"ABSTRAKPenelitian ini berfokus untuk membuktikan bahwa keterbatasan akses dalam fasilitas balapotomotif menjadi salah satu penyebab balapan liar. Berdasarkan penelitian sebelumnya mengenaidisukusi akses terhadap infrastruktur publik, menunjukkan bahwa salah satu kunci utama dariinfrastruktur publik adalah umum di masyarakat, mudah diakses, terbuka, dan terjangkau, dengan katalain dapat dikatakan inklusif. Riset ini berusaha melebarkan ruang literatur dari permasalahan sosialekonomi ke keseluruhan aksesibilitas dalam dunia balap otomotif. Hal ini disebabkan hanya terdapatsatu fasilitas balap permanen di area Jabodetabek yang berbiaya mahal bagi penggunaan pribadi dantidak ada pilihan lain untuk balapan secara resmi sampai sekarang, terkecuali terdapat acara-acaratertentu. Penggunaan jalanan umum dapat juga dapat digunakan secara illegal sebagai lintasan dragataupun arena drifting oleh aktor balap mobil karena lebih mudah di akses yang mana kegiatan inidianggap sebagai balap liar. Metode dalam penelitian ini menggunakan pendekatan kunatitatif denganpengisian kuesioner kepada responden sebagai pelaku dari balap liar di Jakarta, ditambah denganobservasi pada kegiatan balap liar dan infrastruktur publik. Hasil penelitian menunjukkan bahwaperilaku balap mobil benar adanya berhubungan dengan kemampuan aksesibilitas seseorang, di manabalap mobil resmi lebih mudah di akses oleh kelompok yang memiliki kemampuan aksesibilitas yangtinggi dari segi finansial, fisik, organisasional, dan ketersediaan waktu, sehingga kelompok yangmemiliki kemampuan aksesibilitas yang lebih rendah cenderung lebih memilih balap liar.

ABSTRACTThis research is focused on proofing that the limited access factors on automotive racing facilities arecausing illegal street racing. Based on previous researches about leisure activities in the city, stated thatthe one of main role for public infrastructure things being popular to society is the accessible, open, andaffordable, or in other words for being inclusive. This research tried to widen literature space of accessissues and socioeconomic issues into automotive racing scene. Since there is only one permanentracing facilities in Greater Jakarta area that cost a fortune for privateer and no other accessible racingfacilities which exist recently, in spite of well-prepared official racing events. Thus implies to mainargument that, lack of accessible legal places to race as a privater explains illegal street racing scenehappened in Jakarta. As the public road usage may also be used illegally as dragstrip or drift park bystreet racers, as two-function of space. The method used in this research is quantitative approach thatusing questionnaire to the respondents as the participants of street racing in Jakarta, plus usingobservation to the street racing scene and public infrastructure. The research shows that automotiveracing activities are related to actors access ability. It shows that sanctioned automotive racing requireshighier accesibility abilities rather than illegal street racing."

"Negara Indonesia adalah merupakan negara hukum sebagaimana disebutkan dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dalam konteks yang berkaitan dengan pasal tersebut juga dapat dilihat dengan adanya sebuah negara hukum tentunya harus dihadirkan pula kepastian hukum sehingga tidak ada terjadi kesalahan-kesalahan dalam penegakan hukum baik dari segi prosedural, bentuk penindakan pelanggarannya, ataupun untuk dapat mengatakan mana yang merupakan pelanggaran dan mana yang bukan. Dalam penggunaan kendaraan bermotor di jalan raya, tidak sedikit pengguna kendaraan bermotor yang memodifikasi motornya dengan cara mengganti knalpot dengan tujuan meningkatkan performa ataupun mendapatkan suara yang lebih berisik demi kepuasan pribadi penggunanya. Dalam hal penggunaan knalpot yang sudah dimodifikasi ini pun menimbulkan keluhan dari sebagian masyarakat yang merasa terganggu dengan suara yang dihasilkan knalpot tersebut sehingga aparat kepolisian melakukan penindakan terhadap penggunaan knalpot yang sudah dimodifikasi tersebut. Permasalahan yang timbul pula adalah mengenai penindakan knalpot yang sudah dimodifikasi tersebut karena masih cukup menimbulkan pro dan kontra oleh sebagian pihak. Penelitian ini akan meneliti mengenai apakah sebenarnya penggunaan knalpot tersebut diperbolehkan dalam peraturan perundang-undangan dan bagaimana dengan kondisi penindakan pelanggaran penggunaan knalpot tersebut oleh aparat kepolisian di DKI Jakarta.
