Abstrak :
The concept of restorative justice plainly submitted concerning criminal justice which involved the whole snake holders to anticipate through forthcoming dilemma?s. Based those concepts the criminal conduct precisely creating the belier circumstances by looking solution to healing. reconciliation and reassured. The author?s also thought that objective of sentence in restorative justice and in the draft of Indonesian Criminal law amendment are having the same paradigm. It has been proved by the draft of amendment which slated that the objective of sentence is origined from lndonesian's sentence philosophy. The philosophy is based on collectivety and harmonization paradigm which given crucial role of the society.

Pemikiran Kuhn bergantung pada konsep paradigma untuk revolusi ilmiahnya. Pergeseran paradigma bergerak seperti siklus yang bermula pada sains normal, anomali, krisis, dan revolusi ilmiah, lalu kembali menjadi sains normal. Akan tetapi, terdapat ambivalensi dalam konsep paradigma itu sendiri. Tentunya hal itu berdampak juga terhadap revolusi ilmiah yang digagas oleh Kuhn. Selain itu, hierarki dari konsep paradigmanya ini menimbulkan bias. Kuhn terlalu menekankan posisi sains normal yang hanya bergeser oleh fakta anomali dan krisis. Ambivalensi bahasa dalam konsep paradigma mengakibatkan inkonsistensi dalam merumuskan revolusi ilmiah. Penelitian ini akan berusaha untuk menelaah implikasi ambivalensi konsep pergeseran paradigma Thomas Kuhn dan relevansinya terhadap revolusi ilmiahnya. Pembuktian akan dianalisis menggunakan konsep dekonstruksi Jacques Derrida. Kemudian, menelaah kembali konsistensi struktur revolusi ilmiah Kuhn. Setelah itu, konsep paradigma yang ambivalen menyebabkan kerusakan konsep pergeseran paradigma yang menyebabkan paradigma terjadi tanpa krisis karena paradigma terjadi disebabkan terdapat titik balik. Ini membuat struktur dari revolusi ilmiah berubah yang tadinya normal-anomali-krisis-luar biasa menjadi normal-titik balik-luar biasa. ......Kuhn's thinking relies on the concept of paradigm for his theory of scientific revolution. This paradigm shift moves in a cycle starting with normal science, anomalies, crises, and scientific revolution, then returning to normal science. However, there is ambivalence within the concept of paradigm itself. This inevitably affects the scientific revolution proposed by Kuhn. Furthermore, the hierarchy of his paradigm concept introduces bias. Kuhn places excessive emphasis on the position of normal science, which is only shifted by anomalies and crises. The ambivalence of language within the concept of paradigm leads to inconsistencies in formulating the scientific revolution. This study aims to examine the implications of the ambivalence of Thomas Kuhn's paradigm shift concept and its relevance to his theory of scientific revolution. The analysis will employ Jacques Derrida's concept of deconstruction. The consistency of Kuhn's structure of scientific revolution will be re-evaluated. Subsequently, the ambivalent concept of Paradigm causes inconsistency to the concept of paradigm shift, leading to paradigm shifts occurring without crises as they are triggered by turning points. This results in a change in the structure of scientific revolution, transforming it from normal-anomaly-crisis-extraordinary to normal-turning point-extraordinary.
