Pada asasnya apabila penguasa ataupun pengusaha /kalangan bisnis memerlukan tanah untuk keperluan apapun, maka cara untuk memperoleh tanah yang diperlukan harus melalui musyawarah antara pihak yang memerlukan tanah dengan pemegang hak atas tanah hingga tercapai kesepakatan antara kedua belah pihak. Bahwa Peraturan Presiden Nomor 36 Tahun 2005 Jo Peraturan Presiden Nomor 65 Tahun 2006 sebagai suatu pedoman bagi pelaksanaan pengadaan tanah untuk kepentingan umum harus memperhatikan kepentingan pemegang hak atas tanah yang terkena dampak atas pelaksanaan pengadaan tanah tersebut. Penelitian ini dianalisis secara deskriptif analitis dengan dengan menggunakan metode pendekatan yuridis normatif. Pelaksanaan pengadaan tanah harus dilakukan berdasarkan asas-asas perolehan tanah, asas kesejahteraan dan perlindungan hukum yang diberikan kepada pemegang hak atas tanah. Berdasarkan hasil analisa dalam penelitian ini,ternyata Peraturan Presiden Nomor 36 Tahun 2005 Jo Peraturan Presiden Nomor 65 Tahun 2006 kurang memberikan perlindungan hukum dan kurang menjamin kesejahteraan pemegang hak atas tanah yang terkena pengadaan tanah. Basically, when the authorities or operators / among businesses require land to any needs, then how to acquire land needed to go through deliberations between the party who requires the land to the right land owners until reach an agreement between both parties. That the Presidential Regulation Number 36 Of 2005 amended by Presidential Regulation Number 65 Of 2006 as a guideline for the implementation of the land acquisition for public interest should considering the right land owners who affected by the implementation of land acquisition. This research is a descriptive analysis by using the method of analytic under juridical normative approach. Implementation of land acquisition should be based on the fundamental of land acquisition, basic welfare and protection of the law given to the land owner. Based on analysis in this research, it appears to Presidential Regulation Number 36 Of 2005 amended by Presidential Regulation Number 65 Of 2006 providing less legal protection and less prosperity to the land rights owners who affected by the land acquisition. |
