"Tulisan ini menganalisis konsep pemekaran daerah otonomi baru berdasarkan peraturan perundang-undangan yang berlaku dan selanjutnya melakukan tinjauan terhadap keberlanjutan pembentukan daerah otonomi baru provinsi kepulauan nias. Penulisan tesis ini menggunakan metode penelitian doktrinal. Daerah otonomi baru dapat lahir sebagai perwujudan terjadinya penggabungan hingga pemekaran suatu daerah. Esensi dilakukannya pemekaran daerah ialah untuk mencapai efektivitas dan efisiensi pelayanan publik berdasarkan asas desentralisasi. UU No. 23 Tahun 2014 menjadi landasan yuridis pembentukan daerah otonomi baru dan selanjutnya diatur dalam PP No. 78 Tahun 2007. Persyaratan dalam pemekaran daerah diantaranya: 1) persyaratan dasar kewilayahan; 2) persyaratan dasar kapasitas daerah; dan 3) persyaratan administratif. Masyarakat Kepulauan Nias dan pemerintah Kepulauan Nias menyetujui pemekaran daerah mendorong BPP-PKN untuk mengupayakan terealisasinya pembentukan daerah otonomi baru Provinsi Kepulauan Nias. Kepulauan Nias telah memenuhi seluruh persyaratan untuk melakukan pemekaran. Proses rancangan pembentukan daerah otonomi baru Provinsi Kepulauan Nias telah sampai pada pembahasan di tingkat pusat antara pemerintah dan DPR. Adapun yang menjadi kendala terhambatnya pemekaran wilayah disebabkan oleh landasan teknis terkait pemekaran yang masih diuji relevansinya dengan UU No. 23 Tahun 2014 serta penundaan pemekaran wilayah yang dilakukan pemerintah saat ini dikarenakan bukanlah menjadi program kerja prioritas.

This paper analyzes the concept of the expansion of a new autonomous region based on applicable laws and regulations and then reviews the sustainability of the formation of a new autonomous region in the Nias Islands province. This thesis uses doctrinal research methods. New autonomous regions could be born as a manifestation of the merger or expansion of a region. The essence of regional expansion is to achieve effectiveness and efficiency of public services based on the principle of decentralization. Law No. 23 of 2014 became the juridical basis for the formation of new autonomous regions and was further regulated in the Government Regulation No. 78 of 2007. Requirements for regional expansion include: 1) basic regional requirements; 2) basic regional capacity requirements; and 3) administrative requirements. The people of the Nias Islands and the government of the Nias Islands agreed to regional expansion, encouraging BPP-PKN to strive for the realization of the creation of a new autonomous region for the Nias Islands Province. The Nias Islands have fulfilled all the requirements for expansion. The design process for the formation of a new autonomous region for the Nias Islands Province has reached discussions at the central level between the government and the House of Representatives. The obstacles to regional expansion are caused by the technical basis related to expansion which is still being tested for its relevance to Law No. 23 of 2014 and the current government's postponement of regional expansion because it is not a priority work program."
