Koordinasi dan pengawasan penyidik Polri terhadap proses penyidikan tindak pidana yang dilakukan oleh Penyidik Pegawai Negeri Sipil telah diatur dalam KUHAP, UURI Nomor 2 tahun 2002 tentang Polri, dan Peraturan Kapolri Nomor 6 tahun 2010 tentang Manajemen Penyidikan oleh Penyidik Pegawai Negeri Sipil, serta Peraturan Kapolri Nomor 20 tahun 2010 tentang Koordinasi, Pengawasan dan Pembinaan Penyidikan bagi Penyidik Pegawai Negeri Sipil. Koordinasi tersebut meliputi kegiatan pemberitahuan dimulainya penyidikan, pemberian bantuan penyidikan kepada Penyidik Pegawai Negeri Sipil (berupa bantuan teknis, bantuan taktis, bantuan upaya paksa, dan bantuan konsultasi), penyerahan berkas perkara, penyerahan tersangka dan barang bukti, penghentian penyidikan, tukar menukar informasi, rapat secara berkala, dan penyidikan bersama. Sedangkan pengawasan meliputi kegiatan menghadiri dan memberikan petunjuk dalam gelar perkara yang dilaksanakan Penyidik Pegawai Negeri Sipil, meminta dan meneliti laporan kemajuan penyidikan dari Penyidik Pegawai Negeri Sipil, bersama Penyidik Pegawai Negeri Sipil meneliti berkas hasil penyidikan lalu meneruskan kepada Penuntut Umum, melakukan supervisi bersama ke jajaran Penyidik Pegawai Negeri Sipil sesuai permintaan pimpinan instansi Penyidik Pegawai Negeri Sipil, melakukan pendataan jumlah, instansi dan wilayah penugasan Penyidik Pegawai Negeri Sipil, penanganan perkara Penyidik Pegawai Negeri Sipil dan bantuan penyidikan, serta menganalisis dan mengevaluasi pelaksanaan penyidikan yang dilakukan Penyidik Pegawai Negeri Sipil. Dalam praktek di lapangan, koordinasi dan pengawasan tersebut tidak terlaksana secara optimal, bahkan ada yang menyimpang dari ketentuan yang berlaku. Penulisan tesis ini bertujuan untuk menunjukkan pelaksanaan koordinasi dan pengawasan penyidik Polri pada Seksi Korwas PPNS Dit Reskrimsus Polda Jabar terhadap proses penyidikan tindak pidana yang dilakukan oleh Penyidik Pegawai Negeri Sipil di daerah hukum Polda Jabar yang terjadi selama ini. Metode penelitian yang digunakan yaitu metode penelitian kualitatif melalui beberapa teknik pengumpulan data berupa pengamatan, wawancara, dan studi dokumen. Metode tersebut dipilih karena masalah yang diteliti termasuk katagori penelitian tindakan yaitu merupakan refleksi antara teori dan praktek. Hasil penelitian menunjukkan bahwa koordinasi dan pengawasan penyidik Polri terhadap proses penyidikan tindak pidana yang dilakukan oleh Penyidik Pegawai Negeri Sipil di daerah hukum Polda Jabar belum berjalan secara optimal, bahkan ada yang tidak sesuai ketentuan perundang-undangan yang berlaku.
Coordination and Controlling function of the Police Investigators on the process of criminal investigations by the Civil Servant Investigators has been regulated in the Criminal Law Code of Criminal Procedure, Law of the Republic of Indonesia Number 2 of 2002 on the Indonesian National Police, and the Regulations of the Indonesian National Police Chief number 6 of 2010 concerning investigations management by the Civil Servants investigators and the Regulation of the Indonesian National Police Chief number 20 of 2010 on Coordination, Supervision and Development Investigations for Civil Servants Investigators. Coordination activities include notification of commencement of the investigation, providing investigative assistance to the civil servants Investigator (in the form of technical assistance, tactical aid, relief efforts to force, and consulting assistance), submission of case files, the transfer of suspects and material evidence, termination of the investigation, information exchange, regular meetings, and joint investigations. While controlling function includes to attend and give instructions in case the title is held civil servant investigator, ask for and examine the progress of the investigation report of the civil servant investigators, examine the results of the investigation file and then going to the General Prosecutor, with the ranks of supervision civil servant investigators as requested by agency investigators led civil servants, perform data collection on the number of civil servant investigator, institution and area of assignment civil servant investigator, handling the case made by the civil servant investigators and aid the investigation, and analyze and evaluate the implementation of the investigation by the civil servants investigators. In practice in the field, coordination and controlling function does not ensure an optimal, even in defiance of regulations. This thesis aims to demonstrate the implementation of coordination and control conducted by Investigators of Indonesian National Police in Section Coordination and Controlling the civil servant investigators, Directorate of Special Criminal Investigation at Indonesian National Police in West Java to civil servant investigators in the process that occurred during this investigation. The research method used is qualitative research methods through data collection techniques, is observation, interviews and document studies. This method was chosen because of the problems examined include the category of action research is a reflection of theory and practice. The results show that the coordination and control of police investigators to the process of criminal investigations conducted by the Civil Servant investigators in the Law of the Republic of Indonesia Police Region of West Java is not running optimally, and even some that are not appropriate statutory provisions in force. |
