Abstrak :
This article tries to give an image on whether or not european Law can be considered as a genre in law. The treaty of the European Union, the institution of European Union itself,the role of European Court of Justice, and the draft of the European constitution all combined made the European Union not just an ordinary Regional International Organization but more a distinctful European Federation,because it still holds the sovereignty of each member states. What even more interesting to analyze is how European law combines the tradition of Roman Law and tradition of the Anglo Saxon Law. Due to these distinctive features, any country conducting bilateral relations with any ot the member states should also put some considerations to the European law that will affect their bilateral relations.

Penelitian ini adalah penelitian hukum/normatif. Penelitian ini membahas kasus Pilav v. Bosnia Herzegovina yang diadili di European Court of Human Rights. Dalam tesis ini dibahas kedudukan konstitusi negara sebagai bentuk pelaksanaan kedaulatan negara, yang dilindungi dari intervensi asing oleh hukum internasional. Dibahas pula perkembangan penegakan Hak Asasi Manusia yang berimbas pada pembatasan terhadap jurisdiksi domestik negara untuk menetapkan hukum bagi wilayah dan warga negaranya, termasuk adanya kewenangan pengadilan internasional untuk mengadili konstitusi negara yang bertentangan dengan norma hukum internasional tentang Hak Asasi Manusia. Dalam hal pertentangan antara konstitusi negara dengan aturan hukum internasional tentang Hak Asasi Manusia, digunakan sudut pandang hukum internasional dan hukum nasional. Kedua sudut pandang ini digunakan untuk menganalisis putusan European Court of Human Rights dalam kasus Pilav v. Bosnia Herzegovina.
......The purpose of this thesis is to present a case study of Pilav v. Bosnia Herzegovina before European Court of Human Rights. This thesis uses theoretical arguments and international law instruments to analyse the violation of international norms on human rights by state constitution. This thesis discusses the legal status of state constitution as a part of domaine r serv, which is protected from foreign intervention according to international law. It also discusses the development of international law on human rights, which leads to the limitation on domestic jurisdiction of a state including the emergence of international courts which have the jurisdiction to adjudicate violation of international norms on human rights by state constitution. In the conflict between international norms on human rights and state constitution, there are two perspectives that can be used international law and national law. These two perspectives are used in this thesis to examine ECtHR rsquo s jurisdiction on this case.

Abstrak :
This research explains the definition of jurisdiction, development of the extraterritorial jurisdiction and its regulation in international law which includes its principle and also boundaries. This research then analyzes cases before Al- Skeini and others v. UK case regarding the application of jurisdiciton mentioned in Article 1 of the European Convention on Human Rights (ECHR) by European Court of Human Rights (ECtHR). Furthermore, this research analyzes the applications of Article 1 ECHR in United Kingdom?s House of Lords decision and ECtHR decision in Al-Skeini. In its decision ECtHR stated that the existance of Public Power in Al-Skeini causes an extraterritorial jurisdiction in that case. The judgement cater to the human rights protection but on the other hand it still leaves a confusion in determining the requirement of extraterritorial jurisdiction in the ECHR.
Skripsi ini pertama menjelaskan pengertian yurisdiksi serta penjelasan perkembangan dan pengaturan yurisdiksi ekstrateritorial dalam hukum internasional yang mencakup prinsip-prinsip munculnya yurisdiksi ekstrateritorial juga batasan terhadapnya. Skripsi ini kemudian menganalisa kasus-kasus sebelum kasus Al-Skeini and others v. UK berkaitan dengan penerapan yurisdiksi yang dimaksud di dalam Pasal 1 European Convention on Human Rights (ECHR) oleh European Court of Human Rights (ECtHR). Skripsi ini selanjutnya menganilisa penerapan Pasal 1 ECHR dalam putusan House of Lords Inggris serta putusan ECtHR dalam kasus Al-Skeini. Putusan ECtHR menyatakan keberadaan Public Power dalam kasus Al-Sekini menimbulkan yurisdiksi ekstrateritorial atas kasus tersebut. Putusan tersebut berpihak kepada perlindungan Hak Asasi Manusia tetapi di lain sisi tetap meninggalkan kebingungan mengenai syarat jelas timbulnya yurisdiksi ekstrateritorialitas dalam ECHR.
