Abstrak :
Skripsi ini membahas mengenai pertanggungjawaban hukum bagi dokter dan klinik kecantikan yang menyediakan layanan stem cell untuk perawatan estetika beserta analisis penulis terhadap Putusan Pengadilan Negeri Jakarta Selatan Nomor 563/Pid.Sus/2020/PN.Jkt.Sel. Fokus dari penelitian ini adalah mengenai legalitas penggunaan stem cell di Indonesia baik untuk tujuan pelayanan kesehatan maupun untuk digunakan dalam perawatan estetika. Bentuk penelitian skripsi ini adalah yuridis normatif dengan tipe deskriptif dan metode kualitatif. Hasil penelitian ini menyimpulkan bahwa penggunaan stem cell di Indonesia untuk tujuan penyembuhan penyakit maupun perawatan estetika diperbolehkan secara terbatas pada fasilitas pelayanan kesehatan yang telah mendapatkan izin dari kementerian kesehatan. Putusan Nomor 563/Pid.Sus/2020/PN.Jkt.Sel merupakan putusan yang menjatuhkan hukuman pidana terhadap seorang dokter yang menggunakan stem cell untuk perawatan estetika pada pasiennya. Hasil penelitian ini menyarankan agar pemerintah terutama kementerian beserta organisasi kedokteran yang berwenang untuk segera mengeluarkan pengaturan terkait kompetensi dokter yang diperbolehkan menggunakan stem cell baik untuk pelayanan kesehatan maupun untuk perawatan estetika sehingga kepastian hukum bagi dokter yang melakukan praktik stem cell dapat terwujud. ......This study discusses legal accountability for doctors and beauty clinics that provide stem cell for aesthetic treatment along with the author's analysis of the South Jakarta District Court Verdict Number 563 / Pid.Sus / 2020 / PN.Jkt.Sel. The focus of this research is on the legality of using stem cells in Indonesia both for health care purposes and for use in aesthetic treatments. The form of this thesis research is normative juridical with descriptive type and qualitative methods. The results of this study conclude that the use of stem cells in Indonesia for the purpose of curing diseases and aesthetic treatments is limited to health care facilities that have obtained permission from the ministry of health. Verdict Number 563 / Pid.Sus / 2020 / PN.Jkt.Sel is a verdict that imposes a criminal sentence on a doctor who uses stem cell for aesthetic treatment of his patient. The results of this study suggest that the government, especially the ministry of health and medical organizations that are authorized to immediately issue regulations regarding the competence of doctors who are allowed to use stem cells for both health services and for aesthetic treatment, so that legal certainty for doctors who uses stem cell in their practicecan be realized.

Skripsi ini membahas mengenai pertanggungjawaban hukum dokter dan pemilik klinik kecantikan ditinjau berdasarkan hukum kesehatan. Penelitian ini merupakan penelitian yuridis normatif yang menekankan pada penggunaan data sekunder. Penyelenggaraan Klinik Kulit dan Kecantikan merupakan bagian dari kegiatan pelayanan publik di bidang kesehatan yang berada dalam ranah hukum Kesehatan yang sangat terkait dengan aspek etika dan disiplin medis. Pemberlakuan hukum kesehatan ini sangatlah penting untuk memberikan kerangka pertangggungjawaban hukum dokter dan pemilik klinik kecantikan dalam rangka untuk memberikan perlindungan dan kepastian hukum, baik terhadap pemberi maupun penerima jasa pelayanan kesehatan. Mengacu pada analisis putusan pengadilan, telah menunjukkan atas lemahnya implementasi atau penegakan hukum kesehatan. Kelemahan tersebut diindikasikan oleh adanya disparitas antara ancaman hukuman yang diatur dalam hukum kesehatan dengan vonis yang dijatuhkan oleh majelis hakim terhadap pelaku dan penyelesaian pertanggungjawaban hukum pelaku yang masih sangat parsial. Penegakan hukum kesehatan seharusnya dilakukan secara komprehensif dan tegas terhadap seluruh pihak yang terlibat, terutama dokter dan pemilik klinik kecantikan.

This thesis discusses on the legal responsibilities of doctor and the owner of aesthetic clinic based on health law. This study applies a normative legal study that emphasizes the use of secondary data. The operational of the Aesthetic Clinic is part of public service activities in the Health Sector which is very related to ethical aspects and medical disciplines. The implementation of this health law is very important to provide a framework of legal responsibility of doctor and the aesthetic clinic owner in order to give protection and legal certainty, both for the health service providers and recipients. Based on the analysis of the court decision, it has been shown the weakness of the implementation or the enforcement of the health law. The weakness is indicated by the disparity between the threat of punishment regulated in the health law with the verdict imposed by the judges to the perpetrator and the settlement of the legal responsibilities of the perpetrator which is very partial. The Health Law enforcement should be done comprehensively and firmly to all parties involved, especially to the doctor and the owner of the aesthetic clinic.

