"PMH yang dilakukan debitur pada perjanjian kredit mengakibatkan batalnya lelang eksekusi hak tanggungan seperti yang terjadi pada kasus dalam Putusan Mahkamah Agung Nomor 664PK/PDT/2020. Pembatalan lelang tersebut memberikan dampak hukum tertentu bagi para pihak dalam hal ini pemilik objek lelang yang sebenarnya, pembeli lelang, dan kreditur. Oleh karena itu, penelitian ini dilakukan untuk mengangkat permasalahan terkait (1) perbuatan melawan hukum yang menjadi dasar pembatalan lelang; dan (2) perlindungan terhadap para pihak yang dirugikan dalam rangkaian peristiwa penguasaan hak atas tanah. Penelitian hukum ini merupakan penelitian doktrinal dengan tipe penelitian eksplanatoris. Hasil penelitian adalah sebagi berikut: (1) pemalsuan identitas debitur dikategorikan sebagai PMH dan dapat dijadikan alasan untuk melakukan pembatalan lelang; dan (2) bentuk perlindungan hukum bagi pemilik obyek lelang adalah berupa hak untuk mengajukan tuntutan kepada Pengadilan untuk membatalkan lelang; sedangkan bentuk perlindungan hukum bagi pembeli lelang (yang beritikad baik) adalah hak untuk mendapatkan kembali uang pembayaran atas obyek lelang yang dimenangkannya; untuk kreditur, berhak mengajukan tuntutan ke pangadilan atas pemalsuan identitas debitur dan membayarkan sejumlah ganti rugi. Oleh karena itu, disarankan bagi para pihak terkait lelang untuk menerapkan prinsip kehati-hatian dan bekerjasama dengan Direktorat Jenderal Kependudukan Dan Pencatatan Sipil dan Kantor Pertanahan guna memeriksa riwayat kepemilikan tanah. The unlawful act committed by the debtor in the credit agreement resulted in the cancellation of the mortgage execution auction as happened in the case in the Supreme Court Decision Number 664PK/PDT/2020. The cancellation of the auction has certain legal impacts on the parties, in this case the actual owner of the auction object, the auction buyer and creditors. Therefore, this research was conducted to raise issues related to (1) unlawful acts which are the basis for canceling auctions; and (2) protection for parties who are harmed in a series of land rights control events. This legal research is a doctrinal research with an explanatory research type. The results of the research are as follows: (1) forgery of the debtor's identity is categorized as unlawfull act and can be used as a cause for canceling the auction; and (2) the form of legal protection for the owner of the auction object is in the form of the right to submit a claim to the Court to cancel the auction; while the form of legal protection for auction buyers who have good intentions is the right to get back the settlement for the auction object won; for the creditor, has the right to file a lawsuit against the court for fabricate the identity of the debtor and paying a sum of compensation. Therefore, suggested to the parties that involved in the auction to apply the precautionary principle and cooperate with the Directorate General of Population and Civil Registration and the Land Office to background check of land ownership. In addition, judges in handling similar cases should be guided by SEMA No. 7/2012 to protect auction winners as buyers with good faith."

"Perkembangan teknologi khususnya internet telah membawa banyak perubahan dalam cara bertransaksi dalam perdagangan, melalui internet peserta lelang yang sedianya harus datang ke kantor lelang, saat ini dapat mengikuti kegiatan lelang tanpa datang terlebih dahulu ke kantor lelang, Kementerian Keuangan Republik Indonesia telah membangun Aplikasi Lelang Email (ALE) untuk mendukung perkembangan dari kegiatan lelang, Kementerian Keuangan juga telah menetapkan peraturan kementerian keuangan yang memperbolehkan lelang online untuk objek hak tanggungan, Padahal sebelumnya telah ditetapkan larangan terhadap pelaksanaan lelang atas objek Hak Tanggungan (eksekusi) melalui internet, bagaimanakah keabsahan serta perlindungan hukum bagi pemenang lelang, Metode Penelitian yang digunakan dalam penulisan ini adalah yuridis normatif dengan menggunakan data sekunder. Penelitian ini menyimpulkan pelaksanaan lelang atas objek hak tanggungan melalui ALE adalah sah, karena tidak terdapat larangan dalam Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan, telah memenuhi kriteria dalam Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik dan juga telah terdapat aturan baru yakni Peraturan Menteri Keuangan (PMK) No. 27/PMK.06/2016 tentang petunjuk pelaksanaan lelang yang menentukan bahwa lelang eksekusi termasuk lelang atas objek hak tanggungan dapat dilaksanakan melalui lelang online, selain itu tidak terdapat perbedan yang signifikan antara lelang online dengan lelang konvensional oleh karenanya hak dari pemenang lelang pada dasarnya secara hukum tetap terlindungi.

