ABSTRACT An idea to construct a code of ethics in acountry is a result from an idea of ethical reformation,code of ethics and code of behaviors in numbers ofparliaments in the world, ethical regime and code ofethics. The idea begins first in a private sector, alsopublic sector for democration and being active in anydemonstration for people trust that have been entrustedto governmental officials. One of the governmentalinstitutions in Unitary State of Republic of Indonesia(NKRI/Negara Kesatuan Republik Indonesia) is IndonesianLegislative Assembly (DPR-RI/Dewan Perwakilan Rakyat-Republik Indonesia) , regulated in VII of the 1945Constitution where Article 19 and 22 B are. Theinstitution makes another institution controlling itsmembers' daily ethics, named Ethical Committee (BK/BadanKehormatan) which is ad hoc. Then, this is permanent andhas a legal power. The Ethical Committee is regulated inthe Article 98 Sub (2) alphabet g, the Act No.22/2003Susduk People's Consultative Council (MPR/MusyawarahPermusyawaratan Rakyat), Indonesian Legislative Assembly(DPR-RI) , Leadership of Political Party at local level(DPD/Dewan Perwakilan Daerah), and DPR-RI aboutcomprehensiveness and support and Decision of DPR No.08/1/2005-2006 on DPR-RI on the Order and Code of Ethicsof DPR-RI. The effectiveness is regulated in the Article60, punishment is through complain, process, 14 dayssince the complain, and 14 days later, the letter ofinvitation is sent to a related member, at least 3-daysbefore meeting. The meeting is different from othercourts. When the decision of Ethical Committee bringspunishment due to breaking the Code of Ethics, thedecision is final and there is no comparison. Thecomparison between Code of Ethics in DPR-RI EthicalCommittee and that in other countries is substantivelysimilar, but the punishment is different. The EthicalCommittee of DPR—RI has discharged one's membership ofDPR-RI members because of his breaking the EthicalCommittee's Code of Ethics. The mechanism is regulated inthe Act of Regional Government No. 32/2004. |
