ABSTRAK Pendaftaran Tanah untuk pertama kali (InitialRegistration) yang dilakukan terhadap tanah-tanah girik ataumilik adat memerlukan data pendukung berupa Salinan Letter C,Surat Keterangan Riwayat Tanah dan Surat Keterangan TidakSengketa yang dikeluarkan oleh Kepala Desa yang diambil daribuku-buku register tanah tingkat desa yang memerlukankecermatan pada saat pengisiannya, pemeliharaan danpenyimpanannya sehingga menjadi data yang dijaminkebenarannya. Hal ini menjadi tanggung jawab dari Kepala Desakarena apabila terdapat kekeliruan berdampak pada kesalahandata yang menjadi dasar pembuatan Surat Keterangan RiwayatTanah dan Surat Keterangan Tidak sengketa, yang pada akhirnyajuga berdampak pada kekeliruan data fisik dan data yuridisdalam penerbitan sertipikatnya. Hal ini dapat menimbulkanpermasalahan tanah seperti overlapping / sertipikat ganda /tumpang tindih. ^ ,Kesalahan dalam mengeluarkan data tanah tersebut,seorang Kepala Desa dapat dimintai pertanggungjawaban baiksecara pidana, perdata atau sanksi administratif berupateguran, pemberhentian sementara atau tetap dari jabatankepala desa berdasarkan Peraturan Pemerintah Nomor 2 ahun2005.Untuk mengurangi terjadinya kesalahan data registertanah tingkat desa, perlu pembinaan, bimbingan dan penyuluhansehingga meningkatkan pengetahuan aparat desa khususnyamengenai peraturan di bidang pertanahan dan a ministrasipemerintahan, sedangkan untuk mengurangi terjadinyaoverlapping tersebut perlu kecermatan dan ketelitian dalamproses pendaftaran tanah khususnya pada pengukuran danpemetaan di kantor pertanahan.Untuk penyelesaian masalah overlapping tersebut,berdasarkan Peraturan Menteri Negara Agraria / Kepala BadanPertanahan Nasional Nomor 9 tahun 1999 Kantor Pertanahandapat membatalkan sertipikat tersebut baik atas permohonanpihak yang berkepentingan ataupun berdasarkan kewenanganPejabat Kantor Pertanahan. Despite of other reasons theproblem, a complete inexistence of land registry map speciallywhen the government applied the Government ordinance Number 10 in1961 and with Government ordinance Number 24 in 1997 possibilitiesoverlapping can be minimized for by PP 24 / 1997 have been enabledusage modern technology in measurement and mapping.For problem solution overlapping certificate, the Office ofLand Affairs has the authority to cancel certificates, based onState's Minister rule of Agrarian Affairs / Head of National ofland affairs Number 9 in 1999.
