Abstrak :
Kotamdaya Tanggerang merupakan daerah perkotaan yang memiliki angka kejadian curanmor yang relatif tinggi, karena kasus curanmor menempati peringkat teratas sebagai kasus yang paling banyak terjadi di Kotamdaya Tangerang pada periode 1995-1998. Penelitian ini bertujuan untuk mengetahui pola persebaran curanmor sehubungan dengan struktur kota di Kotamdaya Tangerang tahun 1994, 1996, dan 1998. Variabel yang digunakan adalah variabel terikat yaitu jumlah curanmor dan lokasi kejadian curanmor, dan variable bebas yaitu deliniasi struktur kota yang meliputi daerah urban, daerah peralihan dan daerah non urban.

Tingginya pencurian kendaraan bermotor di wilayah hukum Polsek Sukaraja menunjukan bahwa kinerja Bhabinkamtibmas Polsek Sukaraja masih belum optimal, seharusnya pencurian kendaraan bermotor di wilayah Polsek Sukaraja mengalami penurunan bukan mengalami kenaikan tiap tahunnya. Kinerja Bhabinkamtibmas Polsek Sukaraja masih diibaratkan sebagai petugas pemadam kebakaran karena masih kurang dalam mengidentifikasi adanya suatu permasalahan atau suatu tindak pidana. Dari kejadian tersebut, bisa dilihat bahwa masih rendahnya community policing, problem solving dan lemahnya predictive policing yang dimiliki oleh Bhabinkamtibmas Polsek Sukaraja. Kinerja Bhabinkamtibmas Polsek Sukaraja juga masih belum efektif karena banyaknya tugas-tugas kepolisian lain diluar tugas pokok Bhabinkamtibmas sehingga tidak setiap saat Bhabinkamtibmas dapat dekat dengan masyarakat serta dapat melakukan sambang, anjangsana dan kunjungan ke masyarakat meskipun Bhabinkamtibmas Polsek Sukaraja telah bergabung di dalam grup Whatsapp yang di dalamnya terdapat unsur-unsur dari masyarakat tetapi tidak semua informasi telah disampaikan ke dalam grup whatsapp tersebut. Polsek Sukaraja merupakan salah satu Polsek dari 1.062 Polsek yang ditunjuk tidak melakukan penyidikan, hanya untuk Pemeliharaan Keamanan dan Ketertiban Masyarakat pada Daerah Tertentu. Terkait maraknya pencurian kendaraan bermotor dan kinerja Bhabinkamtibmas yang belum optimal di Sukaraja tersebut, perlu upaya pemecahan masalah dengan cara mengetahui faktor penghambat kinerja Bhabinkamtibmas dalam pencegahan curanmor di Sukaraja dan upaya preemtif yang dapat dilakukan oleh Bhabinkamtibmas dalam pencegahan curanmor di Sukaraja, sehingga pelaksanaan pencegahan pencurian kendaraan bermotor yang diharapkan dapat terlaksana dengan adanya jaminan menurunnya atau menghilangnya pencurian kendaraan bermotor yang berdampak pada terwujudnya keamanan dan ketertiban masyarakat. Penelitian ini menggunakan pendekatan kualitatif. Lokasi penelitian berada di wilayah hukum Polsek Sukaraja. Landasan teori dan konsep yang digunakan yaitu konsep Community Policing yang dijelaskan lebih lanjut menggunakan Teori Partisipasi dan Teori Komunikasi, Konsep Predictive Policing dan Konsep Kinerja. Bhabinkamtibmas Polsek Sukaraja harus selalu melakukan community policing, predictive policing dan problem solving terhadap masalah yang terjadi di tengah masyarakat sehingga kinerja Bhabinkamtibmas dapat berjalan dengan optimal. ......The high rate of motor vehicle theft in the jurisdiction of the Sukaraja Sector Police indicates that the performance of the Bhabinkamtibmas of the Sukaraja Sector Police has not been optimal, it should have decreased, not increased in each year. Regarding the rise of motor vehicle theft and the non-optimal performance of Bhabinkamtibmas in Sukaraja, it is necessary to solve the problem by knowing the inhibiting factors of Bhabinkamtibmas' performance in preventing motor vehicle theft in Sukaraja and the pre-emptive efforts that could be carried out, so that the implementation of preventing motor vehicles theft, which are expected to be carried out with the guarantee of decreasing or disappearing motor vehicle theft, will have an impact on the realization of security and public order. The approach used in this study is qualitative approach. The research location is in the jurisdiction of the Sukaraja Police. The theoretical basis and concept used is the Community Policing concept which is further explained using Participation Theory and Communication Theory, Predictive Policing Concept and Performance Concept. Bhabinkamtibmas of the Sukaraja Sector Police must always carry out community policing, predictive policing and problem solving of problems that occur in the community so that the performance of Bhabinkamtibmas could be run optimally.

