Yudisial power is free and independent in nature (Yudisial Independence). It is arranged in both the constitution and tire law. The judge in hearing and deciding a case must be free, objective and neutral. The judge must be free of any influences, including the influence of executive and legislative. The separation of Yudisial institution from the Department of Justice (executive) may result in concern that the Supreme Court (judicative) will became a party controlling indicative power (a tyranny). To prevent it from happening, a Komisi Yudisial is established as an independent institution (external control), whose function is to supervise and develop the judges (checks and balances). Many countries in the world already have a Komisi Yudisial, using different names. In addition to maintaining the standard and the value of judges, Komisi Yudisial also serves to recruit the judges of the Supreme Court. |
