Abstrak :
Penulisan fanfiction atau karya penggemar menimbulkan pertanyaan mengenai status serta perlindungan hukum hak cipta yang diberikan baik kepada pencipta ataupun penulis karya fanfiction tersebut. Hal ini dikarenakan penulisan karya fanfiction tersebut tanpa izin dari pencipta dan/atau pemegang hak cipta karya asli. Dalam penelitian ini, metode yang digunakan adalah metode penelitian hukum normatif atau metode penelitian hukum kepustakaan. Penelitian ini menunjukkan bahwa karya fanfiction merupakan karya turunan yang tidak memiliki izin sehingga tidak mendapatkan perlindungan hak cipta. Bagi pencipta atau pemegang hak cipta, penulisan fanfiction merupakan pelanggaran hak moral dan/atau hak ekonomi mereka sehingga terdapat perlindungan preventif maupun represif yang dapat digunakan terhadap penulisan fanfiction tersebut. Sedangkan penulis fanfiction dapat menggunakan doktrin fair use sebagai perlindungan terhadap gugatan pelanggaran hak cipta yang diajukan kepadanya. Apabila fanfiction telah dimodifikasi sedemikian rupa sehingga tidak memiliki kesamaan substansial dengan karya aslinya, maka akan menghasilkan karya transformatif yang dilindungi oleh hak cipta. Karena penulisan karya fanfiction pada dasarnya merupakan pelanggaran hak cipta, maka penggemar sebaiknya melihat terlebih dahulu pendapat pencipta atau pemegang hak cipta mengenai penulisan fanfiction dan tidak mengkomersialisasikan fanfiction tersebut untuk mencegah gugatan pelanggaran hak cipta. ......The writing of fanfiction raises questions about the legality and copyright protection of either the author or the writer of the fanfiction itself. These questions occurred from the fact that the writing of fanfiction are done without the consent of the author and or copyright holder. The form of method that used to conduct this research is a normative judicial research. This research shows that fanfiction is an unauthorized derivative work, therefore does not hold a copyright protection. For either the author or copyright owner, the writing of fanfiction is a form of moral right and or economic right infringement, and for that there are preventive and repressive protections that can be used to protect their rights. On the other hand, the fair use doctrine can be used by the writer fanfiction as a defense against copyright infringement lawsuit filed by the copyright owner. A fanfiction that has been modified and changed in a way that it does not hold any substantial similarity with the original work falls under the transformative work, hence protected by the copyright law. Since the writing of fanfiction is a copyright infringement, fanfiction writer need to look further at whether or not the author or copyright owner approves of the writing of fanfiction based on their work and not to commercialize their fanfiction to avoid copyright infringement lawsuit.

Fanfiksi homoerotis merupakan sebuah medium dan ruang yang digunakan oleh penggemar untuk saling terhubung dengan menyalurkan perasaan dan pandangan mereka terhadap idola pada penggemar lain lewat imajinasi dan fantasi. Dalam fandom K-Pop Indonesia kehadiran fanfiksi homoerotis dengan tokoh idola (real person slash) yang memuat unsur seksual masih memicu pro-kontra, terutama di fandom ATINY (fans ATEEZ) Indonesia. Artikel ini menganalisis bagaimana dalam komunitas penggemar yang mempraktikkan penulisan fanfiksi homoerotis dalam fandom K-Pop terdapat proses pe-liyan-an terhadap golongan penggemar tertentu berdasarkan perasaan dan pandangan yang diyakini dalam fandom. Melalui pendekatan etnografi digital dan konsep afek, terlihat bahwa pro-kontra ini hadir karena penggemar yang terlibat masih terjebak dalam paradoks terhadap penerimaan terhadap LGBTQIA+ dalam konteks fanfiksi semata dan ketaatan terhadap norma serta moral yang masih berlaku di Indonesia yang tidak menerima LGBTQIA+ dan diskusi tentang seksualitas. Ekspresi seksual dimunculkan dalam fanfiksi homoerotis lewat rekonstruksi persona idola, yang membuat penggemar dapat merasakan empati atau simpati pada cerita yang mereka baca. Terdapat perasaan yang kompleks dalam praktik ini, dimana afek positif dan negatif yang muncul dibarengi dengan kebingungan dan skeptisme terhadap pandangan yang dianut oleh masing-masing anggota fandom. Hal ini memperlihatkan bahwa meskipun fanfiksi homoerotis telah membuka jalan bagi penggemar Indonesia untuk menerima kehadiran orientasi seksual dan identitas gender lain, penerimaan tersebut masih terpaku pada apa yang menurut mereka benar sesuai dengan standar moral yang dianut lingkungannya. ......Homoerotic fanfiction is both a medium and a space used by fans to connect with each other by channeling their feelings and ideas of an idol to other fans via imagination and fantasy. In Indonesian K-Pop fandom, sexualized homoerotic fanfiction that used an idol’s image is a controversial issue, especially within Indonesian ATINY (ATEEZ’s fans) fandom. This article views how within a fan community which engages in homoerotic fanfiction writing, there is a process of othering towards a certain group of fans, and this is done based on the feelings and values shared by fandom. Through digital ethnographic approach and affect framework, this research discovers that the contradiction between acceptance of homoerotic fanfiction and discrimination of those who oppose it was born because fans are trapped in a paradox of accepting LGBTQIA+ only in the space of fanfiction while still strongly comply with Indonesian’s norm and moral standard that does not accept LGBTQIA+ nor openly discuss sexuality. The sexual expressions are shown in text via idol’s persona reconstruction, which made fans sympathize or empathize with the stories they read. There are complex emotions in this practice, where both positive and negative affect are present accompanied by confusion and skepticism on the views held by fans in fandom. This finding shows that even though homoerotic fanfiction opens a path for Indonesian fans to accept the existence of other sexual orientations and gender identities, this form of acceptance is still limited to what they deemed as right, and dictated by the norm they follow.

