Dengan meratifikasi Persetujuan Pembentukan WTO, yang di dalamnya mencakup Persetujuan TRIPs, Indonesia terikat pada seluruh aturan dalam Persetujuan TRIPs, termasuk prinsip national treatment. UU No. 15 Tahun 2001 tentang Merek, yang merupakan penyesuaian dengan Persetujuan TRIPs, tidak mengatur prinsip national treatment secara eksplisit di dalamnya. Sejumlah kasus contoh memperlihatkan bahwa dalam proses penyelesaian sengketa merek terkenal asing di Pengadilan Indonesia telah diterapkan prinsip national treatment Persetujuan TRIPs dalam bentuk pengaturan yang bersifat "no less favourable". By ratifying Agreement on Establishing the World Trade Organization, which includes Agreement on Trade Related Aspects of Intellectual Property Rights and Counterfeit Goods within, Indonesia is bound by the TRIPs Agreement’s provisions, including its national treatment principle. Law No. 15 Year 2001 on Trademark, which is a compliance regulation of TRIPs Agreement, does not regulate the national treatment principle explicitly. Some of the court decisions discussed confirm that the national treatment principle of TRIPs Agreement has been implemented in the dispute settlement process of foreign well-known marks in Indonesian Court, in the "no less favourable" rule model. |
