Abstrak :
Korupsi merupakan masalah yang menjadi perhatian dari masyarakat internasional. Untuk menghadapi masalah tersebut, negara-negara di dunia kemudian membuat dan menandatangani perjanjian internasional yakni United Nation Convention Againts Corruptions UNCAC , dimana didalam UNCAC ini dikenal suatu konsep baru perampasan aset yang dikenal dengan Non-Conviction Based Asset Forfeiture yang memungkinkan negara untuk merampas aset hasil korupsi tanpa memidana pelaku korupsi tersebut. Akan tetapi bagaimana jika terdapat suatu kepentingan dari pihak lain terhadap aset tersebut, dalam hal ini kreditor. Dalam hal ini konsep Non-Conviction Based Asset Forfeiture ini dapat memberikan perlindungan kepada kreditor dalam bentuk pihak ketiga yang beritikad baik dan juga pemberian hak untuk mengajukan keberatan terhadap permohonan perampasan aset yang diajukan. Hal ini serupa dengan pengaturan tentang perlindungan bagi kreditor di Amerika, Australia dan juga Filipina. ......Corruption is an issue of concern from the international community. To address these issues, the countries in the world then create and sign international treaties named United Nations Convention Against corruptions UNCAC . There is a new concept of assets forfeiture within UNCAC, known as Non Conviction Based Asset forfeiture which allows the state to seize assets resulting from corruption without convict perpetrators of corruption. But what if there is an interest of the other party to such assets, in this case the creditor. In this case the concept of Non Conviction Based Asset forfeiture is to provide protection to creditors in the form of third parties acting in good faith and also granting the right to raise objections against the petition filed confiscation of assets. This is similar to the setting of protection for creditors in the United States, Australia and the Philippines.