eberadaan fanfiksi pada era modern ini tersebar ke berbagai platform. Salah satu bentuk fanfiksi adalah fanfiksi semesta alternatif atau alternate universe (AU) yang populer di media sosial Twitter. Semesta alternatif adalah sebuah genre fiksi dengan latar tempat dan latar waktu yang berbeda dengan realitas asli dari semesta alternatif tersebut. Fanfiksi ini menciptakan fenomena baru dengan kemunculan istilah “Cowok AU” dalam lingkup komunitas penggemar di Twitter. Berkaitan dengan hal tersebut, penelitian ini bertujuan menjelaskan karakteristik tokoh utama laki-laki pada fanfiksi yang diambil sebagai data kajian, serta merumuskan tipe karakter yang ada pada fanfiksi tersebut sebagai data terkait. Metode yang digunakan dalam penelitian ini adalah metode penelitian deskriptif-analitis melalui studi pustaka dan pengumpulan pendapat karakteristik “Cowok AU” menurut pembaca melalui kuesioner. Analisis penokohan ini didasarkan pada pengertian oleh Sudjiman (1988), yaitu tokoh ialah individu rekaan yang mengalami peristiwa atau tindakan dalam berbagai kejadian dalam cerita. Melalui pemaparan analisis penelitian ini, penokohan dalam fanfiksi terkait menghasilkan beberapa karakteristik yang dapat disebut sebagai “Cowok AU”. ......Fanfiction can be found in many platform in this era of modernism. Alternate universe fanfiction is one of the type of fanfiction that popular in social media Twitter. Alternate universe or semesta alternatif is one of a fiction genre which the time frame and the setting is different from its original setting of its alternate universe. This fanfiction create a new term “Cowok AU” within the fan community in Twitter. Thus, this research aim to analyze the characteristics of the characters, and also to formulize the type of the characters in the fanfiction as the related data. The method of this research is descriptive-analytical through a literature study and collecting the reader’s idea of “Cowok AU” characters through questionnaire. This research analysis based on Sudjiman (1988), that characters of a story is a created figure that experienced incident or action within the event in the story. Through the analysis, the characters in the related fanfiction has generated a few characteristics that could be called “Cowok AU”.

Aktivitas penggemar tidak lagi hanya sebatas mengkonsumsi produk budaya populer saja. Pada kenyataannya, penggemar juga menciptakan produknya sendiri, seperti yang dilakukan oleh penggemar K-Pop dengan menciptakan produk bernama fanfiction idol K-Pop. Tulisan ini berfokus kepada aktivitas yang dilakukan oleh penggemar K-Pop dalam proses menciptakan fanfiction idol K-Pop. Dengan menggunakan metode etnografi, penelitian ini menunjukkan bahwa penggemar K-Pop melakukan cultural translation untuk menciptakan fanfiction idol K-Pop. Penciptaan fanfiction idol K-Pop lalu dilihat sebagai mediated-fan practice, karena tanpa media aktivitas ini tidak dapat berlangsung. Penelitian ini juga menemukan bahwa aktivitas penggemar K-Pop dalam menciptakan fanfiction idol K-Pop tersebut dapat dilihat sebagai suatu bentuk free labor dan fan labor, dimana penggemar K-Pop tidak sadar bahwa apa yang mereka lakukan adalah sebuah bentuk labor sebab mereka tidak mendapat kompensasi dari segi ekonomi, namun secara tidak langsung menguntungkan pihak-pihak kapital.

ABSTRACT
Fan activities are no longer limited to the consumption of popular culture products. In fact, fans also create their own products, like those K-pop fans do by created a product called K-Pop idol fanfiction. This research focuses on the activities carried out by K-Pop fans in the process of creating K-Pop idol fanfiction. The method used in this research is ethnography. The result of the study shows that K-Pop fans doing a cultural translation in creating K-Pop idol fanfiction. The creation of K-Pop idol fanfiction idol was then seen as mediated-fan practice, because without media, this activity cannot be held. This research also found that K-Pop fans activity in creating those K-Pop idol fanfiction can be seen as a free labor and fan labor, where the K-Pop fans are not aware that what they are doing is a form of 'labor' because they did not get compensation in terms of any economy, but indirectly they give profit to the capital parties.
