Tesis ini menggambarkan tentang Pemberitaan pers dalam sebuah kasuskonflik dapat berdampak kondusif maupun destruktif. Berdampak kondusifapabila pemberitaan yang dihasilkan secara objektif mampu memberikan rasadamai terkait dengan situasi yang ada. Sedangkan bersifat destruktif apabilapemberitaannya malah dapat memicu atau memperbesar sebuah konflik. Untukpemberitaan yang dianggap bersifat destruktif, insan pers dapat dikenakanpertanggungjawaban atau dijerat dengan tindak pidana pers (delik pers), baikmengacu pada pasal-pasal KUHP dan UU No. 40 tahun 1999 tentang pers yangsaling melengkapi. Delik pers yang dapat digunakan terkait dengan pemberitaankasus konflik adalah delik penabur kebencian, delik agama, dan delik beritabohong. Selain itu, dalam kedua perundang-undangan tersebut diatur juga pihakpihakyang bertanggung jawab atas sebuah pemberitaan pers serta sanksi atauhukuman pidana yang diterima. Perbedaan di antara kedua perundang-undangantersebut adalah dalam melihat pihak yang seharusnya bertanggung jawab atassebuah pemberitaan pers. apabila KUHP mengatur bahwa setiap insan pers (setiapindividu) dapat dikenakan pertanggungjawaban, maka dalam UU No. 40 tahun1999 hanya pemimpin redaksi yang dapat dikenakan pertanggungjawaban. Dalampenerapannya, ketiga delik pers tersebut dapat digunakan untuk menjerat insanpers dalam beberapa contoh pemberitaan, khususnya terkait dengan kasus konflikdi Ambon dan Sampit. Abstract The thesis describes a Press Release in a conflict case which may haveconducive and destructive impacts. It will have conducive impacts if the news isproduced objectively and may result in peaceful feeling related to the existingsituation. On the other hand, it will be destructive if the news can even trigger ormagnify a conflict. For the news considered as destructive, the members of thepress may be charged to be accountable or indicted with press criminal acts (pressoffense), referring to the articles of Penal Code and the Law No. 40 of the year1999 on Press (those two laws mutually complement each other). The pressoffenses which may be used related to the press release of a conflict case are thehatred spread offense, religion offense, and untrue news offense. In addition, inthe two laws the parties accountable for a press release and the sanction orcriminal punishment sentenced are governed. The difference between those 2 lawsis in looking at the parties who should be responsible for a press release. ThePenal Code governs that every member of the press (each individual) may becharged accountable, whereas in the Law No. 40 of the year 1999 only the head ofthe editorial staff can be charged accountable. In its implementation, the threepress offenses can be used to indict the members of the press in several examplesof a press release, especially related to the conflict cases in Ambon and Sampit. |