Kejahatan selalu berkembang seiring dengan peradaban manusia, seperti saat ini dimana manusia sudah beranjak pada penggunaan teknologi untuk memenuhi kebutuhan. Kejahatanpun semakin berkembang, mulai dari kejahatan tradisional hingga kejahatan yang menggunakan teknologi canggih dan modern. Kejahatan dapat mengganggu stabilitas nasional, dimana stabilitas nasional dan keamanan dalam negeri menjadi tanggung jawab Polri sebagaimana tercantum dalam UU No 2 tahun 2002 tentang Kepolisian Negara Republik Indonesia. Hal ini disebabkan kejahatan dapat membuat ketakutan (Fear of crime) pada masyarakat sehingga masyarakat merasa tidak nyaman dalam melaksanakan kegiatan. Polresta Tangerang yang membawahi wilayah penyangga DKI Jakarta yaitu meliputi wilayah Tangerang Kabupaten, dimana wilayah ini terdiri dari wilayah pemukiman dan wilayah perindustrian. Wilayah Polresta Tangerang memiliki tingkat crime total yang cukup tinggi diantara Polres yang lain dijajaran Polda Metro Jaya. Terutama kejahatan pencurian dengan kekerasan, pencurian dengan pemberatan dan pencurian kendaraan bermotor. Polri memiliki salah satu strategi dalam mencegah kejahatan curas, curat dan curanmor Kejahatan sebagai salah satu fokus dari teori kriminologi menghendaki upaya pencegahan yang bersifat komprehensif serta bukan hanya berorientasi pada penindakan pelaku kejahatan saja. Pencegahan Kejahatan bukan hanya merupakan tanggung jawab dari Kepolisian semata, namun juga merupakan tanggung jawab seluruh lapisan masyarakat dan pemerintah. Upaya pencegahan dirasa lebih baik daripada upaya represif. Upaya Represif belum tentu memberikan efek jera bagi para pelaku, selain itu juga sudah menimbulkan korban baik materiil maupun imateriil. Oleh karena kejahatan curas, curat dan curanmor menyebabkan ketakutan pada masyarakat, maka perlu adanya strategi guna menanggulangi kejahatan.

Tesis ini membahas hasil penelitian tentang analisis penggunaan teknik penyelidikandalam penanganan tindak pidana pencurian kendaraan bermotor di Kepolisian ResortMetro Jakarta Barat. Penelitian ini dilakukan dengan metode deskriptif-kualitatifyang bersumber dari data primer dan sekunder dengan metode pengumpulan datayang dilakukan dengan cara wawancara mendalam, wawancara pakar, observasi dantelaahan dokumen. Hasil penelitian menunjukkan bahwa masih adanya curanmor diwilayah hukum Polres Jakarta Barat, disebabkan karena belum terbongkarnyajaringan pelaku curanmor yang terdiri dari pelaku, pengirim dan penadah hasilkejahatan. Saat ini penegakan masih lebih difokuskan pada pelaku pencurian,sedangkan pelaku pengiriman dan penadah tidak seluruhnya dapat diungkap,mengingat kendaraan bermotor sangat mudah berpindah tempat dan diubahbentuknya. Berdasarkan hasil wawancara dan praktik dilapangan, kemudahanperubahan bentuk dan perpindahan kendaraan hasil curian ini juga mempersulitkepolisian dalam menemukan bukti kejahatan dan pengungkapan tuntas kasuscuranmor. Kondisi ini, mendorong munculnya pelaku-pelaku pencurian baik pelakubaru maupun residivis, karena masih ada penadah yang akan menerima hasil curian.Artinya sisi demand dan supply masih tetap berjalan, pelaku pencurian masihmendapatkan nilai ekonomis dari kejahatannya, sehingga masih terus melakukankejahatan curanmor. Selain upaya yang dapat dilakukan oleh Satreskrim PolrestroJakarta Barat adalah menggunakan teknik penyelidikan yaitu controlled deliveryyang dapat mengungkap seluruh pelaku dalam jaringan kejahatan curanmor, dalamhal ini pelaku, pengirim dan penadah yang kedudukannya berada di luar Kota JakartaBarat. Pada masa mendatang penerapan teknik penyelidikan Controlled Delivery pengiriman yang diawasi oleh pihak kepolisian, diharapkan dapat mengungkapjaringan, modus maupun menangkap seluruh pihak terkait dengan pencuriankendaraan bermotor. Pengungkapan jaringan dan modus ini diharapkan dapat lebihefektif untuk menanggulangi bahkan menghilangkan kejahatan pencurian kendaraanbermotor karena meliputi pula upaya pencegahan kejahatan yaitu denganmenghilangkan nilai ekonomis dari kejahatan.

