"Penelitian ini membahas peran Notaris dalam pembuatan akta perjanjian pemberesan warisan, dimana budel pewaris telah habis dibagikan semasa hidupnya berdasarkan adat Tionghoa. Permasalahan dalam penelitian ini adalah bagaimana keabsahan akta perjanjian pemberesan warisan yang dibuat Notaris tanpa adanya harta warisan; bagaimana akibat hukum bagi para pihak yang mengikatkan diri dalam perjanjian dan Notaris yang membuat akta perjanjian pemberesan warisan tanpa adanya harta warisan jika terjadi sengketa; dan bagaimanakah hakim menjatuhkan putusan dalam perkara Putusan Mahkamah Agung Nomor 1626 K/Pdt/2018. Metode penelitian yang digunakan adalah yuridis normatif, dengan tipe penelitian eksplanatoris. Hasil penelitian adalah judul akta perjanjian pemberesan warisan tidak mencerminkan isi akta dimana tidak ada prestasi sebagaimana dimaksud Pasal 1234 KUHPerdata, yaitu dalam hal ini untuk melakukan pemberesan warisan, karena pewaris tidak lagi memiliki budel yang telah dibagikan kepada anak-anaknya semasa hidup. Namun akta Notaris tersebut tetap berlaku sah dan mengikat para pihak yang membuatnya selama tidak ada tuntutan dari pihak yang merasa dirugikan. Pihak yang melanggar kesepakatan dalam perjanjian dapat dituntut melakukan perbuatan melawan hukum sebagaimana Pasal 1365 KUHPerdata, termasuk Notaris yang melakukan kesalahan dalam pembuatan akta dan mengakibatkan kerugian bagi pihak lain, namun tetap harus dibuktikan dengan putusan pengadilan. Walaupun hakim dalam gugatan konvensi untuk pembagian warisan menyatakan pembagian warisan yang dilakukan pewaris semasa hidupnya berdasarkan adat Tionghoa tidak bertentangan dengan ketentuan yang berlaku dan mengesampingkan hukum perdata yang berlaku nasional bagi masyarakat Tionghoa, namun hakim menerapkan hukum progresif untuk memenuhi rasa keadilan dengan menolak gugatan ganti kerugian yang diajukan dalam gugatan rekonvensi karena perbuatan melawan hukum.

This study discusses the role of the Notary in making the deed of inheritance settlement agreement, where the inheritance has been distributed by the heir during his lifetime based on Chinese Tradition. The problem in this study is how is the validity of the deed of inheritance agreement made by the notary without the inheritance; how the legal consequences for the parties who bound themselves in the agreement and the Notary who made the deed of inheritance agreement without the inheritance in the event of a dispute; and how the judge made the verdict in the case of the Supreme Court Decision Number 1626 K/Pdt/2018. The research method used is normative juridical research, with explanatory research type. The result of the research is that the title of the deed of inheritance settlement agreement does not reflect the content of the deed where there is no achievement as referred to Article 1234 of the Indonesian Civil Code, which in this agreement is to do the inheritance settlement, since the heir no longer has the inheritance that has been distributed to his children during the heir's life. However, the notary deed remains valid and binds the parties made it, as long as there is no claim from those who feel disadvantaged. Parties who violate the mutual agreement in the contract, could be prosecuted for committing unlawful act as Article 1365 of the Indonesian Civil Code, including Notary who make mistake in making the deed and causes losses to other parties, but still must be proven by a court decision. Although the judge in the convention lawsuit for inheritance distribution stated that the inheritance distribution done by the heir during his lifetime based on Chinese Tradition did not conflict with the applicable regulations and overrode the civil law applied nationally for Chinese community, the judge applied the progressive law to fulfill a sense of justice by rejecting the claim for compensation due to the unlawful acts submitted in the reconvention lawsuit."

"Skripsi ini membahas mengenai hukum perkawinan adat masyarakat etnis Tionghoa di Indonesia khususnya pada masyarakat etnis Tionghoa di Kota Medan. Hukum perkawinan adat masyarakat etnis Tionghoa di Kota Medan kemudian dianalisis keberlakuannya menurut undang-undang perkawinan nasional. Penelitian ini merupakan penelitian yuridis empiris yang dilakukan dengan studi kepustakaan data sekunder lalu diikuti dengan penyajian dengan data lapangan. Hasil penelitian ini menunjukkan hukum perkawinan adat masih dijalankan oleh masyarakat etnis Tionghoa di Kota Medan. Selain itu, hukum perkawinan adat masih memiliki beberapa peranan dalam undang-undang perkawinan nasional.

