"Tesis ini akan membahas tentang perlindungan hukum terhadap para pihak dalam perjanjian pemanfaatan lahan bersama area pertambangan dan perkebunan antara PT. MPP dan PT. BDA, berdasarkan peraturan perundang-undangan yang berlaku. Penelitian ini dilakukan dengan pendekatan studi normatif terhadap peraturan perundang-undangan yang berlaku dan juga dengan pendekatan studi kasus.Dari hasil penelitian yang telah dilakukan, diperoleh hasil bahwa perjanjian pemanfaatan lahan bersama antara PT. MPP dan PT. BDA telah memenuhi syarat-syarat sahnya suatu perjanjian yang ditentukan oleh peraturan perundang-undangan yang berlaku. Dalam penelitian ini ditemukan adanya beberapa kelemahan dalam perumusan perjanjian pemanfaatan lahan bersama antara PT. MPP dan PT. BDA, dimana kelemahan tersebut dapat dilihat dengan tidak diakomodirnya klausul force majure didalamnya.

This thesis will discuss on the legal protection of the parties in a land use agreement with the mining and plantation area between PT. MPP and PT. BDA, based on legislation in force. This research was conducted with the normative approach to the study of the laws and regulations in force and also with the case study approach.

From the research that has been done, the results showed that land use agreement between PT. MPP and PT. BDA has fulfilled the terms of the validity of a treaty which is determined by the legislation in force. In the present study found a number of weaknesses in the formulation of land use agreement with the PT. MPP and PT. BDA, where weaknesses can be seen by the force majeure clause omission therein."
