Abstrak :
Bahwa pembentukan Sovereign Wealth Fund (SWF) sendiri merupakan salah satu upaya yang dilakukan Pemerintah dalam rangka meningkatkan pertumbuhan ekonomi berkelanjutan dan menjaga kesejahteraan generasi mendatang dari suatu negara. Indonesia Investment Authority (INA) sebagai lembaga SWF di Indonesia dimaksudkan untuk dapat meningkatkan dan mengoptimalisasi nilai aset secara jangka panjang guna mendukung pembangunan secara berkelanjutan Indonesia sebagaimana hal ini dijelaskan dalam Pasal 165 ayat (2) UU Cipta Kerja. Urgensi pembentukan dari INA sendiri menjadi pertanyaan besar dikarenakan telah adanya lembaga Badan Usaha Milik Negara (BUMN) dan Badan Koordinasi Penanaman Modal (BKPM) yang telah dibentuk oleh Indonesia, namun dengan perbedaan yang mendasar seperti tujuan pembentukan INA dengan BUMN dan BKPM sendiri pun telah menjawab urgensi dari dibutuhkannya pembentukan INA sebagai suatu lembaga pengelola investasi di Indonesia. Kelembagaan INA diperkenalkan sebagai suatu sui generis atau kelembagaan yang memiliki karekter khusus. Dari sisi kebadanhukuman INA berbentuk sebagai badan hukum privat, dengan mekanisme perusahaan berbentuk badan hukum privat, modal pemerintah terpisah dari APBN dan bukan bagian dari keuangan negara. Dengan adanya Pasal 158 ayat (4) UU Cipta Kerja mengindikasikan apabila keuntungan dan kerugian INA hanya dihitung sebagai risiko bisnis dan tidak dapat dihitung sebagai keuntungan dan kerugian keuangan negara. ......Whereas the formation of the Sovereign Wealth Fund (SWF) itself is one of the efforts made by the Government in order to increase sustainable economic growth and maintain the welfare of future generations of a country. The Indonesia Investment Authority (INA) as a SWF institution in Indonesia is intended to be able to increase and optimize asset values in the long term to support Indonesia's sustainable development as this is explained in Article 165 paragraph (2) of the Job Creation Law. The urgency of the formation of the INA itself is a big question because there have been State-Owned Enterprises (BUMN) and Investment Coordinating Boards (BKPM) that have been formed by Indonesia, but with fundamental differences such as the purpose of forming an INA with BUMN and BKPM itself has answered the urgency of the need to establish INA as an investment management institution in Indonesia. The INA institution was introduced as a sui generis or institution that has special characteristics. In terms of legal entity, INA is in the form of a private legal entity, with the company mechanism in the form of a private legal entity, government capital is separate from the state budget and is not part of state finances. The existence of Article 158 paragraph (4) of the Job Creation Law indicates that INA's profits and losses are only counted as business risks and cannot be counted as state financial gains and losses.

Abstrak :
Indigenous hunting has always been an indigenous human rights core issue that has received high attention in the conflict between national laws and indigenous legal traditions. J.Y. Interpretation No. 803 affirmed indigenous hunting culture is a constitutional guaranteed fundamental right enjoyed by individual indigenous people. Nevertheless, the said Interpretation did not satisfy indigenous claimant’s assertions. The most critical are the collective nature of indigenous right and the aboriginal title still in the predicament of unclear concept and undetermined content. This article starts with a brief comparative law study, and then analyzes the said Interpretation, and continues with the theory of multicultural constitutionalism to make the argument based on the indigenous claims of traditional territorial rights.
