"Tesis ini membahas mengenai kerjasama pengoperasian sistem peluncuran udara, disebut juga Air Launch System, yang telah menjadi suatu aktivitas yang signifikan dalam era komersialisasi ruang angkasa saat ini. Air Launch System adalah system peluncuran bergerak dari udara atau pesawat udara. Adanya keinginan pihak Rusia dan Indonesia untuk melakukan kerjasama dalam pemanfaatan Biak sebagai Intermediate Based pengoperasian Air Launch System yang memerlukan persiapan dan antisipasi dari aspek hukum. Pengoperasian sistem peluncuran udara (Air Launch System) dalam Hukum Internasional masih membutuhkan prosedur dan undang-undang tambahan yang pasti. Selain itu, adanya tanggung jawab negara yang akan terus melekat terhadap Launching State dan Registry State apabila peluncuran tersebut menimbulkan kerugian terhadap negara lain.

Air launch system operation becomes a significant activity in the era of outer space commercialization nowadays. Air launch system is a mobile launch system from the air or from the aircraft. Initially, this system was developed from an armed aircraft system. The willingness of Russia to cooperate with The Republic of Indonesia by using Biak as an intermediate based on Air Launch System operation that will require preparation and anticipation of the legal aspects has not been regulated in the International Law. The Air Launch System operation in the International Law requires a certain procedure and additional law concerning the Air Launch System operation. Moreover, the state responsibility will always be borne by the launching state and state of registry in the event of damage towards another state due to such operation."

ADACELLWORKS INDONESIA sebagai perusahaan yang bergerak dalarn bidang telekomunikasi saat ini tengah menangani pencapaian Site Quality Acceptance pada proyek Pre Launch Optimization di salah sate operator lokal di Indonesia. Untuk itu diperlukan suatu analisa dan kajian mengenai tingkat pencapaian pada proyek tersebut.Pada tesis ini, pengukuran dan evaluasi strategi peningkatan kinerja proses tersebut dilakukan berbasis pada kerangka kerja six sigma, dimana berdasarkan pengukuran, kondisi baseline performance proses tersebut belurn mencapai target sesuai yang diharapkan. Serkenaan dengan hat tersebut maka dilakukan analisa dan kajian strategi untuk meningkatkan kinerja proses Pre Launch Optimization.Pada tesis ini evaluasi strategi dilakukan dalam dua opsi, yang pertama adalah strategi dengan durasi satu semester dan yang kedua adalah strategi dengan durasi dua semester. Untuk mengimplementasikan strategi yang pertama dibutuhkan alokasi biaya 147.85% dari budget (dibutuhkan tambahan alokasi biaya sebesar 47.85% dari budget), sedangkan strategi yang kedua alokasi biaya yang dibutuhkan 86,96% dari budget (tidak melebihi budget proyek). Selanjutnya, untuk mempertahankan pencapaian target proyek yang telah dicapai melalui strategi peningkatan kinerja tersebut, maka dibuat pula sustaining program, untuk mengimplementasikan program ini dibutuhkan alokasi biaya 71.85% dari budget.

PT. ADACELLWORKS INDONESIA as a company that focuses their business on telecommunication at nowdays are being involved in achievement of Site Quality Acceptance in Pre Launch Optimization project at one of local operator in Indonesia. According to that issue there is necessary to have an analysis and research which concern in the achievement rate for that project.In thesis, measurement and improvement strategy evaluation of that proses was performed in six sigma frame work, and based on the measurement result, the baseline performance of process does not meet the target yet. Regarding to that issue, an analysis and research of strategy to improve the achievement rate of Pre Launch Optimization process was performed.In thesis the strategy was evaluated in two option, first is the strategy in one semester periode and the second one is the strategy in two semester periode. The first strategy needs project cost 147.85% of budget (to implement the first startegy needs additional cost 47.85% of budget). The second strategy needs project cost 86,96% of budget (without over budget). Further to maintain the project achievement, it is necessary to perform the sustaining program, this program needs project cost 71.85% of budget."

"ABSTRAKRisiko dan nilai pertanggungan dalam asuransi peluncuran satelit sangatbesar sehingga membutuhkan kapasitas asuransi yang besar pula untuk menutupirisiko tersebut. Salah satu cara untuk meningkatkan kapasitas asuransi adalahdengan mengatur retensi sendiri yang memadai dan meningkatkan dukunganreasuransi. Otoritas Jasa Keuangan pada tahun 2015 telah mengeluarkanketentuan terkait hal tersebut yaitu Peraturan Otoritas Jasa Keuangan (POJK) No.14/POJK.05/2015 tentang Retensi Sendiri dan Dukungan Reasuransi DalamNegeri. Oleh karenanya, permasalahan yang akan diteliti dalam skripsi ini adalahbagaimana pengaturan retensi sendiri dan dukungan reasuransi untuk asuransipeluncuran satelit dalam POJK tersebut. Metode penelitian yang akan digunakandalam penelitian ini adalah metode yuridis normatif yaitu penelitian yangdilakukan terhadap hukum positif tertulis maupun tidak tertulis. Dalam POJKtersebut diatur bahwa dalam perusahaan asuransi wajib menerapkan batas retensisendiri dengan berdasarkan pada profil risiko dan kerugian (risk and loss profile)untuk setiap risiko dengan memperhatikan batas minimum dan maksimum retensiyang diatur dalam SEOJK. Sedangkan untuk dukungan reasuransi diatur bahwauntuk asuransi peluncuran satelit diwajibkan perusahaan asuransi mereasuransikansetiap risikonya kepada perusahaan reasuransi dalam negeri minimal Rp. 40 M.Dari penelitian yang dilakukan saran yang dapat diberikan adalah dalammenetapkan retensi sendiri perusahaan asuransi harus benar-benar memperhatikankemampuan sendiri karena apabila ditentukan terlalu besar dapat menyebabkankegoncangan, namun apabila ditetapkan terlalu kecil dapat menyebabkan tingkatsolvabilitas perusahaan asuransi tersebut menurun.

ABSTRACTThe risk and value of insurance for the launch satellite insurance isintensively high, so it also needs big capacity to insure the risk. One of the waysto increase the insurance capacity is to maintain the own (sufficient) retention andto increase reinsurance. Otoritas Jasa Keuangan (Financial Services Authority ofIndonesia) in 2015 made a regulation for that, called Otoritas Jasa KeuanganRegulation (Regulation of The Financial Services Authority) Number14/POJK.05/2015 concerning Own Retention and Reinsurance from LocalCompany. The issue to be studied in this thesis is how POJK regulates the ownretention and reinsurance for launch satellite insurance. The method used in thisresearch is normative juridical method which conducted on the written andunwritten positive law. That OJK Regulation regulates that insurance companyhas to apply the own retention based on the risk and loss profile for every risk byobserving the maximum and minimum own retention limit regulated by OJK.Meanwhile for the reinsurance, regulated that for launch satellite insurance,insurance company has to reinsure its risk to the local company for minimum 40billion rupiah. The suggestion from this research is that insurance company has todecide the own retention carefully. However, if the retention is too high, it canmake the company's finance shaking, but when the own retention is too low, it canmake the company solvencies descend."
