Perlindungan hukum terhadap performer's rights dalam perjanjian antara artis pemain sinetron dengan produkser rumah produksi

Pembuatan suatu sinetron tidak terlepas dari terselenggaranya kerjasama yang baik antara artis pemain sinetron dan produser rumah produksi. Perjanjian kerjasama ini formatnya dirancang seluruhnya oleh produser rumah produksi. Perjanjian baku ini memuat klausul-klausul baku yang harus dipenuhi oleh artis pemain sinetron. Tujuan dari penelitian ini adalah untuk mengetahui perlindungan hukum yang dimiliki oleh pihak artis pemain sinetron dan produser rumah produksi, terutama klausul baku mengenai peralihan performer's rights dari artis pemain sinetron kepada produser rumah produksi. Metode penelitian yang dipergunakan adalah yuridis normatif.Berdasarkan hasil penelitian, dapat diambil simpulan bahwa peralihan atas performer's rights sudah sesuai dengan ketentuan Undang-Undang Nomor 19 Tahun 2002 tentang Hak Cipta, namun artis pemain sinetron tidak mempunyai posisi menawar (bargaining position) pada saat ketentuan tersebut tidak memberikan kompensasi selain honorarium yang telah diperjanjikan sebelumnya. Peralihan hak ini tidak memenuhi unsur keadilan. Peralihan hak harus disertai dengan kompensasi yang sesuai yang disebut sebagai remuneration rights. Hasil penelitian menyarankan agar remuneratin rights ini juga diatur dalam undang-undang hak cipta agar perlindungan performer's rights artis pemain sinetron menjadi lebih baik. The most important thing in the making of sinetron is the agreement between the artists and the producers of production house. The agreement itself is made by the producers of production house, and the artists have to obey it when they decide to sign the agreement. The purpose of this study is to understand the law protection of the artists and the producers of production house. This research is yuridis normative.The conclusion of this research is the artists have no better bargaining position to the agreement consist of the transfer of performer's rights. According to the agreement, the artists will transfer the performer's rights to the producers of production house without any compensation. Although this agreement is approriate with the national Literary and Copyright Works, but that is not fullfill justice requirements. The artists deserve to have compensation of this transfer. This rights of compensation is remuneration rights. The researcher suggest that the remuneration rights should be regulated by the national regulation of the national Literary and Artistic Works to protect the performer's rights of the artists. |