This thesis describes adat marriage law practiced by Chinese people in Indonesia, particulary Chinese people living in Medan. The enforcability of the aforementioned Chinese adat marriage law is then being analyzed using the national marriage law. This research uses empirical-juridical apporach, which is done through studying secondary data, then presenting and analyzing the field data. The results of the research shows that adat marriage law are still practiced by Chinese people living in Medan. However, the adat marriage law practiced by the Chinese people living in Medan isn?t legally recognized by national marriage law, although the national marriage law only acknowledge several parts of adat marriage law."

"[Pengangkatan anak (adopsi) di kalangan masyarakat adat Tionghoa merupakan suatu perbuatan yang lazim dilakukan bila tidak terdapat keturunan laki-laki dalam suatu perkawinan. Keberadaan keturunan laki-laki dalam masyarakat Tionghoa adalah sangat penting sebagai penerus marga (she) dan pemelihara abu leluhur. Dalam perkembangannya masyarakat adat Tionghoa mengalami perubahan sistem kekerabatan menjadi bercorak parental sehingga sekarang dikenal pula pengangkatan anak perempuan. Motif utama pengangkatan anak turut mengalami perubahan, tidak lagi demi melanjutkan keturunan semata tetapi demi kepentingan terbaik anak. Kedudukan anak angkat dalam keluarga angkat haruslah dalam posisi yang menjamin kesejahteraan anak tersebut, termasuk pula bila orang tua angkatnya meninggal kelak berkaitan dengan warisnya. Yang menjadi permasalahan dalam penelitian ini adalah bagaimana pelaksanaan pengangkatan anak pada masyarakat adat Tionghoa di Indonesia, bagaimana akibat hukum dari pengangkatan anak terhadap kedudukan anak angkat dalam hukum waris adat Tionghoa, bagaimanakah pelaksanaan pengangkatan anak (adopsi) yang dilakukan oleh masyarakat Tionghoa dalam penetapan Pengadilan
Negeri Jember Nomor 10/Pdt.P/2014/Pn.Jr. Metode penelitan yang digunakan adalah penelitian yuridis normatif dengan tipologi penelitian eksplanatoris. Data yang digunakan adalah data sekunder yang dikumpulkan dengan studi kepustakaan, selain itu dilakukan pula wawancara untuk mendukung fakta yang ditemukan dalam data sekunder. Dari penelitian diketahui bahwa masyarakat adat Tionghoa di Indonesia melakukan pengangkatan anak hanya secara adat karena pengangkatan anak melalui pengadilan dianggap rumit dan memakan banyak biaya. Akibat hukum dari pengangkatan anak terhadap kedudukan anak angkat dalam hukum waris adat Tionghoa adalah anak angkat menjadi ahli waris dari orang tua angkatnya. Pengangkatan anak yang dilakukan oleh masyarakat Tionghoa dalam penetapan Pengadilan Negeri Jember Nomor 10/Pdt.P/2014/Pn.Jr adalah pengangkatan seorang anak perempuan yang awalnya hanya dilakukan berdasarkan adat kebiasaan yang kemudian dapat disahkan oleh pengadilan negeri demi mendapat kepastian hukum dan mewujudkan kepentingan terbaik anak tersebut.

Over the time Chinese Indonesian's descent system transforming into bilateral kinship system so that girls adoption are also recognized now. Adoption's main motives also started shifting, it was to
carry on the lineage but now it is for foster child's own benefit. Foster child?s should be placed in the proper position that guarantee his/her welfare being, including in the time of foster parents? death regarding the legacy. The subjects of this research are how is the practice of adoption among Chinese Indonesians, what
is the legal consequence of adoption in matter of foster's child's position in Chinese Indonesians customary inheritance law, how is the practice of adoption among Chinese Indonesians as stated in Jember district court order number 10/Pdt.P/2014/Pn.Jr. The research method are juridicial normative method with explanatory typology. Data used are secondary data which gathered through literature study, beside there's also interview performed to advocating facts found in secondary data. From the research we can tell that Chinese Indonesians conduct adoption solely based on their tradition because doing it through court considered complicated and will cost a lot of money. The legal consequence of adoption in Chinese Indonesians customary inheritance law is foster child becomes adoptive parent's heir. Adoption among Chinese Indonesians as stated in Jember district court order number 10/Pdt.P/2014/Pn.Jr is the adoption of a girl which at first only conducted based on tradition then authorized by district court for the sake of legal certainty and to actualize the child's best interest.;Adoption among Chinese Indonesians are a very common thing to do if there’s no male descendant born in a marriage.
