"Skripsi ini membahas penyalahgunaan wewenang yang dilakukan salah satu staf khusus presiden berkaitan dengan Surat Edaran Staf Khusus Presiden Nomor 003/S-Skp-Atgp/Iv/2020 Perihal Kerjasama Sebagai Relawan Desa Lawan COVID-19 yang dikeluarkannya. Penelitian berfokus pada dasar pembentukan dan kewenangan dari staf khusus presiden berdasarkan peraturan perundang-undangan di Indonesia. Selain itu, fokus penelitian adalah unsur penyalahgunaan yang dilakukan staf khusus presiden tersebut. Metode penelitian yang digunakan dalam skripsi ini adalah yuridis-normatif yang menekankan pada norma hukum tertulis dan hasil penelitian disajikan secara deskriptif. Hasil penelitian ini menyimpulkan bahwa dasar pembentukan staf khusus presiden adalah melalui keputusan presiden dan wewenangnya hanya terbatas untuk membantu presiden sehingga segala yang dilakukannya berdasarkan komando presiden. Selain itu, ditemukan unsur penyalahgunaan wewenang dikarenakan tidak adanya pelimpahan wewenang atau perintah dari presiden. Berdasarkan hasil penelitian tersebut, Penulis menyarankan agar pemerintah mempertegas kewenangan staf khusus presiden dan staf khusus presiden diharapkan untuk mempertahankan integritasnya sebagai pejabat pemerintahan.

This thesis discusses the abuse of authority committed by one of the special presidential staff in relation to the Surat Edaran Staf Khusus Presiden Nomor 003/S-Skp-Atgp/IV/2020 Regarding Cooperation as a Village Volunteer Against COVID-19 that he issued. The research focuses on the basis of the formation and authority of special presidential staff based on Indonesian laws and regulations. In addition, the focus of the research is the element of abuse of power committed by the special presidential staff. The research method used in this thesis is juridical-normative which emphasizes written legal norms and the research results are presented descriptively. The results of this study conclude that the basis for the formation of special presidential staff is through presidential decrees and their authority is only limited to assisting the president so that everything he does is based on the president's command. In addition, an element of abuse of authority was found because there was no delegation of authority or orders from the president. Based on the results of this study, the author suggests that the government should strengthen the authority of the presidential special staff and the presidential special staff are expected to maintain their integrity as government officials.
