"ABSTRAKSalah satu notaris yang melakukan pelanggaran jabatannya adalah Lany Sofyan,yang mendapatkan sanksi pemberhentian secara tidak hormat dari MajelisPengawas Pusat (MPP). Upaya hukum MPP terhadap putusan menteri adalahdengan mengirimkan surat kepada menteri untuk menindaklanjuti putusan MPPtersebut. Karena belum dikeluarkannya putusan menteri maka status hukumnotaris tersebut tetap menjadi notaris. Penulisan tesis ini memakai metodepenelitian yuridis normatif yaitu metode penelitian yang mengacu kepadaperaturan perundang-undangan dan sumber data lainnya yang berkaitan,sedangkan kesimpulan ditarik secara preskriptif analitis dimana penelitianbertujuan untuk memberikan saran untuk mengatasi permasalahan.

ABSTRACTOne of the Notary that breach its position is Lany Sofyan, who get sanction ofdishonorable termination from the Notary Central Supervisory Council (MPP).MPP’s legal remedy against the minister decree is to send a letter to the ministerto follow up the MPP’s decree. Since the minister has not issued the decision sothat the legal status of the notary still remains a notary public. This thesis use anormative research method namely a method of research that refers to legislationregulation and other relevant data sources, while the conclusions drawn inprescriptive analytics where the thesis purpose is to provide suggestions toovercome the problems."

"Menteri Negara Badan Usaha Milik Negara (BUMN) membuat suatu surat keputusan mengenai pemberhentian dan pengangkatan Ketua Dewan Pengawas di Perusahaan Umum (Perum) XXX, dimana dalam Diktum Keempat dinyatakan memberikan kuasa kepada Direksi Perum XXX untuk membuatkan surat keputusan tersebut kedalam bentuk akta otentik dihadapan Notaris. Akta otentik yang dibuat oleh Notaris X atas surat keputusan Menteri BUMN tersebut adalah akta pernyataan. Kesimpulan tersebut diperoleh dengan memakai metode penelitian yuridis normatif yaitu metode penelitian yang mengacu kepada peraturan perundang-undangan Indonesia dan sumber data lainnya yang berkaitan. Sumber perolehan data yang digunakan adalah sumber data sekunder dengan bahan hukum primer dan sekunder yang terdiri dari akta pernyataan yang dibuat Notaris X, peraturan perundang-undangan yang berlaku dan referensi lainnya. Kesimpulan dalam tesis ini adalah akta pernyataan yang dibuat oleh Notaris X memberikan kekuatan pembuktian yang lebih kuat meskipun berlebihan karena Menteri BUMN adalah pejabat Negara yang surat keputusannya mempunyai kekuatan sebagai akta otentik dan seharusnya Notaris X memberikan penyuluhan mengenai hal tersebut kepada penghadap mengenai hal tersebut.

The Minister of State Owned Enterprise are making a Decree on retirement and appointment of The Head of Overseeing Board in Public Company (Perum) XXX, which in the fourth of his decision were stated that it also gives to the Board of Director Perum XXX a power of authority to concluded the Decree in a form of authentic deed in the presence of Public Notary. Authentic deed were made by Public Notary X to the Minister of State Owned Enterprise Decree is statement deed. Those conclusion were made by making a normative legal type of research method which that kind of method refers to the Indonesia law and regulation and with other source of data. The source of data were used is secondary data source with primary and secondary legal resources which conclude public notary statement deed, Indonesia law and other reference included. The conclusion of this thesis is statement deed were made by Notary X gives a stronger evidentiary power although it`s excessive because the Minister of State Owned Enterprises is a state officials which all its decree prevail as an authentic deed and it`s supposed to be that Notary X gives counseling about it to the authorized about it."
