ABSTRAK Peraturan mengenai rumah susun saat ini diatur didalam Undang-Undang No.16tahun 1985 tentang Rumah Susun. Penghuni Rumah Susun wajib membentukPerhimpunan Penghuni yang bertugas mengatur kehidupan bersama sesamapenghuni didalam rumah susun. Berdasarkan Pasal 10 Undang-Undang No.16tahun 1985 tentang Rumah Susun, pemindahan hak milik atas satuan rumah susundari penyelenggara pembangunan kepada pembeli pemindahan haknya harusdilakukan dengan Akta Pejabat Pembuat Tanah (PPAT) akan tetapi, dewasa inidalam kegiatan pemasaran properti khususnya rumah susun di Indonesiaseringkali satuan rumah susun dijual dengan jalan Perjanjian Pengikatan Jual beliyang tidak dilanjutkan ketahap pembuatan Akta Jual Beli. Yang menjadipertanyaan dan akan dibahas dalam penulisan ini adalah bagaimana penyelesaianperkara yang teijadi antara Perhimpunan Penghuni Rumas Susun terkait denganpersoalan kehidupan bersama didalam rumah susun bila dikaitkan dengan unitunitrumah susun yang dijual hanya berdasarkan Perjanjian Pengikatan Jual Beli.Apakah dengan Peijanjian Pengikatan Jual Beli telah teijadi peralihan hak antaraDeveloper dengan pihak ketiga?
