Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen mengatur beberapa hal mengenai hak konsumen terhadap informasi produk yang dikonsumsinya. Konsumen Indonesia, secara khusus juga merupakan konsumen obat-obatan yang mempunyai hak atas informasi terhadap obat-obatan yang mereka beli dan konsumsi. Skripsi ini membahas bagaimana analisis peraturan perundang-undangan yang mengatur mengenai hak konsumen atas informasi terhadap fakta yang terjadi terkait dengan pelanggaran-pelanggaran yang dilakukan oleh pelaku usaha dalam pemenuhan hak konsumen atas informasi obat. Skripsi ini juga membahas pelanggaran-pelanggaran yang dilakukan oleh pelaku usaha dalam peredaran produk obat kuat impor, serta pengaturan mengenai perlindungan hukum terhadap konsumen yang mengalami kerugian akibat mengkonsumsi obat tersebut. Hasil penelitian menyarankan bahwa dalam membeli produk obat kuat impor tersebut, sebaiknya konsumen menerapkan prinsip kehati-hatian; diadakan kerja sama antara Badan Pengawas Obat dan Makanan dengan pihak Kepolisian dalam pengawasan peredaran produk obat kuat impor; diadakan sosialisasi, edukasi mengenai obat yang memenuhi standar yang baik kepada masyarakat, khususnya dalam pemenuhan hak konsumen obat secara umum; dan penyuluhan tentang Undang-Undang Perlindungan Konsumen.
The Law Number 8 Year 1999 on Consumer Protection rules some consumer rights about product information which is consumed. Indonesian consumers, especially health consumers also have information right about medicines they buy and consume. The focus of this study is the consumer protection aspect on the distribution of medicine products, is thesis discusses how the analysis of legislation regulating for the rights of consumers to information on facts that occurred related to the violations committed by the medicine entrepreneur in the fulfillment of consumer rights for medicine information. This thesis also discusses the violations made by the seller in distribution of imported wonder pills product, as well as setting the legal protection of consumers who suffered losses due taking the pills. The results suggested while buying imported wonder pills product, the consumer should apply the precautionary principle; held the cooperation between the National Agency of Drug and Food with the police in monitoring the circulation of imported wonder pills product; held socialization, education about medicines that meet the standards of good to community, particularly in the fulfillment of medicine consumer rights in general, and counseling on the Law of Consumer Protection. |
