Tesis ini membahas tentang penyidikan tindak pidana kehutanan oleh Polri terhadap pelanggaran hukum pidana di bidang kehutanan yang dilalukan oleh perusahaan-perusahaan penebangan kayu. Dari hasil penelitian ditemukan datadata yang menunjukkan bahwa telah terjadi hambatan dalam proses penegakan hukum pidana korporasi di bidang kehutanan, dimana dalam proses penegakan hukum oleh Polri, tidak menerapkan konsep pertanggungjawaban pidana korporasi kepada perusahaan-perusahaan pelaku tindak pidana.Di sisi lain, proses penegakan hukum yang dilakukan oleh polri, pada dasarnya bukanlah untuk kepentingan polri semata, namun untuk kepentingan yang lebih luas lagi. Disamping itu, upaya penegakan hukum oleh polri selama ini tidak menciptakan efek jera kepada korporasi pelanggar tindak pidana di bidang kehutanan, dan oleh karena itu perlu dilakukan upaya penyidikan secara lebih progresif terhadap tindak pidana kehutanan dengan mulai menerapkan konsep pertanggungjawaban pidana korporasi pada setiap proses penyidikan tindak pidana korporasi di bidang kehutanan.Penerapan pertanggungjawaban pidana korporasi dalam proses penyidikan oleh polri sebenarnya membawa dampak positif lainnya yaitu koporasi juga dapat dibebankan sanksi administratif lainnya seperti denda dan pencabutan izin usaha, sehingga meniadakan keuntungan ekonomis yang dapat diraih korporasi atas pelanggarannya tersebut.
This thesis discusses the investigation of criminal offenses by police to forestry violations of criminal law in the field of forestry that is passed by the logging companies. From the results of the study it is found data that indicate there has been a bottleneck in the process of corporate criminal law enforcement in forestry, which is in the process of Law enforcement by the police, do not apply the concept of corporate criminal liability to the companies.On the other hand, the law enforcement process conducted by the national police, are basically not merely for the sake of national police, but for the wider interests to serve and protect the comunity. In addition, law enforcement efforts by the national police has not created a deterrent effect on corporate crime violators in the field of forestry, and therefore needs to be done in a more progressive investigative efforts against crime forestry with begin to apply the concept of corporate criminal liability in any process of investigation of criminal criminal corporations in the field of forestry.The application of corporate criminal liability in the process of investigation by the national police actually bring other positive effects which can also be charged corporation for other administrative sanctions such as fines and revocation of business licenses, thus negating the economic benefits that can be achieved by the corporation for the infraction. |
