"ABSTRAKTesis ini membahas mengenai intervensi Kementerian Perhubungan melalui Peraturan Menteri Perhubungan No.108 Tahun 2017 terhadap taksi berbasis online sebagai pelaku usaha mikro terkait dengan Undang-Undang persaingan usaha. Penelitian Ini adalah penelitian hukum dimana suatu penelitan hukum tentu bersifat normatif, dengan mengunakan pendekatan Undang-Undang sehingga penelitian ini menelaah Undang-Undang dan regulasi yang berhubungan dengan isu hukum terutama sehubungan dengan Peraturan Menteri Perhubungan No.108 Tahun 2017 tentang Peyelenggaraan Angkutan Orang Dengan Kendaraan Bermotor Umum Tidak Dalam Trayek dengan Undang-Undang No.5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat dimana jika terjadi suatu pertentangan antara peraturan perundang-undangan maka hierarki-nya peraturan perudangang-undangan yang lebih rendah tersebut harus disisihkan. Hasil penelitian menyimpulkan bahwa pelaku usaha taksi online selaku pelaku usaha mikro diakui dan dilindungi oleh pengecualian yang terdapat dalam peraturan persaingan usaha, kemudian Pemerintah melakukan intervensi terhadap usaha taksi online melalui Peraturan yang dikeluarkan oleh Kementerian Perhubungan meskipun peraturan dari Kementerian Perhubungan tersebut telah beberapa kali di mohonkan untuk di uji materiil, hal ini tidak terlepas dari ketidak sesuaian Peraturan Menteri Perhubungan tersebut terhadap Peraturan perundang-undangan yang berada diatasnya terutama terhadap Undang-Undang persaingan usaha. Oleh karena itu Sebaiknya Kementerian Perhubungan lebih berhati-hati dalam membuat suatu peraturan dengan memperhatikan peraturan yang berada diatasnya serta memperhatikan saran serta masukan dari berbagai pihak.

ABSTRACT

This thesis discusses the intervention of the Ministry of Transportation through the Minister of Transportation Regulation No.108 of 2017 towards online-based taxis as micro-business actors related to the competition law. This research is legal research where legal research is of course normative, using the Law approach so that this study examines laws and regulations relating to legal issues, especially in connection with the Minister of Transportation Regulation No.108 of 2017 about organizing people transportation with public motor vehicles not in route with Law No.5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition where if there is a contradiction between laws and regulations, the lower hierarchy of regulatory regulations must be set aside. The results of the study concluded that online taxi business actors as micro-entrepreneurs were recognized and protected by the exceptions contained in business competition regulations, then the Government intervened in online taxi businesses through regulations issued by the Ministry of Transportation even though the regulations from the Ministry of Transportation had been requested several times to be subjected to judicial review, this is inseparable from the incompatibility of the Minister of Transportation's Regulation on the legislation that is above it, especially in respect of the competition law. Therefore, the Ministry of Transportation should be more careful in making a regulation by paying attention to the regulations above it and paying attention to suggestions and input from various parties."

"Pengesahan Peraturan Menteri Perhubungan Nomor 98 Tahun 2017 bertujuan dalam mengakomodir regulasi penyelenggaraan transportasi publik yang aksesibel bagi pengguna jasa berkebutuhan khusus, termasuk penyandang disabilitas. PT KCI menjadi salah satu operator transportasi publik yang ikut berkomitmen dalam menyelenggarakan layanan Commuter Line yang ramah bagi penyandang disabilitas, termasuk di wilayah Depok. Penelitian ini bertujuan untuk menganalisis faktor-faktor yang memengaruhi implementasi Peraturan Menteri Perhubungan Nomor 98 Tahun 2017 pada layanan Commuter Line Depok bagi penyandang disabilitas. Analisis dilakukan dengan menggunakan teori implementasi Edwards III dengan 4 faktor yang memengaruhi implementasi, yaitu communications, resources, disposition, dan bureaucratic structure. Penelitian ini menggunakan pendekatan post-positivist dengan teknik pengumpulan data kualitatif melalui wawancara mendalam dengan 12 narasumber, obeservasi, dan studi kepustakaan. Hasil analisis menunjukkan bahwa terdapat 10 dari 18 indikator yang terpenuhi terkait faktor-faktor yang memengaruhi implementasi Peraturan Menteri Perhubungan Nomor 98 tahun 2017 pada layanan Commuter Line Depok bagi penyandang disabilitas. Hambatan pada faktor-faktor yang memengaruhi implementasi Peraturan Menteri Perhubungan Nomor 98 Tahun 2017 pada layanan Commuter Line Depok bagi penyandang disabilitas berkaitan dengan komunikasi terhadap stakeholder penyandang disabilitas yang belum merata dan menyebabkan penyelenggaraan layanan Commuter Line Depok belum sepenuhnya terwujud sesuai kebutuhan penyandang disabilitas, baik dari segi sarana, prasarana, dan petugas. Pelaksana kebijakan perlu untuk memperluas keterlibatan penyandang disabilitas serta melengkapi fasilitas sarana dan prasarana aksesibel yang belum terpenuhi, termasuk memberikan pelatihan kepada petugas dan menyediakan informasi yang dapat diterima bagi seluruh penyandang disabilitas.......The ratification of the Minister of Transportation Regulation Number 98 of 2017 aims to accommodate regulations on the implementation of accessible public transportation for service users with special needs, including persons with disabilities. This study aims to analyze the factors that influence the implementation of Minister of Transportation Regulation Number 98 of 2017 on Depok Commuter Line services for persons with disabilities. The analysis was carried out using Edwards III's implementation theory with 4 factors that influence implementation, namely communications, resources, disposition, and bureaucratic structure. This study uses a post-positivist approach with qualitative data collection techniques through in-depth interviews with 12 informants, observation, and literature studies. The results of the analysis show that there are 10 out of 18 indicators that are fulfilled regarding the factors that influence the implementation of the Minister of Transportation Regulation Number 98 of 2017 on Depok Commuter Line services for persons with disabilities. Obstacles to the factors that influence the implementation of Minister of Transportation Regulation Number 98 of 2017 on Depok Commuter Line services for persons with disabilities are related to communication to stakeholders with disabilities that have not been evenly distributed and have resulted in the implementation of Depok Commuter Line services not being fully realized according to the needs of persons with disabilities, both from terms of facilities, infrastructure, and staff. Policy implementers need to expand the involvement of persons with disabilities and complete accessible facilities and infrastructure that have not been met, including providing training to officers and providing information that is acceptable to all persons with disabilities."
