ABSTRAK Salah satu wewenang Presiden sebagai Kepala Pemerintahan dalam sistempresidensil adalah wewenang mengangkat pejabat publik. Wewenang ini termasukdalam bidang wewenang administrasi yang disebut juga sebagai hak prerogatifPresiden. Wewenang ini merupakan wewenang yang melekat pada Presidensebagai bagian dari kekuasaan pemerintahan yang disebutkan pada Pasal 4 ayat(1) UUD 1945. Wewenang ini telah mengalami pembatasan setelah perubahanUUD 1945 sebagai akibat semakin dianutnya teori pemisahan kekuasaan padaUUD 1945. Presiden tidak dapat lagi dengan leluasa mengangkat pejabat publiktanpa melibatkan lembaga legislatif (DPR). Skripsi ini akan secara khususmembahas mengenai pengangkatan jabatan Wakil Menteri. Jabatan WakilMenteri, walaupun tidak disebutkan secara eksplisit pada Pasal 17 UUD 1945,bukan berarti bahwa jabatan Wakil Menteri ini inkonstitusional sehingga Presidentidak dapat membentuk jabatan Wakil Menteri ini. Berdasarkan pada PutusanMahkamah Konstitusi No. 79/PUU-IX/2011, jabatan Wakil Menteri tidakinkonstitusional sehingga jabatan Wakil Menteri tersebut dapat dibentuk. Putusanini juga memperkuat wewenang Presiden dalam mengangkat jabatan WakilMenteri. Abstract One of the Presidential power as Head of Government in presidential system ispower to appointing public official. This power is part of administrative powerwhich is also known as President prerogative. This power is attached to thePresident as part of the power of government mentioned in the article 4 paragraph(1) Indonesia constitution. This power has experienced restrictions after thechange of constitution as a result of the embrace of the theory of separation ofpowers in Indonesia constitution. President can no longer freely appoint publicofficials without involving the legislature (the House of Representatives). Thisthesis will in particular discuss the appointment of the position of Vice Minister.The position of Vice Minister, although not explicitly mentioned in Article 17Indonesia constitution, not mean that the position of Vice Minister of thisunconstitutional, so the President can not establish the position of Vice Minister.Based on the Constitutional Court Decision Number 79/PUU-IX/2011, theposition of Vice Minister not unconstitutional so that the position of Vice Ministercan be formed.
