"Perguruan Tinggi Negeri Badan Hukum atau PTN-BH ialah sebuah institusi pemerintah yang bersifat non-profit yang didirikan dalam rangka pemerataan pendidikan. Namun seiring berjalannya waktu, tujuan pendirian PTN-BH sebagai pemerataan pendidikan mulai berhadapan dengan fakta dikeluarkannya kebijakan penerapan perpajakan atas PTN-BH, dimana PTN-BH ditetapkan sebagai Pengusaha Kena Pajak. Hal ini menimbulkan permasalahan sebab dapat menghambat pelaksanaan pendidikan tinggi sebagaimana kewajiban Tri Dharma. Penelitian ini dilaksanakan untuk menganalisis implikasi kewajiban perpajakan PTN-BH setelah ditetapkan sebagai PKP ditinjau dari compliance cost dan Tri Dharma. Selain itu, penelitian ini bertujuan untuk menganalisis secara studi komparasi pengenaan PPN atas PTN-BH di beberapa negara di dunia. Penelitian ini menggunakan metode penelitian post-positivist dengan metode pengambilan data menggunakan metode kualitatif yaitu studi literatur dan wawancara mendalam. Hasil penelitian menunjukkan bahwa implikasi penetapan PTN-BH menjadi PKP menyebabkan compliance cost PTN-BH bertambah Bila ditinjau dari fungsi negara, penetapan PTN-BH sebagai PKP tidak menciderai fungsi negara, karena jasa pendidikan dikecualikan dari jasa kena pajak. Akan tetapi, penetapan PTN-BH sebagai PKP diprediksi akan mendistorsi penyelenggaraan pendidikan tinggi.Di satu sisi, hasil dari studi literatur menunjukkan bahwa international best practice atas pemajakan institusi pendidikan tinggi yang diselenggarakan pemerintah adalah Negara Malaysia karena menyediakan informasi peraturan yang komprehensif dan mudah diakses oleh seluruh kalangan.

Legal Entity State University or PTN-BH is a non-profit governmental organization that is established for equity in education. However, after a period of time, the purpose of establishing PTN-BH as equity in education begins to confront the enforcement of a taxation policy on PTN-BH, where PTN-BH was assigned as Taxable Persons. Consequently, the policy raises problems because it can impede the implementation of three pillars of high education. This research was conducted to analyze the implications of PTN-BH tax obligations after being determined as taxable persons in terms of compliance costs and Tri Dharma. In addition, this study also aims to analyze a comparative study of the imposition of VAT on PTN-BH in several countries in the world. This study applied a post-positivist research method which the collection of data used a qualitative approach namely literature studies and in-depth interviews. The results of this study indicate that the implications of establishing PTN-BH as taxable persons makes compliance cost of PTN-BH is increasing. However, the establishment of PTN-BH as PKP is predicted to distort the implementation of higher education. On the other hand, the result of the literature study proves that the international best practice for taxation of higher education institutions organized by the government is the state of Malaysia because it provides comprehensive regulatory information and easily accessed by all groups."

"ABSTRAKIstilah negara gagal hadir dan ramai digunakan sejak dekade 1990-an, kemudian kembali hadir dan ramai digunakan setelah Peristiwa Terrorisme 11 September hingga saat ini. Sayangnya, penggunaan istilah negara gagal secara umum belum memberikan elaborasi yang mendalam mengenai maksud istilah tersebut dan masih sering diperdebatkan dalam kaitannya dengan istilah negara lemah atau negara kolaps. Alhasil, terdapat variasi yang sangat beragam dalam memahami apa yang dimaksud dengan negara gagal yang sangat dikhawatirkan dapat mengarah pada kesalahan penggunaan istilah. Padahal, konsekuensi dari kesalahan penggunaan cukup serius karena anggapan sebagai sebuah negara gagal dapat menjustifikasi sebuah intervensi internasional. Dengan melakukan kajian pustaka mengenai negara gagal dalam Jurnal Hubungan Internasional atau Pembangunan Internasional serta sumber-sumber lain, Tugas Karya Akhir berjudul Konsep Negara Gagal ini hadir untuk menjawab permasalahan tersebut. Pertama, Tugas Karya Akhir ini akan mengelaborasi ragam definisi, ragam tipologi negara gagal, dan perbedaan antara istilah negara gagal dengan istilah lain terkait. Kedua, Tugas Karya Akhir ini akan menjelaskan pergeseran persepsi para akademisi mengenai negara gagal, dari mulanya sebagai ancaman terhadap kemanusiaan dan kemudian sebagai ancaman terhadap keamanan global. Terakhir, Tugas Karya Akhir ini akan menjelaskan perkembangan metode penetapan negara gagal, dari mulanya hanya berdasarkan tanda atau karakteristik hingga hadirnya Indeks Negara Gagal. Dengan penelusuran tersebut, harapannya para pembaca dapat memahami istilah negara gagal dengan baik beserta batasannya, juga dapat melihat perkembangan konseptual istilah tersebut.

ABSTRACTThe term of failed states has appeared and publicly been used since the decade of 1990s. This term then has reappeared and publicly been reused after the September 11th Terrorist Attack, untill this time. Nevertheless, the uses of the term of failed states have not given a deep elaboration about the meaning of failed states and have been very much debatable in its relation to the other more or less similar terms. Consequently, there are many variations of the understanding of the term of failed states those are feared could lead to the misused of the term. Whereas the consequences of the misused of the term of failed states are quite serious, because the perception that a state is a failed state might justify an international intervention. By doing review on literatures that provided by journals or books about International Relations or International Developments, this writing is created to solve these problems. Firstly, this writing describes some definitions of the term of failed states, some tipologies of failed states, and the differences between the term of failed states and another more or less similar terms. Secondly, this writing describess the shifting of scholars rsquo perceptions towards failed states from the perception as a threat to humanity to the perception as a threat to global security. Thirdly, this writing describes the development of the method in determining whether a state is a failed state or not from determining based only on signs or characteristics of failed states to determining based on the newly appeared Failed States Index. In the end, hopefully, the readers of this literature review will better understand the meaning of the term of failed states, its limitations, and also its conceptual development."
