"Perkembangan teknologi yang begitu pesat membuat terjadi suatu pola perubahan gaya hidup masyarakat saat ini, khususnya dalam kegiatan transaksi pada suatu transaksi barang dan/atau jasa dari metode transaksi secara konvensional menjadi transaksi secara elektronik, atas dasar tersebut muncullah Penyelenggara Sistem Elektronik (PSE) selaku platform digital yang memfasilitasi kegiatan pertukaran barang dan/atau jasa. Transaksi yang dilakukan pada PSE tentunya tidak terlepas dari adanya potensi kebocoran data dan informasi atas setiap transaksi yang dilakukan oleh konsumen pada PSE, sehingga PSE selaku pelaku usaha berkewajiban untuk melakukan upaya dalam hal mencegah hal-hal tersebut terjadi yang salah satunya dengan menerapkan standar ISO 27001 tentang Sistem Manajemen Pengamanan Informasi (SMPI) selaku standar internasional dalam upaya mencegah risiko-risiko yang terjadi pada transaksi elektronik yang salah satunya memenuhi hak konsumen dan kewajiban PSE selaku pelaku usaha. Pokok permasalahan pada penelitian ini adalah terkait bagaimana mekanisme penerapan ISO 27001 selaku SMPI serta apakah ISO 27001 selaku SMPI dapat menjamin PSE dari kebocoran data konsumen. Penelitian ini akan dilakukan secara kualitatif, hasil dari penelitian bahwa ISO 27001 selaku SMPI membantu PSE dalam mencegah kebocoran data dan informasi konsumen, serta saran yang dapat diberikan dari penelitian ini adalah regulator mengevaluasi dan membuat satu aturan rigit mengenai penerapan SMPI sejak terdapat adanya dualisme pengaturan terhadap penerapan SMPI.

The rapid development of technology has made a pattern of changing the lifestyle of today's society, especially in transaction activities in a transaction of goods and/or services from conventional transaction methods to electronic transactions, on this basis an Electronic System Operator (ESO) has emerged as a platform. digital services that facilitate the exchange of goods and/or services. Transactions carried out at ESO are certainly inseparable from the potential for data and information leakage for every transaction made by consumers at ESO. Therefore, ESO as a business actor is obliged to make efforts to prevent these things from happening, one of which is by implementing the ISO 27001 standard. regarding the Information Security Management System (SMPI) as an international standard to prevent risks that occur in electronic transactions, one of which fulfills consumer rights and PSE obligations as business actors. The main problem in this research is related to the mechanism for implementing ISO 27001 as SMPI and whether ISO 27001 as SMPI can guarantee ESO from consumer data leaks. This research will be carried out qualitatively and the results of the research show that ISO 27001 as SMPI can assist ESO in preventing consumer data and information leaks, as well as advice that can be given from this research is that the regulator evaluates and makes one strict rule regarding the implementation of SMPI since there is dual regulatory regulation on the implementation of SMPI. "Poverty is one of social topic which will be talked and disputed continously at national and international forum. The fact shows that development which has done can not reduce indigent population in the world. To reduce poverty, we have to know who ingoing in indigent category and where they stay behind. MARS is a classification method which are innovative and relative flexible to investigate relationship pattern among dependent and independent variables without any assumption to its functional form.This research investigates the model accuration of MARS for village or sub-district's status, indigent (code 1) or not indigent (code 0), obtained by PSE'05.There are 27 predictor variables obtained by PODES SE'06. This research shows that the accuration of classification in indigent sub-district for urban region is 100 percents, affected by 17 community factors, i.e., distance to nearby post office, ratio of families live in flood gristle, healthy card receiver family percentage, ratio of health facility per 1000 citizen, total industrial enterprise, distance to nearby market, distance of village to the capital regency, agricultural family percentage, pra-KS and sejahtera 1 family percentage, distance of village to other capital regency, ratio of non PLN electricity user, total market, ratio of families, live in dirty residence, family having indigent card percentage, unskilled laborer in agriculture percentage, total telephone-shop, and distance of village to the capital district."

"Skripsi ini membahas hak kebebasan berekspresi pengguna sistem elektronik di internet setelah berlakunya PM Kominfo 5/2020. Landasan penelitian ini ialah pemutusan akses terhadap beberapa situs dan aplikasi PSE Lingkup Privat oleh Kemenkominfo, kondisi kebebasan menggunakan internet di Indonesia yang bebas setengah, dan pembatasan hak kebebasan berekspresi di internet yang marak dilakukan, baik oleh pemerintah ataupun individu. Perlindungan atas hak kebebasan berekspresi pengguna sistem elektronik di internet merupakan amanat UUD NRI 1945, kemudian dijelaskan lebih lanjut di dalam UU HAM dan UU Kemerdekaan Berpendapat. Tidak hanya di skala nasional, hak kebebasan berekspresi pengguna sistem elektronik di internet juga dilindungi oleh instrumen HAM internasional, baik yang sudah diratifikasi oleh Indonesia seperti ICCPR maupun yang berbentuk rekomendasi dari para pakar hukum. Meski hak ini sudah diatur secara tegas, pasal – pasal di PM Kominfo 5/2020 terkait moderasi dan pemutusan akses terhadap informasi dan dokumen elektronik yang tidak memiliki standar jelas dan subjektif berpotensi melanggar hak kebebasan berekspesi pengguna sistem elektronik di internet. Dengan demikian, rumusan masalah yang diangkat di dalam penelitian ini ialah lingkup pengaturan dan konsep hak kebebasan berekspresi pengguna sistem elektronik di internet menurut instrumen hukum secara internasional serta nasional, dan implikasi hak kebebasan berekspresi pengguna sistem elektronik di internet setelah berlakunya PM Kominfo 5/2020. Penelitian ini merupakan penelitian kualitatif dengan desain deskriptif. Penelitian ini menemukan bahwa PM Kominfo 5/2020 melanggar hak kebebasan berekspresi pengguna sistem elektronik di internet.

This thesis discusses the right to freedom of expression of electronic system users on the internet after the enactment of PM Kominfo 5/2020. The research's basis is access termination to several Electronic System Providers in the Private Sector by the Ministry of Communication and Informatics, freedom to use the internet in Indonesia, and restrictions on the right to freedom of expression on the internet which are widely practiced, both by the government and individuals. Protection of the right to freedom of expression for users of electronic systems on the internet is a mandate of the 1945 Constitution, which is further explained in the Human Rights and the Freedom of Opinion Law. Not only on a national scale, the rights to freedom of expression of electronic systems users on the internet are also protected by international human rights instruments that Indonesia has ratified, such as the ICCPR and recommendations from legal experts. Albeit this right has been strictly regulated, articles in PM Kominfo 5/2020 regarding moderation and terminating access to electronic information and/or documents that do not have clear and subjective standards potentially violate the right to freedom of expression of electronic systems users on the internet. Thus, the problem raised in this study is the regulation and the concept of the right to freedom of expression of electronic systems users on the internet according to international as well as national legal instruments and the implications of it after the enactment of PM Kominfo 5/2020. This research is qualitative, using a descriptive method. This research found that PM Kominfo 5/2020 violated the right to freedom of expression of electronic system users on the internet."
