"Tulisan ini berangkat dari issue mengenai guru penggerak yang diinstruksikan oleh Mentri Pendidikan dan Kebudayaan, namun praktiknya kurikulum sangat menekan. Sehingga muncul guru transformatif dalam praktik hidden curriculum yang memberikan kontribusi terhadap pendidikan. Studi-studi sebelumnya membahas stakeholders dalam praktik hidden curriculum sekolah secara terpisah. Sedangkan dalam tulisan ini, peneliti ingin menunjukkan praktik hidden curriculum dan menunjukkan peran seluruh stakeholders sekolah menggunakan kerangka pemikiran Henry Armand Giroux. Penelitian ini merupakan penelitian studi kasus dengan pendekatan kualitatif. Temuan dalam penelitian ini ialah (1) kurikulum yang berlaku di sekolah Avicenna ialah kurikulum 2013 dengan pengembangan sesuai visi sekolah yaitu berkarakter kepemimpinan, berbasis sains dan teknologi, peduli pada lingkungan dan berprestasi (2) Praktik hidden curriculum dilakukan oleh pengurus yayasan dengan mengubah identitas, dan dilakukan oleh guru untuk mempertahankan identitas lama, terdapat relasi kekuasaan dan ideologi antar stakeholders sekolah (3) Dinamika muncul akibat kontestasi nilai antar stakeholders, karena guru menjalankan perannya sebagai intelektual transformatif dengan melakukan perjuangan untuk mempertahankan nilai (4) Dampaknya, siswa menjadi korban atas kontestasi nilai yang terjadi di sekolah. Penelitian ini memberikan saran bahwa perlunya kepercayaan, pemberdayaan dan public spehere untuk seluruh stakeholders sekolah dalam mendapat pencapaian yang maksimal.

This paper departs from the issue of the teacher instructor instructed by the Minister of Education and Culture, but in practice the curriculum is very pressing. So that transformative teachers emerge in the practice of hidden curriculum which contributes to education. Previous studies discussed stakeholders in the practice of hidden school curriculum separately. Whereas in this paper, researchers want to show the practice of hidden curriculum and show the role of all school stakeholders using the framework of Henry Armand Giroux. This research is a case study research with a qualitative approach.

The findings in this study are (1) the curriculum applicable at Avicenna school is the 2013 curriculum with development in accordance with the school's vision of leadership, science and technology-based, environmental care and achievement (2) The hidden curriculum practice is carried out by the foundation management by changing identity, and is done by teachers to maintain old identities, there are power relations and ideologies between school stakeholders value contestation that occurs in schools. This research suggests that the need for trust, empowerment and public spehere for all school stakeholders to get the maximum achievement."

"Skripsi ini membahas mengenai kedudukan Fenomena Meme Internet dari Perspektif Hukum Hak Cipta Indonesia, Uni Eropa dan Amerika. Penelitian ini menggunakan metode analisis data kualitatif yaitu dengan cara mengurai suatu hal hingga komponen dasarnya kemudian menganalisis hubungan masing-masing komponen dengan keseluruhan konteks dan pembahasan dari bermacam sudut pandang. Oleh karena itu, skripsi ini akan membahas bagaimana pengaturan pembatasan dan pengecualian Indonesia, Uni Eropa dan Amerika dan menganalisis kedudukan meme internet sesuai pengaturan tersebut. Meme internet sebagai bentuk kebebasan berekspresi dan telah menjadi bagian dari kehidupan berinternet sepatutnya diberikan ruang oleh Udang-Undang Hak Cipta. Kemudian setelah menganalisis yurisdiksi negara lain dapat dipelajari doktrin baru seperti Transformative Use yang diatur di Amerika Serikat dapat diimplementasikan ke dalam pengaturan hak cipta di Indonesia.

The focus of this study discusses the position of the Internet Meme Phenomenon from the perspective of Indonesian, European Union and American Copyright Law. This study uses a qualitative data analysis method, namely by breaking something down to its basic components and then analyzing the relationship between each component with the overall context and discussion from various points of view. Therefore, this thesis will discuss how to regulate the restrictions and exclusions of Indonesia, the European Union and America and analyze the position of internet memes according to these settings. Internet memes as a form of freedom of expression and have become part of internet life should be given space by the Copyright Act. Then after analyzing the jurisdictions of other countries, it is possible to learn new theories such as Transformative Use which is regulated in the United States, which can be implemented into copyright regulations in Indonesia."