Industri kecantikan saat ini menjadi sebuah potensi pasar yang besar dalam bisnis, karena perawatan kecantikan telah menjadi sebuah kebutuhan yang dianggap penting untuk meningkatkan performa diri maka dijadikan momen bagi para pengusaha terutama pada sektor jasa untuk mendukung kehadiran klinik kecantikan dalam memenuhi kebutuhan masyarakat akan perawatan kecantikan, termasuk di Kecamatan Cibinong. Perkembangan bisnis klinik kecantikan yang semakin pesat membuat klinik kecantikan perlu memperisapkan strategi, lokasi menjadi strategi utama untuk sukses. Penelitian ini dilakukan dengan tujuan untuk mengetahui pengaruh lokasi tersebut terhadap kesuksesan bisnis klinik kecantikan di Kecamatan Cibinong. Variabel yang digunakan untuk mengukur tingkat kesuksesan ialah lama usaha, pencapaian BEP, dan jumlah pengunjung klinik kcentikan. Pengumpulan data pada penelitian ini dilakukan dengan cara observasi lingkungan klinik kecantikan dan wawancara kepada manajer atau pengelola klinik kecantikan. Hasil penelitian ini dapat menjelaskan bahwa lokasi memiliki pengaruh terhadap tingkat kesuksesan bisnis klinik kecantikan. Klinik kecantikan yang berada di kelas jalan arteri dan di sekitar kawasan komersil, permukiman, dan perkantoran pemerintahan memiliki tingkat kesuksesan yang lebih sukses dibanding kelas jalan lokal dan di sekitar kawasan permukiman. Klinik kecantikan dengan karakteristik lokasi strategis untuk kecantikan klinik yang dilihat berdasarkan aksesibilitas, visibilitas, dan kondisi lingkungan bisnis yang tergolong tinggi dan memiliki fasilitas sangat lengkap dan tipe klinik kecantikan jenis perawatan sangat lengkap dan target pasar differentiated marketing (tipe 1) memiliki tingkat kesuksesan yang sukses. Sedangkan lokasi yang kurang strategis untuk kecantikan klinik yang dilihat berdasarkan aksesibilitas, visibilitas, dan lingkungan bisnis yang tergolong sedang dan memiliki fasilitas lengkap dan tipe klinik kecantikan dengan jenis perawatan lengkap dan target pasar concentrated marketing (tipe 4) memiliki tingkat kesuksesan yang kurang sukses. ......The beauty industry is currently a huge market potential in business, because beauty care has become a necessity that is considered important to improve self-performance, so it is used as a moment for entrepreneurs, especially in the service sector, to support the presence of beauty clinics in meeting people's needs for beauty care. including in Cibinong District. The rapid development of the beauty clinic business makes beauty clinics need to prepare a strategy, location being the main strategy for success. This research was conducted with the aim to determine the effect of the location on the success of the beauty clinic business in Cibinong District. The variables used to measure the level of success are length of effort, achievement of BEP, and the number of visitors to the clinic. Data collection in this study was carried out by observing the environment of the beauty clinic and interviewing the manager or manager of the beauty clinic. The results of this study can explain that location has an influence on the success rate of the beauty clinic business. Beauty clinics located in arterial road classes and around commercial, residential and government office areas have a higher success rate than local road classes and around residential areas. A beauty clinic with the characteristics of a strategic location for a beauty clinic as seen based on accessibility, visibility and business environmental conditions which are classified as high and have very complete facilities and a type of beauty clinic with a very complete type of care and a differentiated marketing target market (type 1) has a successful success rate. While the location is less strategic for a beauty clinic as seen based on accessibility, visibility and business environment which is classified as moderate and has complete facilities and the type of beauty clinic with a complete type of treatment and concentrated marketing target market (type 4) has a success rate that is less successful.

Abstrak :
Seiring dengan perkembangan industri kecantikan secara global maupun di Indonesia, persaingan antara klinik kecantikan terus meningkat. Retensi pelanggan merupakan unsur yang penting bagi klinik kecantikan dalam meningkatkan loyalitas, serta meningkatkan keuntungan yang didapat agar dapat bersaing dan bertahan dalam industri. Klinik kecantikan yang menjadi objek penelitian ini menghadapi kesulitan dalam meyakinkan pelanggan untuk melakukan repurchase perawatan kecantikan. Variabel laten yang memengaruhi keputusan pelanggan dalam melakukan repurchase diteliti dalam penelitian ini menggunakan metode structural equation modeling untuk menguji hubungan antara kualitas layanan, nilai pengalaman, dan intensi repurchase. Variabel yang ditemukan berpengaruh secara signifikan dalam keputusan pelanggan melakukan repurchase digunakan sebagai indikator penentuan prioritas strategi untuk meningkatkan retensi pelanggan menggunakan metode technique of order of preference by similarity to ideal solution. Berdasarkan hasil dari penelitian ini, ditemukan bahwa kualitas layanan berpengaruh secara signifikan terhadap intensi repurchase, dengan sepuluh variabel terukur yang berasal dari lima dimensi SERVQUAL. Prioritas strategi dimulai dengan memberikan jaminan layanan, meningkatkan kualitas alat yang digunakan untuk perawatan, dan memperbaiki perilaku karyawan. ......With the development of beauty industry globally and in Indonesia, the competition between beauty clinics is increasing. Customer retention is an important element for beauty clinic in increasing customer loyalty and increasing profit to compete and survive in the industry. The beauty clinic which is the object of this research is facing difficulties in convincing customer to repurchase beauty treatment. Latent variables that affect customer’s decision to repurchase are analyzed using structural equation modeling to test the relationship between service quality, experiential value, and repurchase intention. Variables that are found to have a significant effect to customer’s decision to repurchase are then used as indicators to decide strategy priority to increase customer retention using technique of order of preference by similarity to ideal solution method. Based on the findings of this research, it is found that service quality has a significant effect to repurchase intention, consisting of ten measured variables derived from five dimension of SERVQUAL. Strategy priority is started with giving service assurance, increasing quality of tools used for treatment, and improving employee behavior.
