Abstract
ABSTRAK
Sejak KPPU didirikan sebagai lembaga dengan Keputusan Presiden Nomor 75 Tahun 1999 Tentang Komisi Pengawas Persaingan Usaha, telah ada lebih dari 100 kasus persekongkolan tender secara vertikal yang melibatkan panitia tender sebagai terlapor. Secara garis besar, tugas dan wewenang KPPU adalah untuk mengawasi dan menindaklanjuti pelaku usaha agar bersaing secara sehat dan tidak melanggar Undang-Undang Nomor 5 Tahun 1999 Tentang Larangan Praktek Monopoli Dan Persaingan Usaha Tidak Sehat. Namun, panitia tender bukanlah pelaku usaha dan seharusnya tidak menjadi yurisdiksi KPPU untuk menanganinya. Skripsi ini akan membahas permasalahan tersebut sehingga mendapatkan pemahaman yang benar dan mendalam akan kedudukan hukum panitia tender dalam kasus-kasus persekongkolan tender secara vertikal di Indonesia.
ABSTRACT
Since the establishment of KPPU with Presidential Decree Number 75 Year 1999 Concerning Commission for the Supervision of Business Competition, there are more than 100 cases of vertical collusive tendering involving tender committee as one of the reported parties. In broad, duties and authority of KPPU are to supervise and to follow up business actors for healthy competition and not to violate Law Number 5 Year 1999 Concerning Prohibition of Monopolistic Practices and Unfair Business Competition. However, tender committee is not a business actor and, thus, not in the jurisdiction of KPPU to handle. This thesis will discuss those problems in order to get the right and in depth understanding about tender's committee's legal standing in vertical collusive tendering cases in Indonesia.