Studi ini mengungkap pengalaman Pusat Pengembangan Sumberdaya Wanita PPSW Pasoendan dalam melibatkan laki-laki sebagai upaya mewujudkan transformasi sosial, terutama transformasi gender yang mana laki-laki sebagai aktor ikut berpartisipasi didalamnya. Temuan dari penelitian ini menunjukkan usaha transformasi PPSW Pasoendan tidak mudah tetapi bisa dilakukan yang ditunjukkan oleh adanya program non spesifik laki-laki dan program spesifik laki-laki yang ternyata berdampak secara internal organisasi dan eksternal masyarakat dampingan . Dampaknya adalah meningkatnya kesadaran dan praktik keterlibatan laki-laki dalam pekerjaan rumah tangga, pengasuhan anak dan juga penghargaan terhadap otonomi tubuh perempuan. ABSTRAKWomen 39 s economic empowerment programs have not been able to carry out social transformation because of the programs are women specific. This study sought to reveal the experience of Pasoendan Women 39 s Resources Development Center PPSW Pasoendan in involving men, as a social actor, to realize social transformation, especially gender transformation. The findings of this study show that the transformation process of PPSW Pasoendan is not easy, but it is possible as shown by the presence of non men specific program and men specific program that have significant impact both internally organizational and externally assisted community program beneficiaries . The participation of men in women 39 s economic empowerment programs have impacted three areas 1 increase men rsquo s participation in housework, 2 increase men rsquo s participation in childcare and 3 increase men rsquo s respect towards the autonomy of women rsquo s body reproductive rights. Those impacts are due to the involvement of men, not only on women 39 s economic empowerment programs but on other programs such as reproductive health and environmental health managed by PPSW Pasoendan. "

"Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta di Indonesia mengatur pembuatan karya derivatif hasil pentransformasian sebagai hak ekonomi ekslusif pemegang hak cipta. Di Amerika Serikat, istilah transformasi digunakan demikian pula dalam konteks hak ekonomi dalam Undang-Undang Hak Cipta Tahun 1976 dan dalam konteks pemeriksaan penggunaan yang wajar dalam case law atau hukum putusan hakim. Dalam case law, pentransformasian ciptaan bertujuan untuk melihat apakah penggunaan baru melakukan pentransformasian mdash;dengan cara mengubah tujuan dari karya asli mdash;atau sebaliknya hanya menggantikan benda dari karya asli. Berdasarkan kejadian tersebut, penelitian ini pertama-tama akan berfokus pada arti pentransformasian yang diatur dalam Undang-Undang Hak Cipta Indonesia dan ruang lingkupnya berkaitan dengan karya musik dan foto. Berikutnya, penelitian ini juga akan mencari tahu apakah pentransformasian yang diatur dalam Undang-Undang Hak Cipta Indonesia dapat digunakan sebagai pembelaan dalam pemeriksaan penggunaan yang wajar di Indonesia. Selanjutnya, berdasarkan penggunaan berkelipatan istilah transform di Amerika Serikat, penelitian ini juga akan mencari tahu apakah pentransformasian dalam pemeriksaan penggunaan yang wajar sebagaimana diterapkan di pengadilan Amerika Serikat dapat diterapkan dalam pemeriksaan penggunaan yang wajar di Indonesia, khususnya dengan mengacu pada pendapat pengadilan dalam kasus Campbell v. Acuff-Rose Music, Inc. dan Blanch v. Koons. Penelitian ini membahas masalah-masalah dengan menggunakan metode penelitian hukum yudisial-normatif dengan memeriksa Undang-Undang Hak Cipta Indonesia dan norma hukum di Amerika Serikat, termasuk peraturan perundang-undangan dan hukum putusan hakim.

The Indonesian Copyright Law No. 28 of 2014 regulates the preparation of derivative works of transformative use as an exclusive economic right of the copyright holder. In the United States, the term transformative use is used similarly in the context of the economic right under the Copyright Act of 1976 as well as in the context of the fair use inquiry in case law. In the latter, transformative use becomes a defining inquiry and defense within the fair use inquiry that aims to see whether a new work is transformative of the original mdash by way of giving the original a new purpose mdash or instead merely supersedes the original work rsquo s objects. Based on the aforementioned, this research will first focus on the meaning of transformative use regulated in the Copyright Law of Indonesia and its scope with regards to musical and photographical works. Next, this research will also assess whether the transformative use regulated within the Copyright Law can become a defense within Indonesia rsquo s fair use inquiry. Furthermore, based on the aforementioned multiple uses of the term transform in the United States, this research will also assess whether transformative use as applied in the fair use inquiry of the United States can be applied in the fair use inquiry of Indonesia, specifically by way of referring to the opinions of the courts in Campbell v. Acuff Rose Music, Inc. and Blanch v. Koons. This research approaches the issues using a judicial normative legal research method by examining the Copyright Law of Indonesia and the legal norms in the United States, including statutory regulations and case law. "

