the energy transition are apparently inadequate to accommodate the number of individuals entering the workforce who seek employment opportunities. The government perceives the energy transition as a threat, fearing layoffs in the fossil energy sector, without making adequate preparations to protect workers facing unemployment. Simultaneously, there is a lack of effort to leverage the energy transition as an opportunity to create new jobs. In fact, projections regarding job creation from this energy transition are very promising, particularly when considering successful examples from countries such as Denmark, the United States, and Japan. Policies and regulations in the renewable energy sectors of these countries prioritize employment aspects to promote job creation while supporting the acceleration of the transition to new and renewable energy, without neglecting workers who lose their jobs in the fossil energy sector due to this transition."

"Michè€le Alexandre defines "sexploitation" as the perpetuation of myths and stereotypical notions regarding men and women in order to further an agenda of oppression and subordination in certain spheres of society. The most popular means through which this sexploitation is achieved is through a method Alexandre coins as "sexual profiling." Alexandre argues that sexual profiling ultimately stifles the growth of our society by creating inefficient as well as oppressive systems, and that its eradication can help increase the productivity as well as the morale of society. "ABSTRAK
Tesis ini membahas tentang masalah pengaturan hak pekerja dalam sistem hukum ketenagakerjaan Indonesia pada tahun 2007-2013. Permasalahan yang menjadi topik tesis ini adalah mengenai; 1) pengaturan hak pekerja sesuai norma HAM dan perburuhan internasional dalam sistem hukum ketenagakerjaan Indonesia, 2) Permasalahan yang muncul diseputar upaya penegakan hak pekerja di era otonomi daerah, dan 3) kebijakan hukum yang diambil pemerintah pusat sebagai solusinya. Penelitan tesis ini menggunakan metode yuridis-normatif, dengan mengevaluasi peraturan perundang-undangan yang mengatur tentang hak pekerja serta melihat efektifitas struktur pemerintahan yang berwenang dalam menegakkan norma hak pekerja. Sehingga solusi yang dapat diterapkan dalam memperbaiki sistem hukum ketenagakerjaan agar meminimalisasi munculnya masalah pelanggaran hak pekerja melalui perbaikan sistem pengawasan ketenagakerjaan.

ABSTRACT
This thesis discusses the issue of workers rights arrangements in the Indonesian labor law system in the year 2007 to 2013. The issue of the topic in this thesis is about; 1) the arrangement of worker rights as human rights norm and international labor law at the indonesia employment law system, 2) the issue around the enforcement of the worker rights in the local aotonomy era, and 3) the legal policy from central government as the solution. This thesis research was conducted by normative-juridical methode and by evaluating legislation governing the rights of workers and see the effectiveness of the structure of government authorities in the enforcement of labor rights norms. So the solution can be applied to improve the legal system in order to minimize the emergence of labor rights violations of workers through improved labor inspection systems."
