Penelitian ini akan meneliti Apakah Pengadilan Niaga Indonesia berwenang untuk rnemeriksa, mengadili dan memutus perkara permohonan pernyataan pailit terhadap badan usaha asing?. dan Kendala apakah yang timbul berkenaan pelaksanaan eksekusi putusan kepailitan Pengadilan Niaga Indonesia terhadap badan usaha asing yang telah berkekuatan hukum tetap?
Penelitian ini merupakan metode penelitian hukum nonnatif (yuridis normatif) dengan pendekatan analisis kualitatif terhadap dan atas informasi atau data yang diperoleh dan diperlukan guna menjawab permasalahan pokok dalam penelitian ini, dengan mengacu kepada norma-norma atau asas-asas hukum baik yang terdapat dalam peraturan perundang-undangan dan Konvensi-konvensi sebagai law in books maupun yang sudah secara konkrit ditetapkan oleh Hakim dalam kasuskasus yang diputuskan di dan oleh pengadilan sebagai law in action, yang tidak selalu ditentukan oleh jumlah (kuantitas) peristiwa yang terjadi atau banyaknya jumlah putusan pengadilan yang dimaksudkan, akan tetapi dilakukan pendalaman atas Peristiwa, Pertimbangan Hukum hakim dan Amar Putusan Pengadilan.
Dari penelitian lapangan yang dilakukan oleh peneiiti, ditemukan beberapa perkara kepailitan menyangkut permohonan pernyataan pailit terhadap pelaku usaha atau badan usaha asing baik berbentuk badan hukum maupun perorangan selaku debitur sebagai Termohon Pailit yang diajukan oleh krediturnya baik pelaku usaha Indonesia ataupun pelaku usaha asing sebagai Pemohon Pailit."

"MIC (Methyl Isocyanate) adalah bahan kimia yang sangat berbahaya dan beracun yang telah terbukti menjadi sumber bencana pada tragedi Union Carbide Bhopal tahun 1984. PT X sebagai perusahaan penghasil MIC harus memastikan adanya perlindungan keselamatan proses yang baik. Untuk memastikan hal tersebut perlu dilakukan penilaian risiko secara sistematis dan menyeluruh terhadap alat atau proses produksi MIC. Tesis ini membahas penilaian keselamatan proses menggunakan teknik Failure Mode and Effect Analysis (FMEA). 57 potensi kegagalan teridentifikasi di penelitian ini.
Hasil penelitian memberikan gambaran tentang profil severity, occurance dan detection serta diperolehnya nilai Risk Priority Number (RPN) dari ke-57 potensi kegagalan tersebut. Profil FMEA yang dihasilkan menjadi input untuk membuat skenario terburuk potensi kegagalan ganda. 8 nilai RPN tertinggi dengan potensi keparahan mayor diperoleh untuk segera ditindaklanjuti dengan tindakan perbaikan. Selain itu, diperoleh pula 2 potensi kegagalan ganda terburuk yang harus menjadi perhatian.
Di akhir tesis ini rekomendasi diberikan kepada PT X baik rekomendasi teknis terkait hasil penilaian risiko ini maupun rekomendasi yang bersifat umum untuk meningkatkan perlindungan keselamatan proses di PT X.
......MIC (Methyl Isocyanate) has been classified as extremely toxic and hazardous substances which had severely caused catastrophic at Union Carbide Bhopal in 1984. PT. X has been a producer of MIC which shall ascertain the presence of process safety strictly implemented. To ascertain those things, systematically risk assessment shall be undertaken as well as comprehensively to devices or MIC production process. This thesis elucidates the assessment of process safety by applying Failure Mode and Effect Analysis (FMEA) Technique. 57 failures potential have been identified in this research.
The result of research has provided depiction concerning the profile of severity, occurrence and detection as well as attaining RPN value of the number of 57 failures potential. FMEA profile which has been resulted, it is an input to establish the worsen scenario of multiple failure potential. The highest RPN is 8 based on attained from the major of potential severity to be promtly followed up for corrective action. Hence, 2 potential attained from the worst multiple failures shall be concerned.
In the end of this thesis recommendation is provided to PT. X either technical recommendation of resulted risk assessment or recommendation generally to enhance the protection of process safety at PT. X ."

"Dalam industri minyak dan gas, pipa dipaksa bekerja 24 jam sehari selama satu tahun, atau bahkan selama beberapa dekade. Karena digunakan untuk mendukung distribusi sejumlah besar minyak, gas, dan air dan bahkan dengan jarak yang sangat jauh, medan yang dilewati oleh jaringan pipa sangat beragam, mulai dari laut, dataran rendah, lembah, dan di tanah, kemudian di operasi akan ditemukan dalam berbagai macam masalah. Sangat penting untuk mendeteksi kegagalan di masa depan dari awal tahun atau di mana pipa baru saja dipasang.
Penelitian ini memfokuskan pada analisis risiko, pipa yang akan dianalisis adalah pipa yang berusia di bawah 2 tahun, dan untuk melihat potensi risiko kegagalan pipa, akan menggunakan metode Failure Mode and Effect Analysis (FMEA) dengan penambahan Simulasi Monte Carlo di bagian FMEA (Severity, Occurrence, Detection). Untuk melihat potensi kegagalan dari struktur pipa, itu akan menganalisis kerugian dinding berdasarkan pada ketebalan dinding awal, di mana pipa dinding tidak boleh terdegradasi sebanyak 80% dari total dinding awal. Dengan semua metode ini, memungkinkan semua perusahaan pengguna pipa untuk memantau kegagalan pipa di masa depan, terutama untuk pipa yang baru dipasang.

In the oil and gas industry, pipeline is forced to work 24 hours a day for one year, or even for decades. Because it is used to support the distribution of large amounts of oil, gas, and water and even with very long distances, the terrain passed by pipelines is very diverse, starting from the sea, lowlands, valleys, and in the ground, then in the operation will be found in many kinds of problems. It is really important to detect future failures from early year or where the pipe has just been installed.
This research is focusing on the risk analysis, the pipes to be analyzed are pipes that are under 2 years old, and to see the potential risk of pipe failure, will use the Failure Mode and Effect Analysis (FMEA) method with the addition of a Monte Carlo simulation in the Occurence (Severity, Occurrence, Detection) section. To see the potential failure of the pipe structure, it will analyze wall loss based on the initial wall thickness, where the wall pipe should not be degraded as much as 80% of the total initial wall. With all of these methods, it allows all pipe user companies to monitor pipeline failures in the future, especially for newly installed pipes.