"Penulisan fanfiction atau karya penggemar menimbulkan pertanyaan mengenai status serta perlindungan hukum hak cipta yang diberikan baik kepada pencipta ataupun penulis karya fanfiction tersebut. Hal ini dikarenakan penulisan karya fanfiction tersebut tanpa izin dari pencipta dan/atau pemegang hak cipta karya asli. Dalam penelitian ini, metode yang digunakan adalah metode penelitian hukum normatif atau metode penelitian hukum kepustakaan. Penelitian ini menunjukkan bahwa karya fanfiction merupakan karya turunan yang tidak memiliki izin sehingga tidak mendapatkan perlindungan hak cipta. Bagi pencipta atau pemegang hak cipta, penulisan fanfiction merupakan pelanggaran hak moral dan/atau hak ekonomi mereka sehingga terdapat perlindungan preventif maupun represif yang dapat digunakan terhadap penulisan fanfiction tersebut. Sedangkan penulis fanfiction dapat menggunakan doktrin fair use sebagai perlindungan terhadap gugatan pelanggaran hak cipta yang diajukan kepadanya. Apabila fanfiction telah dimodifikasi sedemikian rupa sehingga tidak memiliki kesamaan substansial dengan karya aslinya, maka akan menghasilkan karya transformatif yang dilindungi oleh hak cipta. Karena penulisan karya fanfiction pada dasarnya merupakan pelanggaran hak cipta, maka penggemar sebaiknya melihat terlebih dahulu pendapat pencipta atau pemegang hak cipta mengenai penulisan fanfiction dan tidak mengkomersialisasikan fanfiction tersebut untuk mencegah gugatan pelanggaran hak cipta.

The writing of fanfiction raises questions about the legality and copyright protection of either the author or the writer of the fanfiction itself. These questions occurred from the fact that the writing of fanfiction are done without the consent of the author and or copyright holder. The form of method that used to conduct this research is a normative judicial research. This research shows that fanfiction is an unauthorized derivative work, therefore does not hold a copyright protection. For either the author or copyright owner, the writing of fanfiction is a form of moral right and or economic right infringement, and for that there are preventive and repressive protections that can be used to protect their rights. On the other hand, the fair use doctrine can be used by the writer fanfiction as a defense against copyright infringement lawsuit filed by the copyright owner. A fanfiction that has been modified and changed in a way that it does not hold any substantial similarity with the original work falls under the transformative work, hence protected by the copyright law. Since the writing of fanfiction is a copyright infringement, fanfiction writer need to look further at whether or not the author or copyright owner approves of the writing of fanfiction based on their work and not to commercialize their fanfiction to avoid copyright infringement lawsuit."

"Fenomena musik Remix di Indonesia semakin berkembang dengan banyaknya masyarakat yang mulai menyukai jenis musik tersebut. Masalah yang muncul adalah ketidaksesuaian dalam penerapan hukum hak cipta pada layanan musik streaming, di mana para Remixer dapat dengan bebas mempublikasikan karyanya tanpa menyertakan musisi asli. Pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normatif. Temuan penelitian menunjukkan bahwa musik Remix merupakan hasil perkembangan teknologi dalam seni musik, yang melibatkan penggunaan fonogram dari karya musik lain yang kemudian dimodifikasi. Undang-Undang Nomor 28 Tahun 2014 mengatur hak cipta fonogram, di mana produser fonogram memiliki hak-hak mekanis. Remixer diwajibkan untuk memperoleh izin dari produser fonogram melalui perjanjian lisensi. Doktrin Transformative Use, yang pertama kali muncul di Amerika Serikat, memungkinkan penggunaan kreatif terhadap karya terdahulu dengan tujuan yang berbeda. Namun, dalam konteks hukum hak cipta Indonesia, penerapan doktrin ini masih terbatas karena pentingnya melindungi hak ekonomi dan moral pencipta, terutama produser fonogram. The phenomenon of Remix music in Indonesia is growing with many people starting to like this type of music. The problem that arises is the discrepancy in the application of copyright law on streaming music services, where Remixers can freely publish their work without including the original musicians. The approach used in this research is normative juridical method. The research findings show that Remix music is the result of technological developments in the art of music, which involve the use of phonograms from other musical works which are then modified. Law Number 28 of 2014 regulates phonogram copyrights, in which phonogram producers have mechanical rights. Remixers are required to obtain permission from the phonogram producer through a licensing agreement. The doctrine of Transformative Use, which first appeared in the United States, allows creative use of earlier works for different purposes. However, in the context of Indonesian copyright law, the application of this doctrine is still limited because of the importance of protecting the economic and moral rights of creators, especially phonogram producers. Therefore, use of the phonogram work by others must be based on a licensing agreement and payment of royalties. This research provides an in-depth understanding of the problem of copyright protection for Remix music in Indonesia and recommends the need for clearer regulations to accommodate the application of the Transformative Use doctrine."

"North Korean refugees face myriad challenges in China which makes it difficult to obtain access to formal education. The Chinese classifies them as ilegal, economic migrants. If they are caught by authorities in China, they face deportation to North Korea, which can result in torture, incarceation, and even execuation. It is important to learn more about the educational experiences, both formal and informal, of Nortjh Korean refugees in China so that aid organizations can better assist them by providing quality educational programs while concealing the refugees identities. Paticipants in the study were North Korean refugees in their twenties who live South Korean and had travelled through China or lived in China prior to againing asylum through a South Korean consultateThe study was conducted with North Korean refugess in South Korea since North Korean refugees in China are sirk being sent back to North Korea if expposed. Several types of data wre colleted including a demographic survey, a timeline of primary life events, standardixed open-ended interviews, and journal entries. This article discusses primary themes that emerged related to the educational experiences of North Korean refugees in China in light of their exposure to human rights violations."