This thesis discusses the results of research on the analysis of the use of investigationtechniques in the handling of criminal theft of motor vehicles at the Police ResortWest Jakarta Metro. This research is done by descriptive qualitative method thatcomes from primary and secondary data with data collecting method done by indepthinterview, expert interview, observation and document review. The result ofthe research shows that the existence of curanmor in West Jakarta Police area iscaused by the unfamiliar network of curanmor perpetrators consisting of theperpetrator, the sender and the felon of the crime result. Currently enforcement is stillmore focused on the perpetrators of theft, while the perpetrators of delivery andpenadah not entirely can be revealed, given the motor vehicle is very easy to moveand changed its shape. Based on the results of interviews and field practice, the easeof change of form and the transfer of stolen vehicles also makes it difficult for thepolice to find evidence of crime and complete disclosure of the case of curanmor.This condition, encouraging the emergence of the perpetrators of theft of both newand recruited perpetrators, because there are still penadah who will receive the loot.This means that the demand and supply side is still running, the theft perpetratorsstill get the economic value of the crime, so still continue to commit crime curanmor.In addition to efforts that can be done by Satreskrim Polrestro West Jakarta is to usea controlled delivery investigation technique that can reveal all the perpetrators incrime network curanmor, in this case the perpetrators, senders and penadah whoseposition is outside the West Jakarta. In the future the application of controlleddelivery supervised surveillance investigation techniques by the police, is expectedto reveal the network, mode and capture all parties related to motor vehicle theft.Disclosure of networks and modes is expected to be more effective to overcome andeven eliminate the crime of motor vehicle theft because it includes also crimeprevention efforts is to eliminate the economic value of crime.

Melihat permasalahan yang semakin kompleks dan permasalahan kejahatan curanmor dengan berbagai modus operandi yang terus mengalami perkembangan, tentunya membuat Polri terus berupaya mengungkap tindak pidana curanmor guna tertib dan tegaknya hukum.Tujuan penelitian ini untuk mengetahui modus operandi pelaku curanmor, pengambilan keputusan oleh Kapolsek dan faktor-faktor yang mempengaruhi. Sedangkan manfaat penelitian ini, berupa manfaat praktis dan manfaat akademik.Manfaat praktis, ditujukan bagi Polri khususnya Polsek Kelapa Dua dalam proses pengambilan keputusan terhadap penanganan tindak pidana curanmor.Sedangkan secara akademis sebagai kajian dan pengembangan ilmu kepolisian di lingkungan Polri.Tesis ini menggunakan pendekatan kualitatif dengan metode deskriptif. Berdasarkan kesimpulan hasil pembahasan bahwa modus operandi tindak pidana curanmor di wilayah hukum Polsek Kelapa Dua diantaranya waktu pada umumnya pada malam hari, di tempat pertokoan/perbelanjaan, warnet, kantor yang tidak dilengkapi dengan kunci ganda.Dalam pengambilan keputusan, Kapolsek melakukan alternatif penanggulangan terdiri dari dua alternatif. Namun dari kedua alternatif tersebut yang dianggap efektif adalah alternatif pertama terdiri dari : (1) melakukan tindakan preventif, melakukan himbauan-himbauan kepada pemilik warnet/pertokoan, (2) menghimbau masyarakat untuk segera melakukan tindakan hukum bila terjadi curanmor, (3) melakukan kerjasama dengan pihak dealer, (4) pembuktian forensik, (5) kerjasama dengan pihak kepolisian wilayah.Terjadinya curanmor dipengaruhi oleh factor internal yaitu dilihat dari aspek penegak hukum, kemampuan personel dan dukungan sarana dan prasarana.
