"Manusia yang sebelumnya merupakan satu-satunya makhluk hidup yang diberikan kecerdasan akal dan fikiran untuk terus berkembang dan menjadi inventor akan teknologi baru, kini dapat mendelegasikan kemampuan tersebut kepada mesin kecerdasan buatan atau AI. Meskipun AI sendiri merupakan sistem ciptaan manusia dan masih sebatas sistem yang terintergrasi dengan manusia atau operatornya, namun saat ini sistem tersebut dapat secara otonom menciptakan invensi, atau yang disebut dengan AI-generated inventions. Namun, apakah invensi dari AI tersebut dapat dimohonkan paten? Hal tersebut menjadi pertanyaan besar dikarenakan sesuai dengan peraturan-peraturan yang ada, subjek yang dapat menjadi inventor adalah natural person, sedangkan dalam hal ini AI bukanlah termasuk dalam klasifikasi natural person. Oleh karena itu, Penulis akan menganalisis bagaimana peran AI sebagai inventor, dilihat dari perspektif hukum Indonesia dan Amerika Serikat, serta dengan kasus actual mengenai permohonan paten atas AI-generated inventions. Penelitian ini dilakukan dengan metode penelitian yuridis-normatif dengan data yang diperoleh dari studi kepustakaan dan wawancara. Hasil penelitian menunjukan bahwa sebenarnya dengan perkembangan zaman, maka akan banyak munculnya AI-generated inventions, sehingga salah satu jalan keluar yang dapat ditempuh adalah dengan membentuk pengaturan mengenai AI-generated inventions tersebut maupun perubahan atau penambahan aturan mengenai klasifikasi inventor dalam undang-undang.
......Humans who were previously the only living beings given the intelligence of mind and mind to continue to evolve and become inventors of new technologies, can now delegate those abilities to artificial intelligence machines or AI. Although AI itself is a human creation system and is still limited to systems that are integrated with humans or their operators, today the system can autonomously create inventions, or so-called AI-generated inventions. However, can the invention of the AI be requested for a patent? This is a big question because in accordance with existing regulations, the subject that can be an inventor is a natural person, while in this case AI is not included in the classification of natural persons. Therefore, the author will analyze how AI's role as an inventor, viewed from the legal perspective of Indonesia and the United States, as well as with actual cases regarding patent applications for AI-generated inventions. This research was conducted with juridical-normative research methods with data obtained from literature studies and interviews. The results show that actually with the times, there will be many applications of AI-generated inventions, so one way out that can be taken is to form arrangements regarding AI-generated inventions as well as changes or additions to rules regarding the classification of inventors in the law."
