Sertipikat tanah yang diterbitkan berlaku sebagai alat pembuktian yang kuat, namun apabila seseorang dapat membuktikan bahwa tanah tersebut sebagai miliknya maka ia dapat mengajukan keberatan ke pengadilan, pada putusan Putusan Pengadilan Negeri Denpasar Nomor 116/Pdt.Plw/1996/PN.DPS terdapat tumpang tindih antara satu bidang tanah dengan yang lainnya di Desa Pemecutan kota Denpasar provinsi Bali, permasalahan pada penelitian ini yaitu apakah yang menyebabkan terjadinya kesalahan proses pengukuran dalam penerbitan sertipikat hak milik nomor 3038/Desa Pemecutan serta apakah pertimbangan Kepala Kantor Pertanahan kota Denpasar untuk membatalkan sertipikat yang sedang bersengketa sesuai dengan ketentuan yang berlaku. Penelitian ini menggunakan metode penelitian kepustakaan yang bersifat yuridis normatif, kesimpulan dari penelitian ini yaitu penyebab terjadinya kesalahan pengukuran dalam penerbitan sertipikat pada kasus tersebut karena kesalahan prosedur pada saat pembuatan surat ukur, serta ketidaktelitian pejabat kantor pertanahan kota Denpasar, pertimbangan Kepala Kantor Pertanahan kota Denpasar untuk membatalkan kedua sertipikat yang sedang bersengketa telah sesuai dengan ketentuan yang berlaku, sebagaimana diatur dalam pasal 103 PMNA/KBPN 9/1999, maka tanpa ada permohonan pembatalan, Kepala Badan Pertanahan Nasional dapat mengeluarkan keputusan pembatalan hak tersebut

Land certificate which issued served as strong evidence of ownership, but if someone can prove that the land as his own then he may appeal to court, in denpasar district court verdict number 116/PDT.PLW/1996/PN.DPS there is overlap between the plot with the others in the village of Pemecutan City of Denpasar at Bali province, The problem in this research is what causes an error in the measurement process of issuance of certificates of property rights number 3038 /Desa Pemecutan and whether the consideration of the Head Office of Denpasar city to cancel certificates dispute in accordance with applicable regulations, This literature research used juridical normative research, The conclusion of this study is the cause of measurement error in the issuance of the certificate in the case because of procedural errors during certificate measurement, as well as the inaccuracy of Denpasar city land office officials. Consideration of the Head Office of Denpasar city to cancel the certificate the dispute in accordance with the applicable provisions, as stipulated in article 103 PMNA / KBPN 9/1999, then without any request for cancellation, the National Land Agency have the right to issue certificate cancelation proposal