The development of technology, particularly the internet, has brought many changes in commerce. Through the internet, bidders which originally have to come to the auction house, now can remotely participate in the auction. In Indonesia, The Ministry of Finance has built an e-mailauction application(ALE) to support the development of auctions. The Ministry of Finance also enacted ministerial regulation that allowsthe online auctions of mortgage objects. Previously,however, the government had set a ban on the online auction of Mortgage objects (execution auction). Therefore, the problem examined in this theses is the legal validity and the legal protection for the auction winners.The research method used in this paper is a normative study using secondary data.The writer concluded that the online auction of mortgage objects through ALE is legitimate because there is no restriction in the Act No. 4 of 1996 on Mortgage and it is comply with the Act No. 11 of 2008 on Information and ECommerce. Furthermore,the newMinister of Finance Regulation, namelyPMK 27 of 2016,determines that execution auction, including mortgage auction, can be carried out through online auction.Thewriter also found that there is no significant differencebetween online auction and conventional auction. Therefore, the auction purchaser is legally protected."

"Dunia bisnis dan perdagangan telah mengalami perubahan radikal, baik dari cara perdagangan dan obyek yang diperdagangkan, berkembang cepat seiring revolusi di bidang teknologi informasi, terutama dengan kemunculan internet. Salah satu bentuk perdagangan baru yang muncul adalah transaksi lelang yang menggunakan media internet. Salah satu pengelola lelang internet terbesar adalah eBay. Lelang internet melalui eBay ternyata mengandung beberapa kelebihan, di samping kekurangan terkait wanprestasi serta penyelesaian akibat wanprestasi. Sementara itu, Sejauh ini belum terdapat peraturan perundangan di Indonesia yang secara khusus mengatur mengenai pelaksanaan lelang internet. Namun prinsip-prinsip pokok mengenai pelaksanaan lelang internet telah diatur pada Pasal 36 ayat (1) Peraturan Menteri Keuangan No. 40/PMK.07/2006. Berangkat dari studi pada lelang internet eBay, tesis ini berupaya mendapatkan temuan-temuan yang dapat menjadi masukan dalam rangka penyempurnaan hukum lelang internet di Indonesia. Penulisan dalam tesis ini menggunakan metode yuridis normatif perspektif. Dari hasil penelitian, ditemukan bahwa regulasi terhadap lelang internet harus memberikan jaminan kepastian hukum dan perlindungan hukum yang baik. Namun demikian, prinsip-prinsip kemudahan dan kelancaran transaksi juga merupakan hal yang patut menjadi pertimbangan.

Business and trade have changed radically, both from the trade way and the object being traded. They are evolved quickly in line with the revolution in the information technology field, especially by the existence of internet. One of the new arising trade form is auction transaction using Internet media. One of the largest internet auction operator is eBay. Internet auction through eBay in fact contains some advantages and disadvantages related to the event of default and settlement of the event of default consequences. Meanwhile, so far there is no law and legislation in Indonesia that specifically regulate the implementation of internet auction. However, the basic principles on the implementation of internet auction has been regulated in Article 36 paragraph (1) Regulation of The Minister of Finance No. 40/PMK.07/2006. Based on the study on eBay internet auction, this thesis attempts to get findings that can become inputs in the frame of improvement of law on internet auction in Indonesia. This thesis writing use normative perspective juridical methods. From the research results, it is found that the regulation on internet auction must guarantee a good legal certainty and legal protection. However, the principles of convenience and smooth transaction are also the cases which should be considered."
