"Implementasi tugas dan fungsi lembaga pemerintah yang berada di lingkaran terdekat Presiden menjadi hal yang menarik untuk diteliti. Posisi strategis yang dimilikinya tidak serta merta menjadikan perannya terlaksana secara optimal. Hal ini dapat dilihat dari fungsi pemberian rekomendasi kebijakan yang dijalankan Sekretariat Kabinet. Permasalahan seperti adanya alur pengajuan kebijakan yang belum terlaksana sepenuhnya maupun permasalahan pada hal-hal yang bersifat administratif seperti kekuatan peraturan perundang-undangan yang mengatur, strategi komunikasi, dukungan teknologi informasi, efektifitas pemantauan kebijakan, maupun penerapan sanksi, membuat implementasi fungsi tersebut belum berjalan optimal. Untuk itu, penelitian ini bertujuan menganalisis implementasi dari fungsi pemberian rekomendasi kebijakan yang dilaksanakan Sekretariat Kabinet beserta faktor-faktor yang mempengaruhinya. Kerangka analisis yang digunakan dalam penelitian ini adalah Teori Implementasi Kebijakan, khususnya Model Implementasi Administratif yang dikemukakan Matland (1995). Pendekatan dalam penelitian ini adalah post-positivist, dengan metode penelitian kualitatif bersifat analisis deskriptif. Fokus penelitian yaitu lembaga Sekretariat Kabinet periode tahun 2015 hingga saat ini. Hasil yang diperoleh dari penelitian ini adalah implementasi fungsi pemberian rekomendasi kebijakan sudah berjalan, namun terdapat berbagai tantangan dan permasalahan yang membuat fungsi tersebut belum terimplementasi secara optimal. Faktor-faktor seperti seperangkat peraturan, komunikasi pelaksana, dukungan teknologi informasi, efektifitas pemantauan, pemberlakuan sanksi, maupun kompetensi pelaksana berpengaruh terhadap implementasi fungsi tersebut. Dari faktor-faktor tersebut, masih kurang kuatnya peraturan perundang-undangan menjadi permasalahan fundamental yang membuat implementasi fungsi pemberian rekomendasi kebijakan belum berjalan optimal. Untuk itu, diperlukan berbagai upaya pembenahan dan penataan agar peran sentral Sekretariat Kabinet dalam policy making process dapat berjalan sebagaimanya mestinya.

The implementation of the duties and functions of government institution in the President's closest circle, is an interesting thing to research. Its strategic position does not necessarily make its role carried out optimally. This can be seen from the function of providing policy recommendations carried out by the Cabinet Secretariat. Problems such as the disobedience of stakeholders to the flow of policy submissions, as well as problems on administrative matters such as supporting rules, communication strategies, information technology support, the effectiveness of policy monitoring, and the implementation of sanctions, have made the implementation of such functions not run optimally. Therefore, this study aims to analyze the implementation of the function of providing policy recommendations by the Cabinet Secretariat. The analytical framework used in this study is Policy Implementation Theory, particularly the Administrative Implementation Model by Matland (1995). This research uses post positivist approach, wtih qualitative method that is descriptive analysis. Focus of the research is the Cabinet Secretariat in the period 2015 until now. The result of this study is the implementation of the function of providing policy recommendations in dealing with various challenges and problems. actors such as a set of regulations, implementing communications, information technology support, effectiveness of monitoring, imposition of sanctions, and competence of implementers affect the implementation of these functions. From these factors, the lack of strong laws and regulations is a fundamental problem that makes the implementation of the function of providing policy recommendations not running optimally. For this reason, various efforts are needed to improve and organize so that the central role of the Cabinet Secretariat in the policy making process can run properly. "

"Makalah penelitian ini menggali peningkatan efektivitas arbitrase dan penyelesaian sengketa alternatif (ADR) dalam sistem hukum Indonesia. Melalui pendekatan penelitian kualitatif dan pemeriksaan menyeluruh terhadap praktik terbaik internasional, penelitian ini bertujuan untuk berkontribusi pada kerangka hukum yang kuat dan dukungan kelembagaan untuk ADR di Indonesia, yang pada akhirnya mempromosikan lingkungan bisnis yang menguntungkan, akses terhadap keadilan, dan mengurangi beban peradilan.

Drawing upon successful models from jurisdictions like Singapore, France, Hong Kong, and Sweden, the paper offers policy recommendations to improve the efficiency, accessibility, and overall effectiveness of arbitration and ADR mechanisms in Indonesia. Through a qualitative research approach and a thorough examination of international best practices, the research aims to contribute to a robust legal framework and institutional support for ADR in Indonesia, ultimately promoting a favourable business environment, access to justice, and reducing the burden on the judiciary."
