Abstrak
ABSTRAK
Gejolak yang timbul dalam lingkungan Universitas Indonesia membuat cikal bakal pembuatan skripsi ini. Skripsi ini berisi mengenai mekanisme yang akan dijalankan berdasarkan perspektif peraturan perundang-undangan, dan Pusat Administrasi Universitas Indonesia guna mengalihkan status kepegawaian Tenaga pendidiknya. Status kepegawaian yang dimaksud dialihkan menjadi Pegawai Negeri Sipil dimana sebelumnya tenaga Pendidik Universitas Indonesia berstatus pegawai Universitas Indonesia Badan Hukum Milik Negara. Diharapkan dengan adanya penelitian ini, tenaga pendidik yang berstatus Pegawai BHMN dalam lingkungan Universitas Indonesia atau di luar Universitas Indonesia dapat memiliki pedoman dan kejelasan serta menghapuskan keraguan-raguan atas status yang dimilikinya. Metode penelitian yang digunakan adalah dengan melakukan studi literatur dan wawancara dengan narasumber. Hasilnya adanya kesamaan antara Pusat Administrasi Universitas Indonesia dengan Pegawai UI, hanya saja kurangnya komunikasi membuat masalah ini menjadi berlarut-larut. Kesimpulannya status Pegawai Tetap Universitas Indonesia dengan SK Rektor sebagai Kepastian Hukumnya merupakan salah satu jalan keluar guna menjamin kepastian hukum selagi menempuh proses pengangkatan secara langsung oleh Pemerintah Pusat.
ABSTRACT
The turmoil arising within the University of Indonesia makes the embryo creation of this thesis. This thesis contains the mechanism that will be run based on the perspective of legislation and the Central Administration of the University of Indonesia, in order to divert personnel employment status of educators. Employment status is transferred to the Civil Servants who previously educators status as an employee of University of Indonesia as Government Owned Legal Entity. Hopefully with this research, educators with the status of Government Owned Legal Entity Officer within the University of Indonesia or other university as Government Owned Legal Entity may have the guidance and clarity as well eliminating doubts over the status they have. The research method used is to do a literature study and interviews with sources. Answer obtained is the similarity of purposes between the Central Personnel Administration by the University of Indonesia and the educators of University of Indonesia, it is just a lack of communication makes the problem becomes protracted. In conclusion, the status of Permanent Employees with the Rector University of Indonesia as a legal certainty is one way out to ensure legal certainty as to take the process of direct appointment by the Central Government.
