ABSTRAK Konvensi Cape Town 2001 yang telah diratifikasiberdasarkan Keputusan Presiden Republik Indonesia No. 8 Tahun2007 bertujuan membentuk suatu perangkat hukum yang berlakudiantara negara peserta atas benda-benda bergerak padaumumnya dan terhadap pesawat udara, helikopter dan peralatanbergerak yang berhubungan dengannya. Tingginya biayapengangkutan udara di Indonesia disebabkan besarnya biayapengadaan pesawat udara sebagai akibat besarnya resiko yangditanggung kreditur, lessor atau penjual dalam hal debitur,lessee atau pembeli cidera janji diantaranya kendala dalammelaksanakan penghapusan tanda daftar dan kebangsaan sertaekspor pesawat udara. Resiko tersebut pada umumnya dialihkankepada perusahaan asuransi yang biayanya menjadi bebandebitur, lessee atau pembeli pesawat udara dan sebagaiakibatnya debitur, lessee Indonesia sebelum diratifikasinyaKonvensi Cape Town 2001 hanya mampu melakukan sewa guna usahaatas pesawat udara yang lama atau tidak baru. Penelitian inibersifat normatif yuridis dengan meneliti sinkronisasiperaturan perundang-undangan yang berlaku serta menggunakanmetode deskripsi analitis dengan menganalisa aspek-aspekhukum yang menjadi kendala praktek pelaksanaan hak-hakkreditur, lessor dan penjual dalam hal debitur, lessee ataupembeli cidera janji khususnya dalam proses penghapusanantanda daftar dan kebangsaan serta ekspor pesawat udara yangpernah dioperasikan oleh PT Air Paradise dan PT Efata PapuaAirlines. Dari penulisan ini dapat disimpulkan bahwaperaturan perundangan yang berlaku saat ini memungkinkanpihak Perhubungan Udara tidak mengabulkan permohonanpenghapusan tanda pendaftaran dan kebangsaan pesawat udarayang tidak diajukan oleh operator/Iessee, meskipun untuk itulessor/pemilik terdaftar bertindak untuk dan atas namaoperator/lessee berdasarkan surat kuasa yang dibuatsebelumnya. Ratifikasi terhadap Konvensi Cape Town 2001 akanmemberi kepastian hukum bagi kreditur, lessor atau penjualuntuk melaksanakan hak-haknya berdasarkan perjanjian yangtelah disepakati dengan pihak debitur, lessee atau pembelidiantaranya dapat dicatatkannya hak kebendaan ataskepentingan internasional (International Interest) padapencatatan internasional (International Registry) sertaterjaminnya hak untuk melaksanakan penghapusan tanda daftardan kebangsaan pesawat udara dan mengekspornya dalam haldebitur, lessee atau pembeli cidera janji. ABSTRACT The Cape Town Convention 2001, which was ratifiedpursuant to Decision of the President of the Republic ofIndonesia No. 8 of the year 2007 is intended to establish aset of rules which will apply amongst the members inrelation to movable goods in general and on aircraft,helicopters and other moveable equipment in relationthereto. The high cost for air transportation in Indonesiahas been in part caused by the high cost of aircraftprocurement due to the risk borne by creditors, lessors orsellers in the case the lessees or purchasers default,including among others, the constraint to proceed with thederegistration of the registration mark and nationality aswell as exportation of aircraft. Such risk is usually takenon by insurance companies which cost shal] be born by thedebtors, lessees or purchasers of an aircraft andconsequently, debtors or Indonesian lessees before theratification of the Cape Town Convention 2001 could onlylease not a new aircraft. This thesis has the character ofnormative law by analyzing the synchronization of theprevailing laws and regulations and using the methodologyof descriptive analysis by analyzing the legal aspectswhich restrict the practice of implementing the rights ofthe creditors, lessors and sellers in the event thedebtors, lessees or purchasers are in default, particularlyin the case of the deregistration and export process ofaircraft which were operated by PT Air Paradise and PTEfata Papua Airlines. From this analysis, it can beconcluded that the prevailing regulations enable the AirAuthority to reject a deregistration request which is notmade by the operators/lessors, even though thelessors/registered owners are acting for and on behalf ofthe operator/lessee by virtue of a power of attorney madeearlier. The ratification of the Cape Town Convention 2001shall give legal certainty to creditors, lessors or sellersto implement their rights arising from an agreement legallyentered into between the parties, among others, theregistration of International Interest at the InternationalRegistry, legal certainty on the right to apply forderegistration of the aircraft from the aircraft registryand legal certainty to apply for exportation. |
