Abstrak :
Undang Undang No 18 tahun 1999 tentang Jasa Konstruksi sudah diberlakukan sejak Mei 2000 dan disusul dengan Peraturan Pemerintah No 29 tahun 2000 sebagai pendampingnya, dimana keduanya berlaku sebagai dasar hukum untuk industri jasa konstruksi di Indonesia. Undang-uindang itu sendiri menjanjikan adanya suatu kemitraan dan kesetaraan kedudukan antara Pemberi Tugas dan Kontraktor, namun sampai sekarang belum ada suatu standar kontrak kerja konstruksi di Indonesia yang mengacu pada kedua dokumen tersebut diatas. Tujuan dari tesis ini adalah untuk meneliti kemungkinan diberlakukannya dokumen FIDIC (1999), Conditions of Contract for Construction, sebagai standar kontrak untuk Indonesia itu, karena dokumen-dokumen terbitan FIDIC, International Federation of Consulting Engineers, telah sejak lama dipakai secara luas dalam bidang industri konstruksi internasional dan sudah terkenal dalam menerbitkan dokumen-dokumen persyaratan kontrak yang menganut asas "balanced risk sharing" antara kedua pihak. Hasil penelitian menyimpulkan bahwa dokumen FIDIC tidak bertentangan dengan perundang-undangan dan peraturan Indonesia, pemakaiannya bersifat umum sehingga cukup fleksibel dan dapat dipakai sebagai dasar dari standar kontrak kerja konstruksi untuk Indonesia. ......The Indonesian Construction Law No 18, 1999, has been effective since May 2000, followed soon thereafter by the government regulation, PP No 29, 2000, both documents provide the legal base for the construction industry. They promise a relation based on partnership and equality between the Employer and the Contractor, unfortunately however there is no standard construction contract based on those regulations in existence in Indonesia at this moment. The purpose of this thesis is to reseach the possibility of applying the FIDIC (1999). Conditions of Contract for Construction, document as the standard construction contract for Indonesia as FIDIC, the International Federation of Consulting Engineers, publications have long been in widespread use in the international construction industry and is well known for their various publications on contract conditions, which are based on balanced risk sharing principles between both parties. The result of the research has proven that the FIDIC document is in accordance with the Indonesian laws and regulations, is of a general nature and is flexible to be used as a base for the Indonesian standard form of construction contracts.

ABSTRACT<>br> In line with physical development that being speeded up by the government, Indonesia currently welcoming a huge number of foreign construction company that wants to make contract and do business on the country. At the beginning of 2017, Indonesian government regulated a new construction law named Act No. 2 2017, replacing Act No. 18 1999. Therefore in this article, the authors want to discuss about how the forementioned law Act. No.2 2017 ruling about construction contract that involving foreign contractor and then do a case study of Emrail Sdn Bhd Malaysian company on LRT Jakarta Trackworks construction contract. After the research, the author concludes that Act born constituting new norms that ruling about foreign contractor which can rsquo t be found on old construction law. However, in the practice, those new norms hasnt been fully obeyed, one of them is Emrail Sdn Bhd which breaking some rules about representative office and license Izin Perwakilan . That problem gives legal consequences to the enterprise administratively and to the LRT Jakarta Trackworks construction contract it made.
